The Problem of Religious Guidance among Indian Muslims: A Forward-Thinking Proposal

    No full text
The Indian Muslim community faces a paradox, marked by the presence of religious leaders without a clear path forward. The article identifies a lack of guidance, particularly in matters of faith, as numerous Ulema offer conflicting fatwas, stemming from a flawed Ifta methodology. Tracing the historical evolution of fatwa issuance, the 19th-century shift in India, influenced by the East India Company's trade-focused policies, led to an abundance of independent Ulema. This article explores the historical evolution of Ifta in Islam, with a focus on India. It reviews the transition to formal fatwa institutions, compares practices across regions, and proposes centralizing fatwa authority through a high central council in India, offering recommendations for reform. The absence of a centralized authority for fatwa issuance in India results in a chaotic scenario. To address this, the author proposes a structured solution: establishing a high central council of diverse Ulema and intellectuals. This council would delegate responsibilities for religious and social issues to ensure uniformity in fatwa decisions nationally. However, the article underscores that councils alone are ineffective without legal enforcement authority. This article will show: 1) Abundance of Guidance and Contradictory Fatwas; 2) Evolution of Fatwa Issuance in Islamic History; 3) Current State of Fatwa Issuance and Recommendations for Reform. Additionally, it advocates reevaluating the concepts of 'Dar al-Islam' and 'Dar al-Harb' in the context of India's identity. The author suggests a Parliament-recognized Council to issue fatwas, aligning with democratic principles and reflecting shared ownership among India's diverse Muslim population

The research results show that To Sallang manages to maintain their social identity as a native of Toraja descent, as well as negotiate personal identity as a Muslim community by adapting their genius and creative assimilation to universal religious values and local wisdom (indigenous knowledge). Through theological concepts such as fitrah-sunnatullah (natural law), hablum min al-nas (social interaction), hurmatu al-takrim (respect and honor), and al-ma'ruf (values of goodness and wisdom that are rooted in the traditions of society) synchronized with local wisdom values such as sikamali (love-miss each other), siangga' (mutual respect), and siangkaran (help each other), To Sallang can present a comprehensive picture of religiosity that accommodates religious aspirations with cultural characteristics. To Sallang strategy could be the best practice and reference to build religious and cultural co-existence since they can survive with their Islamic identity and local wisdom to live together in a multicultural society. It can also be a blueprint for religious and cultural harmony in overcoming potential conflicts caused by ethnic and religious differences

The subject of interfaith marriage in Indonesia, including its pros and cons, has been in the public purview recently. This research aims to answer public concerns, provide recommendations for strengthening regulations, and even prevent this type of marriage. A qualitative method alongside a sociological approach was applied, while data collection techniques included interviews and literature studies. It was concluded through sadd al-żarī'ah analysis, that interfaith marriage should be prohibited as it only leads to harm and difficulties in households and families. Furthermore, fatḥ al-żarī'ah analysis of the marriage of a Muslim man to an Ahlu al-Kitab woman is permitted by the majority of scholars. This is due to the possibility of benefits, namely the opportunity to guide the woman to embrace Islam. it is emphasized that this possibility is relative, as the Muslim man may change his faith. Therefore, this facility (al-żarī'ah) should not be opened (fatḥ al-żarī'ah). The implications of this study recommend sadd al-żarī'ah as material for consideration in strengthening the rules regarding interfaith marriages in the future. Moreover, the polemic of interfaith marriage should be resolved immediately by affirming and enforcing changes to the marriage law. Legal vacuums in the regulation of this matter should not be allowed or ignored due to the negative impact in terms of social and religious life
