    Interfaith Marriage in Indonesia: Judicial Interpretation of Surabaya District Court Decision No. 916/Pdt.P/2022/PN.Sby in the Perspective of Human Rights and Islamic Law Compilation

    This article examines the legal reasoning and implications of the Surabaya District Court Decision No. 916/Pdt.P/2022/PN.Sby, which granted an application for interfaith marriage registration. Using a normative juridical and library research method, the study analyzes primary legal sources such as the Marriage Law No. 1 of 1974, Government Regulation No. 9 of 1975, the Compilation of Islamic Law (KHI), the Qur’an, and relevant Constitutional Court rulings, alongside secondary literature on human rights and family law in Indonesia. The findings reveal a deep legal tension: while Law No. 1/1974 and KHI prohibit interfaith marriage on religious grounds, the Population Administration Law (No. 23/2006) and subsequent judicial practices provide loopholes through civil registration upon court approval. From a human rights perspective, the decision was justified by invoking constitutional guarantees of freedom of religion and the right to form a family. However, from the standpoint of Islamic law and prevailing religious norms, the marriage lacks legal and spiritual validity. This study contributes to scholarly debates on legal pluralism, judicial activism, and the intersection between state law, religion, and human rights in Indonesia. It argues that inconsistent judicial interpretations not only undermine legal certainty but also raise broader questions about the harmonization of national law with religious doctrines in a plural society

    Social Cognitive Theory and Role of Key Actors in YouTube Comment Networks on Turmeric for Health

    This research examines the dissemination of health information on YouTube, specifically focusing on discussions in video comment sections about the use of turmeric as an alternative medicine, a topic deeply rooted in traditional Indonesian medicine. This study aims to identify key actors and understand the process of information dissemination formed in the comments of the YouTube video “Manfaat dan Cara Membuat Kunyit yang Benar untuk Kesehatan”. Using Bandura's Social Cognitive Theory with social network analysis method combined with content analysis. Network analysis identified @dr.emasuperr as a source of scientific information and @saptayusmana7022 as an empirical validator, which together form a decentralized network structure. Findings revealed a dynamic mechanism of reciprocal determinism: (1) personal (individual beliefs formed through user testimonials), (2) behavioral (adoption of health practices), and (3) environmental (social support and medical authority) influence each other. The interaction of these three SCT components creates a snowball effect in information dissemination

    This study aims to examine the importance of learning the age limit of marriage for women from the perspective of Islamic law, by highlighting the implications for the protection of women's rights and family welfare. In Islamic law, marriage is not only a form of legalization of the relationship between a man and a woman, but also as an institution that aims to create a harmonious and prosperous domestic life. However, the age limit for marriage is often a matter of debate, especially in relation to aspects of health, education, and social welfare. This study uses a literature study method with a descriptive-qualitative approach, which analyzes various sources from fiqh books, Islamic legal regulations, and empirical research related to the impact of early marriage on women. Data is collected through literature review of journals, books, and relevant legal documents. The results of the study show that the age limit for marriage for women in Islamic law has flexibility, but still considers the aspects of maturity (rusyd) and benefits. These findings reveal that early marriage has a negative impact on women's reproductive health, education, and welfare, so there is a need for a deep understanding of the urgency of marriage age limits. In conclusion, learning about the age limit of marriage from the perspective of Islamic law is very important to increase public awareness and ensure that marriage is carried out in more ideal conditions and benefits for women and a more stable domestic life

    The Neglect of Husband’s Nusyuz in Indonesian Islamic Civil Law: A Doctrinal Analysis of Qur’anic Principles and the Compilation of Islamic Law

    The study aims to examine the concept of husband’s nusyuz within Islamic civil law and to evaluate its absence in the Indonesian Compilation of Islamic Law (KHI). Although the Qur’an, particularly Surah An-Nisa (128), recognizes the possibility of marital disobedience by husbands, the KHI explicitly regulates only the wife’s nusyuz, thereby creating a doctrinal imbalance. Employing a normative juridical method with a doctrinal and analytical approach, this research investigates primary legal sources (the Qur’an and classical fiqh) and positive legal instruments (KHI and related legislation) to identify the normative gap. The findings show that husband’s nusyuz encompasses both material violations, such as the neglect of maintenance and dowry, and non-material violations, including mistreatment, injustice, or abandonment. The omission of husband’s nusyuz in KHI restricts legal remedies available to wives and perpetuates asymmetry in marital rights and obligations. The study concludes that doctrinal reform is required to incorporate explicit provisions on husband’s nusyuz into KHI, thereby harmonizing Indonesian Islamic civil law with Qur’anic principles and the objectives of maqāṣid al-sharī‘ah. Such reform would strengthen legal protection for wives and promote greater gender justice within the framework of Islamic family law in Indonesia

