Critical review of Marc Amstutz, Evolutorisches Wirtschaftsrecht, Baden-Baden, 2001

Abstract

Ich kritisiere die Konzeption Amstutz’ aus einer Perspektive, die eine kulturelle Evolution im strikten Sinne als gegeben ansieht. Gemessen daran verspielt Amstutz den Nutzen evolutionären Denkens, indem er sich nur metaphorisch auf Evolution bezieht, ohne zugleich seinen Rechtsbegriff zu entwickeln. Das führt zu wissenschaftlich unbefriedigenden Aussagen, zumal saltationistische, quasi-lamarckistische und gruppenselektionistische Modelle genutzt werden, die weder für die biologische noch die kulturelle Evolution brauchbar sind.I criticise the concept of Amstutz from a evolutionary sounded point of view in the Darwinian sense. According to that I hold, that there is cultural evolution in the strict meaning. Compared to it Amstutz gambles away the use of evolutionary thinking by referring only metaphorically to evolution without developing its concept of „right“ at the same time. This leads to scientifically unsatisfactory statements, particularly since he introduces models with elements of saltationism, Lamarckism and group selectionism, which are useable for neither the biological nor the cultural evolution theory
