Стаття 233 КПК України: питання практичної реалізації

Гловюк // Молодий вчений. — 2015. — №2. – Ч. 1. – С. 216-219.У статті проаналізовано зміст ст. 233 КПК України – проникнення до житла чи іншого володіння особи, виявлено проблеми її практичної реалізації. Співвіднесено нормативну регламентацію проникнення до житла чи іншого володіння особи із проведення у житлі чи іншому володінні особи огляду та обшуку. Зроблено висновок про колізійність положень ст.ст. 233, 234, 237 КПК. Обґрунтовано, що ст. 233 у існуючому вигляді доцільно вилучити з Глави 20 КПК, оскільки вона має більш загальний характер. Запропоновано нову редакцію ч. 2 ст. 237 КПК, ст. 13 КПК.В статье проанализировано содержание ст. 233 УПК Украины – проникновение в жилище или другое владение лица, выявлены проблемы ее практической реализации. Соотнесена нормативная регламентация проникновения в жилище или иное владение лица с проведением в жилище или ином владении лица осмотра и обыска. Сделан вывод о коллизионности положений ст.ст. 233, 234, 237 УПК. Обосновано, что ст. 233 в существующем виде целесообразно исключить из главы 20 УПК, поскольку она имеет более общий характер. Предложена новая редакция ч. 2 ст. 237 УПК, ст. 13 УПК.The article analyzes the content of the article 233 of the CPC of Ukraine – entering home or any other possession of a person. Problems of its implementation are identified. The normative regulation of entering home or any other possession of a person and the normative regulation of search of the home or other possession of a person and inspection are compared. The conclusion is drawn about the collision of the articles 233, 234, 237 of the CPC of Ukraine. The advisability of exclusion from Chapter 20 of the CPC of Ukraine the article 233 in its present form is substantiated, because it has a more general character. New editions of the part 2 of the article 233 and of the article 13 of the CPC of Ukraine are proposed

Symbolic transformation of the widows image in biblical cultural tradition: semantics, analogies, universal features

The purpose of the work is to analyze the specific features of a widow’s image and status on the Bible pages, to consider semantic contexts of an image, to follow the parallels between the images of an orphan and a widow, to conceive a loneliness phenomenon and orphans’ and widows’ protection in Biblical tradition. Axiological variety and poly vector spiritual and semantic representation of Biblical women’images are the main focuses of the issue. Methodologically the issue is based on the original source of the Bible. The work is based on methodical description of the women’images, who are selected from the Old and New Testament in order to highlight valued features of each image. Moreover, the methods of semantic analysis and hermeneutics are applied to consider semantic differences. The principles of comparative analysis are applied in order to reveal the traits of a widow’s image in the blocks of historical texts and compare Ukrainian context of widows’ existence with biblical one. Scientific novelty is in the poly semantic analysis of the women’Biblical context and widows’ images separation with further analysis of their fates, valued statuses, which allowed them to embody the problems of motherhood and marriage, future children birth and solitude, the problem of divine protection in different ways. The issue is devoted to the consideration of symbolic and axiological poly vector transformations of the mentioned problems. Conclusions. The social polarity and spiritual separation of a widow’s place and role in ancient tradition, and poly vector semantics of a widow’s Biblical context are conceived.