    Abstrak. Pembelajaran Bahasa Indonesia di sekolah dasar memerlukan strategi interaktif yang mampu menjawab tuntutan literasi abad ke-21. Penelitian ini menguji efektivitas model Discovery Learning berbantuan Quizizz dan Project Based Learning berbantuan Kahoot terhadap hasil belajar siswa kelas IV. Penelitian menggunakan pendekatan kuantitatif dengan desain quasi experiment serta analisis uji-t dua sampel independen. Hasil penelitian menunjukkan bahwa Discovery Learning secara signifikan meningkatkan pemahaman konsep kebahasaan, sedangkan Project Based Learning berpengaruh lebih kuat pada keterampilan penyusunan teks. Integrasi keduanya terbukti memberikan dampak positif terhadap peningkatan hasil belajar Bahasa Indonesia. Kesimpulannya, kombinasi kedua model berbasis digital ini layak diterapkan sebagai pendekatan inovatif dalam pembelajaran di sekolah dasar.     Dynamics of Audit Quality: The Effect of Audit Delay, Company Size, And Audit Tenure with The Role of Audit Fee Moderation

    Purpose: This study aims to examine the effect of audit delay, company size, and audit tenure on audit quality, with audit fees acting as a moderating variable, specifically in sharia-compliant firms listed on the Jakarta Islamic Index 70 (JII 70) during 2020–2024. Design/Method/Approach: The research employs a quantitative explanatory approach using secondary data from company financial statements. Audit quality is proxied by the engagement of Big Four auditors, while audit delay, firm size, and audit tenure serve as independent variables. Moderation regression analysis is applied to evaluate the moderating role of audit fees in these relationships. Findings: The results indicate that audit delay, company size, and audit tenure do not significantly influence audit quality, and audit fees do not significantly moderate these relationships. These findings suggest that traditional predictors of audit quality may be less impactful in sharia-compliant firms, possibly due to their strong adherence to Islamic principles emphasizing accountability and transparency. Originality/Values: This study contributes to the auditing and corporate governance literature in Islamic capital markets by highlighting the unique context of sharia-based firms. It provides practical insights for firms and policymakers to enhance audit practices through strengthened internal controls and clearer reporting frameworks

    From Classical Kafā’ah to Contemporary Economic Justice: A Hadith-Based Legal Reassessment in Islamic Family Law

    This study aims to reassess the concept of economic kafa’ah by re-examining prophetic traditions (ahadith) through a phenomenological and socio-legal lens. Employing qualitative methodology, this research integrates thematic hadith analysis, historical contextualization of classical juristic opinions, and phenomenological interpretation to explore shifts in meaning and application. The findings reveal that economic kafa’ah in prophetic tradition primarily emphasizes ethical reliability, economic responsibility, and shared life capital rather than pre-existing wealth or social pedigree. Contemporary application suggests that kafa’ah is a dynamic construct that may emerge through mutual potential, education, work ethic, and long-term economic cooperation. The legal reassessment demonstrates that classical hierarchy-based criteria are not immutable; instead, they may be contextualized according to maqasid al-shari‘ah to promote economic justice, household stability, and gender balanced financial roles. This study concludes that economic kafa’ah should be reconstructed as a principle of equitable capability and shared socio-economic commitment rather than rigid material equivalence.Penelitian ini bertujuan untuk menganalisis pemahaman tentang Rekonstruksi pemahaman hadis Kafaah perekonomian dalam penentuan pasangan dengan pendekatan Fenomenologis. Kajian ini adalah penelitian kualitatif, dianalisis dengan metode content analysis serta menggunakan pendekatan Fenomenologis. Data bersumber dari Hadis-hadis Nabi yang berbicara tentang Kafaah, litelatur penelitian sosial. Kafaah sering dijadikan keharusan dalam pemilihan pasangan pernikahan, apalagi kafaah secara ekonomi (limaliha) yang selalu dipahami secara materi, oleh karena itu penelitian ini dapat menjadi acuan pemahaman aktualisasi kafaah ekonomi secara kontekstual. Hasil penelitian menunjukkan bahwa hadis yang berbicara tentang Kafaah  terdapat satu hadis dalam Sunan Ibnu majah, 4 hadis terdapat dalam Sunan Imam Darul Qutni, Sedangkan hadis tentang kreteria kafaah terdapat enam hadis dalam kutub al-Tis’ah. Hadis-Hadis tersebut  menunjukkan bahwa kafaah bukanlah syarat syah perkawinan, kafaah merupakan anjuran pertimbangan untuk memilih pasangan dalam berumah tangga. Rekonstruksi Fenomenologi pemahaman kafaah secara ekonomi dalam menentukan pasangan bahwa kafaah tersebut tidak selalu dalam bentuk materi, tetapi dapat secara potensial yaitu persamaan visi, misi, dalam pendidikan, kometmen. Kafaah tersebut akan berimplikasi secara psikologis, ekonomis dan relasi kerja, dalam membina keharmonisan dan keutuhan sebuah rumah tangga

