COMPETÊNCIA LEGISLATIVA EM MATÉRIA AMBIENTAL: UM CAMPO DE INDEFINIÇÃO NO FEDERALISMO BRASILEIRO

Abstract

The system of division of legislative competences on environmental issues established by the Federal Constitution of 1988 aimed to ensure a sphere of legislative autonomy to the federated entities through a mechanism of concurrent competence. This article intends to investigate the possibility of states and municipalities introducing protective systems which could be more rigid in relation to the general norms. Therefore, a study is proposed on decisions of the Supreme Federal Court involving possible conflicts of legislative competence between different federated entities. As a hypothesis, it is suggested that there is a reduced autonomy regarding supplementary competence, which is harming the sphere of legislative initiative of the states and municipalities to reinforce the protective norms.O sistema de repartição de competências legislativas em matéria ambiental estabelecido pela Constituição Federal de 1988 visou assegurar uma esfera de autonomia legislativa aos entes federados através de um mecanismo de competência concorrente. O presente artigo visa investigar a possibilidade de os estados membros e municípios introduzirem sistemas protetivos de maior rigidez em relação às normas gerais. Para tanto, propõe-se um estudo sobre decisões proferidas no âmbito do Supremo Tribunal Federal envolvendo possíveis conflitos de competência legislativa entre diferentes entes federados. Como hipótese, sugere-se haver uma autonomia reduzida em sede de competência suplementar, restando prejudicada a esfera de iniciativa legislativa dos estados e municípios para aprofundamento das normas protetivas
