Constitucionalidad de la facultad de cobro coactivo que tiene el Instituto de Seguros Sociales EPS, para el cobro de aportes parafiscales en Colombia

Abstract

Se presenta una investigación que determina la constitucionalidad de las facultades de cobro coactivo que tiene el Instituto de Seguros Sociales E.P.S. en Colombia. Para el análisis se aborda la descripción del procedimiento de cobro coactivo y a su vez se contrasta con los principios de juez natural, debido proceso e igualdad, encontrando que se desbordan tales principios, con lo cual se crean más fuentes de insatisfacción social, de conflictos sociales y en general creando una fuente más de violencia ante la insatisfacción por el abuso a sus circunstancias de inferioridad y las “cargas” arbitrariamente impuestas.An investigation is presented that determines the Constitutionality she gives the abilities, she gives coercive collection that has the Institute he/she gives Sure Social E.P.S. in Colombia.
