The Ping-Pong of transportation in Colombia

Abstract

La prestación del servicio de transporte a través de plataformas tecnológicas puede generar abusos frente a sus usuarios, debido a la falta de regulación que actualmente tenemos en Colombia. Este artículo busca identificar si dentro de los contratos de prestación de servicio de transporte prestados a través de plataformas, existen o no cláusulas abusivas que afectan al usuario y si su análisis es competencia de la Superintendencia de Industria y Comercio. Lo anterior, se logra a través del estudio de los términos y condiciones de cinco de las plataformas usadas en el país y se logra concluir que efectivamente existen cláusulas abusivas en la celebración de este tipo de contratos y que configuran a todas luces una relación que debería ser objeto de un juicioso estudio de dicha Superintendencia, con el propósito de cumplir con su finalidad de proteger al consumidor.The provision of transportation services through technological platforms may generate abuses against its users, due to the lack of regulation that we currently have in Colombia. This article seeks to identify whether or not there are abusive clauses that affect the user within the contracts for the provision of transportation services provided through platforms, and whether their analysis is within the competence of the Superintendence of Industry and Commerce. This is achieved through the study of the terms and conditions of five of the platforms used in the country and it is concluded that there are indeed abusive clauses in the conclusion of this type of contracts and that they clearly constitute a relationship that should be subject to a judicious study by the Superintendence, in order to comply with its purpose of protecting the consumer
