This guidance explains how maintenance support for living costs at colleges anduniversities will change when the lifelong learning entitlement (LLE) launches.The LLE will launch in the 2026 to 2027 academic year. If a student has a placement in a service-based fieldthat already exists (such as healthcare, education or social work), they will still beeligible to apply for full maintenance support.What learners study and howThe amount that learners are entitled to in each course year will depend on:how much they studyhow they study it – such as modules or short coursesIt will also be linked to a learner’s tuition fee loan balance. Learners taking fewerthan 120 credits in a course year will have their loan reduced proportionally to thenumber of credits in the year.Learners taking more than 5 credits per week on average will not get entitlementfor more than 5 credits per term week. This is equivalent to 50 hours of study perweek.Learners on course years longer than 30 weeks may qualify for extendedmaintenance support, if their household income is below £45,000.Learners taking 110 credits or more in the final year of their course will get lowerfinal year rates of loan. This is similar to now, where these rates apply to full-timestudents only.Learners with a tuition fee loan balance of £0 will not be entitled to maintenanceloans. Learners with less than 30 credits of tuition fee loan left will only be entitled tomaintenance loans if they use part of their remaining tuition fee loan balance topay for a course.Household incomeThe existing rules for assessing household income and calculating anydeductions will not change, for full-time or part-time students.The rules for calculating entitlement for part-time students will closely reflect thesystem used for full-time students. This means that household income will beused to assess eligibility for maintenance support – just as it is for full-timelearners.Learners who choose not to provide household income information will only beeligible for the minimum loan amount.Flexible studyLearners will be able to apply for a maintenance loan to study multiple courses ormodules at the same time. The Secretary has exercised these powers to transfer certain adult education functions of the Secretary of State under the Apprenticeships, Skills, Children and Learning Act 2009 (“the 2009 Act”) on the Tees Valley, Liverpool City Region, West Midlands, Greater Manchester, Cambridgeshire & Peterborough, West of England, North East, South Yorkshire, and West Yorkshire Combined Authorities in relation to the area of the relevant authority. Similar powers apply under s19 of the Levelling-Up and Regeneration Act 2023 in relation to Combined County Authorities.  In 2024, new technical qualifications at levels 2 and 3 were approved by the Institute for Apprenticeships and Technical Education (IfATE), to support the government’s ambition to raise the quality of post-16 education. The new reformed qualifications are high quality and are aligned to IFATE occupational standards to ensure they deliver the skills that employers need. Devolving this funding power will make sure that adults in devolved areas have full access to these high-quality qualifications.  The first qualifications will be available from 1st August 2025 and will be funded nationally under section 100(1B) of the Apprenticeships, Skills, Children and Learning Act 2009 (ASCLA).  To enable Combined Authorities and Combined County Authorities to fund the new technical qualifications from 2025, the Government is considering transferring the funding power under Section 100(1B) of Apprenticeships, Skills, Children and Learning Act 2009 (ASCLA) to them. A list of the new technical qualifications approved for funding can be found here: • for level 2 qualifications- New qualifications approved for funding at level 2 in England from 1 August 2025 – T Levels support for schools and colleges,  • for level 3 qualifications - New qualifications Approved for funding at level 3 in England from 1 August 2025 – T Levels support for schools and colleges  Any new devolved administrations will automatically have this funding power transferred to them as part of their devolution deal. However, the Combined Authorities mentioned above already have devolution arrangements in place or, in the case of York and North Yorkshire Combined Authority and the East Midlands Combined County Authority, have already started the process of devolution of adult skills functions. These Combined Authorities do not currently have the power to fund the newly reformed Level 2 and Level 3 technical qualifications, which means they won’t be able to use their Adult Skills Fund for these qualifications from the 2025/26 academic year. To ensure adult learners across England can access these qualifications, it is proposed that the Secretary of State uses powers under the Local Democracy, Economic Development and Construction Act 2009 and the Levelling Up and Regeneration Act 2023 to transfer Section 100(1B) of the Apprenticeships, Skills, Children and Learning Act 2009 (ASCLA) to these authorities and to the York and North Yorkshire Combined Authority and the East Midlands Combined 4  County Authority. This will ensure that adult learners in these regions have access to the same high-quality qualifications as those in other devolved areas. The Secretary of State must be satisfied that the transfer will improve the economic, social, and environmental well-being of people in these areas. Without this transfer, there could be significant regional differences in access to these qualifications, which could undermine national policy and limit opportunities for adult learners in certain areas. If the powers are not delegated, Combined Authorities may not be able to fund these qualifications, or they could still be funded by central government. However, this could create a lack of cohesion in the local adult education offer, as these qualifications wouldn’t be part of the broader regional strategy. The Secretary of State is required to carry out a public consultation before exercising the powers under s105A and s19. The consultation aims to understand how the transfer of this additional power from the central government to the Combined Authorities/Combined County Authorities will affect various aspects of regional development, including economic growth, public services, education, governance, and 5  community engagement. In line with this, the Secretary of State will consider whether the transfer is likely to improve the economic, social, and environmental well-being of some or all of the people living or working in the area, while ensuring it supports effective local governance and reflects the identities and interests of local communities. It helps adults to gain the skills they need for work, an apprenticeship or further learning. Since 2019/20, certain adult education functions under the Apprenticeships, Skills, Children and Learning Act 2009 have been transferred to Tees Valley, Liverpool City Region, West Midlands, Greater Manchester, Cambridgeshire & Peterborough, West of England, North East, South Yorkshire, and West Yorkshire Combined Authorities through orders made under both the Local Democracy, Economic Development and Construction Act 2009. It is also proposed that these functions will be transferred to the York and North Yorkshire Combined Authority and to the East Midlands Combined County Authority under the Levelling Up and Regeneration Act 2023.   