Abstract
La Declaración Universal de los Derechos Humanos adoptada por la Asamblea General de las Naciones Unidas en 1948, ha servido de inspiración para el establecimiento de los derechos de la persona en las Constituciones Políticas de diversos Estados. Otro antecedente de relevancia histórica y que establece derechos base, es la Declaración Universal de los Derechos del Hombre y del ciudadano de la Revolución Francesa de 1789. Las constituciones políticas peruanas se han inspirado de manera directa o indirecta en esos documentos histórico-universales. El establecimiento se determina por la orientación iusnaturalista o positivista, por eso este artículo establece cuál de dichas teorías filosófico-jurídicas han tenido mayor influencia en nuestras constituciones.Abstract: The Universal Declaration of Human Rights adopted by the United Nations General Assembly in 1948, has served as inspiration for the establishment of the rights of the person in the constitution of many States. Another antecedent of historical significance and establishes basic rights is the Universal Declaration of the Rights of Man and of the Citizen of the French Revolution of 1789. The Peruvian constitutions have been inspired directly or indirectly in these world-historical documents. The establishment is determined by the natural law or positivistic orientation, so this article seeks to establish which of these philosophical and legal theories have had a greater influence in our constitutions
