The next paper pretends expose with completely clarity the current situation of the Venezuelan’s Tax Justice since the voidable and rough promulgation of the Constitution Law (1999), The Tax Code (2001), the currents reforms of 2010, 2014 and 2020, which They have perennially unarmed the effective’s court guardianship as a constitutional guarantee of the payers, being these institutions the vault’s key of the Rule of Law as a whole the tax’s legislative reserve and the tax legality. The methodology responds to the description and explication of the regulations together with the court decisions, because the argumentative exposition is inserted in Courts decisions of Justice System. The main conclusion was the dismantles of the Rule of Law through the legislative regulation with the institutionalization of old medieval privilege in the current tax law system, as the solve et repete by old puntofijista constitutional justice (1961).El presente paper pretende exponer con meridiana claridad la situación actual de la justicia tributaria en Venezuela desde la nula e irrita promulgación de la Constitución de 1999, el Código Orgánico Tributario de 17 de Octubre de 2001, las Reformas del 2010, 2014 y 2020, que perenemente han desarmado a la Tutela Judicial Efectiva como una garantía constitucional de los contribuyentes, siendo ésta la clave de bóveda conjuntamente con la Reserva Legal Tributaria y la Legalidad de un Estado de Derecho Constitucional Material. La respectiva metodología del presente paper responde a un estilo descriptivo-explicativo de carácter jurisprudenciada, pues la exposición argumentativa se inserta en la revisión de distintos casos tratados ante instancias judiciales de la justicia tributaria.
