The Committee on Indian Affairs, to whom was referred the memorial of Thomas J. Alsbury, praying for indemnUy for depredations com-mitted upon his property by Indians, in the State of California, during the year 1850, have had the same under consideration, and have directed me to make an adverse report : Your committee find, upon examination and inspection of the memorial and evidence in the said case, that there is no evidence, ex-cept the affidavit of the claimant, unsupported by the testimony of any other witness. Your committee deem it proper to state that) in the consideration and allowance of claims against the government, the rules of law or equity should apply, as near as may be at least, to the rules that govern courts in passing upon the rights of parties. No such case being made out, in the opinion of your committee, we report adversely upon the said case.