    Government Integration Policy In Crime Prevention: Sexual Violence Against Children In Indonesia

    This research aims to analyze policy models for the government to prevent sexual violence against children, identify obstacles faced in its implementation, and formulate a more ideal integrative research policy model. This is research normative with a socio-legal research approach, namely analyzing normative law with an understanding of the social context and the dynamics of society. The research data, namely primary data, regulations, relevant legislation, and secondary data, were obtained from books, journals, and a report study. This research discloses that the Indonesian government has implemented several policies to handle cases of sexual violence against children. Policies that cover regulatory law, such as the Child Protection Act and the sexual violence crime act, prevention programs like child-friendly schools, as well as the provision of protective services for the victims. The implementation still faces challenges, such as a lack of coordination between institutions, limited source power, human and infrastructure, and low societal awareness, resulting in a lack of reported cases. To overcome obstacles, a more integrative and practical policy model is needed, including strengthening coordination between agencies to form a unit task special, improving source power and infrastructure, such as the regional technical implementation unit for the protection of women and children, as well as implementing more firm and restorative measures. In addition, public awareness needs to be improved through education and the public, as well as the utilization of technology in system reporting, based on big data analysis for supporting prevention, as well as handling cases of sexual violence against children more optimally

    Teacher’s Ridha In The Ethics Of Santri Khidmah: A Hermeneutic Phenomenological Study On Pesantren’s Cultural Resistance To “Santri Slavery” Narratives In Digital Public Spaces

    The issue of “santri slavery” that has circulated widely on social media has distorted the meaning of pesantren education by framing the teacher–student relationship through a paradigm of power rather than spirituality. This narration obscures the moral values underlying the traditional Islamic educational system and has generated public misunderstanding of the practice of devotion (khidmah). This study phenomenologically examines the concept of teacher’s ridha as both the moral foundation of Islamic educational ethics and a form of cultural resistance against accusations of exploitation in modern public discourse. Employing a qualitative approach with a hermeneutic phenomenological design, the research was conducted in three traditional pesantren in East Java, involving 10 active students (santri), 4 teachers (ustaz), and 3 alumni as the participants. Data were collected through in-depth interviews, participatory observation, and focus group discussions (FGD), and analyzed using Interpretative Phenomenological Analysis (IPA). The findings reveal that teacher’s ridha serves as a value structure that governs the teacher–student relationship within a framework of compassion and moral responsibility rather than hierarchical domination. The practice of khidmah is understood as a form of experiential learning that cultivates sincerity, patience, and spiritual character formation. At the same time, the value of teacher’s ridha functions as a moral and symbolic mechanism of resistance to exploitation narratives by redefining devotion as an expression of inner freedom. Furthermore, pesantren have begun utilizing digital media to disseminate alternative narratives grounded in spirituality and adab (ethical conduct). Theoretically, teacher’s ridha is not merely an ethical value but also an epistemological mechanism in the formation of moral subjects, offering an alternative framework to secular paradigms by integrating spiritual legitimacy, exemplary conduct, and lived sincerity. Thus, teacher’s ridha operates as an authentic symbol of liberating Islamic education and as a form of cultural capital that enables pesantren to sustain their moral integrity amid the pressures of modernity

    Transforming Education with the "Merdeka Belajar Curriculum: Digging into Challenges and Crafting Effective Strategies in Rural Indonesia

    The Merdeka Belajar curriculum has been widely recognized for its flexibility, student-centered approach, and potential to enhance digital literacy. However, limited studies have explored its specific impact on English language teaching (ELT), particularly in rural secondary schools. This study investigates the practice of the Merdeka Belajar curriculum in ELT at SMP Negeri 5 Sangatta Utara, focusing on the barriers encountered by teachers and students and the strategies employed to address them. Using a descriptive qualitative approach, data were collected using semi-structured interviews, observations, and document analysis. The study involved three English teachers and ten seventh-grade students. Data were analyzed using Miles and Huberman’s framework, which includes data condensation, data display, and conclusion verification. The findings reveal that while the Merdeka Belajar curriculum encourages innovative teaching methods and student engagement, its implementation in rural settings is hindered by inadequate resources, limited technological infrastructure, and teachers’ readiness. To overcome these challenges, teachers employed adaptive strategies such as contextualized lesson planning, multimodal teaching techniques, and collaborative learning approaches. These strategies helped optimize the curriculum’s objectives despite existing limitations. The study provides valuable insights for educators and policymakers on how to enhance curriculum implementation in resource-constrained environments. It underscores the need for targeted professional development programs, improved educational infrastructure, and community involvement to maximize the curriculum’s impact on English language learning in rural Indonesia
