Biomassa e desenvolvimento sustentável e sócio regional no Brasil: uma análise à luz da Constituição Federal de 1988

Abstract

É verificada mundialmente uma crescente preocupação com a proteção dos recursos naturais do planeta, fato que ganhou força no Brasil a partir da promulgação da Constituição Federal de 1988, com base na ótica do desenvolvimento sustentável que busca promover as atividades econômicas no país em conformidade com a necessidade de conservação e preservação dos recursos naturais para o uso das presentes e futuras gerações. Ademais, busca-se reduzir as diferenças que ocorrem em nossa sociedade, ao determinar como objetivo fundamental a ser perseguido pela República Federativa do Brasil a redução das desigualdades sociais e regionais. Valor que também deverá ser observado no âmbito das atividades econômicas aqui desenvolvidas, pelo fato de tratar-se de princípio geral da ordem econômica e financeira do país. Assim, diante do esgotamento das reservas mundiais de combustíveis fósseis, bem como pelos impactos gerados ao meio ambiente, sobretudo pela grande emissão de gases de efeito estufa, amplia-se o debate acerca da necessidade da alteração da matriz energética mundial, surgindo as fontes renováveis de energia como a grande aposta global para atender os anseios contemporâneos de sustentabilidade, e despontando o Brasil em uma posição bastante favorável, por possuir as condições naturais essenciais para permitir o pleno desenvolvimento do setor. Nessa perspectiva, o trabalho tem o escopo de analisar como a produção de fontes renováveis de energia poderá atuar na busca pela concretização dos valores constitucionalmente consagrados, de promover o desenvolvimento sustentável para as gerações presentes e futuras, e diminuir as desigualdades sócio regionais, numa tentativa de melhorar a qualidade de vida da população. Observa-se ainda o marco regulatório das fontes renováveis de energia existente no ordenamento jurídico pátrio, a fim de verificar a existência da segurança jurídica e institucional necessária para garantir o pleno desenvolvimento do setor no país. E a averiguação dos resultados almejados ocorre através da avaliação concreta das práticas adotadas no setor, analisando a sua compatibilização efetiva com as previsões constitucionais ora em análise, a partir do exame da possibilidade de utilização de fontes biomassa para a produção de biocombustíveis na promoção do desenvolvimento do país, indicando as linhas iniciais acerca de como esse importante setor poderá atuar na solução do desafio energético da atualidadeIt is verified worldwide an increasing concern with the protection of natural resources in the planet, a fact that became relevant in Brazil since the promulgation of the Constitution of 1988, based on the viewpoint of sustainable development, which seeks to promote economic activities in the country according to the need for conservation and preservation of natural resources for the use of present and future generations. In this perspective, the work has the scope to analyze how the production of alternative energy sources may act in the search for concretization of constitutional values, to promote sustainable development for present and future generations, and to reduce regional and social inequalities in an attempt to improve the quality of life of the population. It will also be observed the current regulatory framework of alternative energy sources in the national laws to verify the existence of legal and institutional security, which is necessary to guarantee the full development of the sector in the country.
