Plant variety protection--A fascinating subject

Abstract

The rationale for, and implementation of, plant variety protection under Union pour la protection des obtentions végétales (UPOV) is described. Topics covered include the basic requirements under UPOV (e.g. minimum number of plant genera, minimum period of protection, minimum scope of protection, and the need for distinctiveness, uniformity, stability, novelty and acceptable denomination); the types of materials and plant varieties covered; exceptions to breeders' rights; national implementation and priority provisions; the relationship between plant variety protection and patent protection; reasons for, and administration of, national protection; implementation of rights; and information dissemination.UPOV Plant varieties Essentially derived varieties Breeders' rights Breeders' exemption National protection Information dissemination
