    Intellectual Property, Globalization, and Left-Libertarianism

    Intellectual property has become the apple of discord in today’s moral and political debates. Although it has been approached from many different perspectives, a final conclusion has not been reached. In this paper I will offer a new way of thinking about intellectual property rights (IPRs), from a left-libertarian perspective. My thesis is that IPRs are not (natural) original rights, aprioric rights, as it is usually argued. They are derived rights hence any claim for intellectual property is weaker than the correlative duties attached to self-ownership and world-ownership rights, which are of crucial importance in any left-libertarian view. Moreover, IPRs lack priority in front of these two original rights and should be overridden by stronger claims of justice. Thus, as derived rights, IPRs should not benefit of strong enforcement like any original rights especially if it could be in the latters’ detriment

    Artykuł dotyczy problemu możliwości prawnej istnienia dobrowolnego niewolnictwa na gruncie libertariańskiej teorii naturalnych praw podmiotowych. Praca stawia hipotezę, iż teoria ta zakłada możliwość prawną istnienia umów niewolnictwa i że możliwość ta wynika logicznie ze zbywalności oraz komposybilności (compossibility) naturalnych praw podmiotowych. Artykuł prowadzi dyskusję z przedstawianymi w literaturze przedmiotu argumentami negującymi taką możliwość. W pracy wykorzystano metodę analizy logicznej.The present paper deals with the problem of voluntary slavery lawfulness within the libertarian theoretical framework. It hypothesises that libertarian theory of natural rights assumes the possibility of licit slavery contracts and that it stems logically from the alienability and compossibility of natural rights. Moreover, the paper discusses arguments against voluntary slavery presented in the literature. The method of logical analysis has been employed to examine validity of the hypotheses

    This article critiques institutionalist literature on varieties of capitalism and the more régulationist comparative capitalism approach. It elaborates the alternative concept of variegated capitalism and suggests that this can be studied fruitfully through a synthesis of materialist form analysis and historical institutionalism within a world-market perspective, highlights the role of institutional and spatio-temporal fixes that produce temporary, partial, and unstable zones of stability (and corresponding zones of instability) within the limits of the crisis-prone capital relation, and illustrates this from the crisis of crisis-management in the Eurozone crisis
