The Court reiterates that parties to an application should pursue their case with diligence. Where they fail or implicitly or expressly indicate their lack of interest to do so, Rule 65 of the Rules empowers the Court to remove the application from its cause list. The Court may also strike out an application if in the circumstances, it is no longer justified to continue with the determination of the matter

The Applicants allege a violation of the right to freedom of opinion and expression, which entails the right to hold opinions without interference and the right to seek, receive and disseminate, regardless of borders, information and ideas through any media, as protected by Article 19 of the Universal Declaration of Human Rights (UDHR)

Order Re-Opening Of Pleadings

From the proceedings of the present matter as earlier recounted, it merges that both parties have failed to file their pleadings within the time granted. Since the new pleadings involve new arguments and claims on which the Court will be called upon to rule, the interests of justice require that the attention of both parties be drawn to the procedure applicable under Rule 46(3) read in conjunction with Rule 44(2) of the Rules. In view of the foregoing, it is in the interests of justice to reopen the proceedings in order to implement the procedure prescribed by Rule 46(3) of the Rules, namely to allow both parties forty-five (45) days to reply the new submissions made by each of the partie

CSOs called upon to promote the AU’s Free Movement Protocol

Press Release: 2022This clarion call to CSOs was made during the opening of the Regional CSO Sensitization Forum on the Continental Free Movement Protocol organized by the AU Economic, Social, and Cultural Council (AU-ECOSOCC) with support from the Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ). The forum was held from May 17-19 aimed to popularize the FMP and MPFA, and particularly to improve the understanding of African CSOs of the FMP and to provide them with tools to perform advocacy for implementation of the Protocol by member states
