European and Croatian Regulation of Passenger Rights Protection in Air Transport

Abstract

Uredbom 261/2004 učinjen je daljnji korak u unaprjeđenju zaštite prava putnika u Europskoj uniji. Autorica obrađuje problematiku razvoja instituta odgovornosti zračnog prijevoznika za štetu u Europskoj uniji s posebnim osvrtom na Uredbu 261/2004, koja je stupila na snagu 17. veljaèe 2005. godine. Poseban naglasak je stavljen na potrebu usklađivanja domaćeg zakonodavstva s rješenjima predviđenim regulativom Unije, u skladu s obvezama preuzetim Sporazumom o stabilizaciji i pridrušivanju. Posebice se ističe potreba uvođenja objektivne odgovornosti zračnog prijevoznika za smrt i tjelesne ozljede putnika, po uzoru na Montrealsku konvenciju i Uredbu 889/2002 kojom su odredbe Montrealske konvencije prenijete u sekundarno pravo Unije.Regulation 261/2004 was a further step in the promotion of rotection of passenger rights in the European Union. The author examines the development of the institute of air carrier liability for damage in the European Union, paying special attention to Regulation 261/2004, which came into force on February 17th, 2005. Emphasis is placed on the need to harmonise domestic law with the solutions provided for in the Regulation, in accordance with obligations imposed by the Stabilisation and Association Agreement. The need to introduce objective liability of the air carrier for death and physical injury, as laid down in the Montreal Convention and Regulation 889/2002 which implemented the provisions of the Montreal Convention in the UnionÕs secondary legislation, is pointed out