The devolved authorities are responsible for managing these functions and the associated Adult Skills Fund (ASF). The Education Skills Funding Agency (ESFA) continues to be responsible for adult education functions in areas of England where the ASF has not been devolved.  Adult education functions under the Apprenticeships, Skills, Children and Learning Act 2009 have also been delegated to the Greater London Authority. This delegation is under the Greater London Authority Act 1999. Separate consideration will be given to whether the power under s100(1B) of the Act should be transferred to the Greater London Authority but, as this is not under the same legislation, this is not covered by this consultation. Beds withinsecure children's homes are either contracted to the Youth Custody Service (YCS)or are available to local authorities (LAs) for welfare or criminal justice placements,so children can be placed within these children's homes either by LAs or the YCS.The YCS place vulnerable children when they are remanded to custody by the courtsor are serving a custodial sentence. (opens in a new tab)Places contracted to the  Ministry of Justice (MoJ)From September 2017, the overall responsibility for commissioning of youthcustody transferred to the MoJ from the Youth Justice Board. At the same time theYCS took over responsibility for individual placements of children and young peopleinto youth custody and day-to-day management of youth custody. Some placeswithin secure children's homes are contracted out for use to the MoJ and childrenare placed in them by the YCS. Go to topPlaces approved and availableThere are currently 14 secure children’s homes in England and Wales, with 235approved places which is a decrease of 2 places on last year. The availability of approved places has decreased slightly since last year, at 90%down from 93%. Last year the availability rate was above 90% for the first time since2016.Not all approved places are always available for use, for example homesmay temporarily close to make improvements, a bed may be out of usedue to damage or refurbishment or if staffing ratios mean a reducednumber of places can be filled. The number of approved places contracted to the MoJ steadily declined from 191places in 2010 to 106 in 2019. Since then places contracted to the MoJ haveremained at a similar level - there were 102 places this year - three less than in2024.The number of children placed by the YCS in secure homes decreased from 146 in2011 and 2012 down to 56 in 2023. Last year YCS placements increased slightly to59 and they have increased further this year to 83.Figures published by the His Majesty's Prison and Probation Service (opens in anew tab) show the overall population of the youth secure estate had been decliningto a series low in 2022. The population has fluctuated just above this valuesince. This is reflected in the secure children’s homes data for MoJ contractedplaces and YCS placements.Go to topChildren accommodated and occupancy rateWithin the 14 secure children’s homes, there were 170 children accommodated, up9% since last year. Between 2010 and 2021 there was an overall gradual decline inchildren accommodated in secure children's homes, but since 2021 the number ofchildren accommodated has fluctuated more - generally around 150 children eachyear, and increasing to 170 this year.  The occupancy rate was 72% - up from 66% last year.  Note that a lower than 100%occupancy rate does not necessarily mean that there are available spaces withinsecure children's homes - availability of a suitable place may depend on if the placeis contracted to the YCS. In addition, placements are complex, and each home willassess the resources required to support the individual needs of the children theyaccommodate. Occupancy ratesThese are based on the number of children accommodated in relation tothe number of places for which the home has approval to operate with.Children and young people placed within secure children's homes may be placedas:Children detained or sentenced and placed by the YCS include childrendetained for, or convicted of, a serious offence under the Powers of CriminalCourts (Sentencing) Act 2000 or the Criminal Justice Act 2003; or subject to aSupervision Order with a residence requirement or a Detention and Training Orderunder the Powers of Criminal Courts (Sentencing) Act 2000.Children placed by the local authority in a criminal justice context includechildren remanded by a court under section 102 (Remand to youth detentionaccommodation) of the Legal Aid, Sentencing and Punishment of Offenders Act2012; or accommodated pursuant to section 38 of the Police and CriminalEvidence Act 1984.Children placed by the local authority on welfare grounds include childrenwho are placed into the homes by their local authority under section 25 of theChildren Act 1989 for the protection of themselves and/or others.On 31 March 2025, 47% of the children accommodated in secure children's homeswere placed on welfare grounds, 49% were detained or sentenced and placed bythe YCS and 4% were placed by the LA in a criminal justice context.Children placed in secure homes on a welfare basis increased to 80 (up by 8children). Children detained or sentenced and placed by the YCS increased to 83 (up by 24children). Placements by the YCS have previously varied between 50 and 60children for the last 4 years but is still down from a series peak of 146 in 2012.Children placed by the LA in a criminal justice context decreased to 7 (down by 18children), However, it is common for these figures to fluctuate from year to year. Go to topSex, age, and ethnicityNote that due to the relatively small size of the cohort, users should becautious interpreting year on year changes.SexThere are more males than females accommodated in secure children’s homes.The proportion of children accommodated who were male was 69% - a slightdecrease from 72% last year.  Males are over-represented in the secure children'shomes population (69% compared to 51% in the overall child population - as shownin the ONS mid-year population estimates (opens in a new tab)).AgeChildren aged 15, 16 or 17 years make up 72% of the children accommodated. Thenumbers in each age group are small and do fluctuate over time - childrenaccommodated by age in 2025:14 were aged 13 years (8%)26 were aged 14 years old (15%)49 were aged 15 years old (29%)47 were aged 16 years old (28%)27 were aged 17 years old (16%)the remaining 4% were either aged under 13, or 18 years and over.EthnicityInformation on the ethnicity of children accommodated in secure homes has beenreported since 2021.
