Abstract

一. 직시(直視) 구조적인 실업이 존재하고 또한 여전히 빈곤에 허덕이는 불평등구조 속의 특 정계층이 존재하는 현실에서, 도대체 노동법과 사회보장법은 무슨 의미를 가지는 가?(고용보장의 법적 구조에 관한 시론 -그 이념적 방향정립을 위한 서설적 모 색-, 93면) 헌법상 보장된 사회적 기본권 특히 노동기본권과 사회보장수급권은 그 실현을 위한 구체적 하위입법이 제정되어 시행된다고 해서 과연 이에 따른 구체적 권리 성이 확보되고 또한 이 권리를 기초로 국민은 인간다운 생활을 실질적으로 향유 한다고 말할 수 있을 것인가.(노동기본권과 사회보장수급권의 실효성, 109면) 적지 않은 경우 李興在 선생님의 글은 이렇듯 물음으로 시작한다. 선생님의 사회보장법 관련 논문들을 읽으며 접하게 되는 무수한 질문들은 때로는 화두(話頭) 처럼 들리고(법률지식은 상품인가 공공재인가), 때로는 탄식(歎息)에 가깝다 (세계인권선언이나 ILO의 사회보장에 관한 조약들, 그리고 사회보장법 … (중략) … 그것들은 어쩌면 인류사회의 먹이사슬 구조를 짐짓 위장하려는 假面의 法術 에 지나지 않는다는 말인가 …… ?) 현실에 대한 냉엄한 직시로부터 글쓰기는 시작되고, 분바른 가면을 벗기며 던지는 질문들은 사회정의 실현을 위하여 또는 사회적 약자의 권익을 위하여 법 률을 공부한다고 말하는 학생들로 하여금 스스로 한번 더 자문하게 만든다. This humble article, marking his retirement from teaching at Seoul National Universitys School of Law, is dedicated to Professor Heung Jae Lee, and his significant works on social security law. The Korean Constitution states that all citizens shall be entitled to a life worthy of human beings and that the State shall have the duty to endeavor to promote social security and welfare. In relation to this clause, a number of statutes have been enacted to promote social security and welfare. However, they have been criticized for being insufficient, from a substantial justice perspective, in protecting these welfare rights. Clarifying the cultural and historical characteristics of the formation of Korean social security law and analyzing the actual effectiveness of the legislation, Professor Lee pointed out that the Korean social security law is based on structural inequality. Therefore, he argued that structural reform measures, including positive welfare measures, should be taken to solve this problem and effectively guarantee the right to social security benefits. Furthermore, he strongly suggested that we recognize the importance of the Constitution and basic rights as sound ground for welfare rights, thus making an approach from a social law perspective rather than from that of a civil law in solving the problems of social security law. Ultimately, he believes that it is the most important prerequisite for long term improvement of Korean social security law to really share the idea of life-community (society based on solidarity and communitarian life in harmony with nature) and put this idea into practice. As a teacher, scholar and thinker, Professor Lee inspired many students on and off campus. His articles on social welfare not only made a pathbreaking contribution to social security law, but also will serve as a blueprint for implementing the law into reality
