    La suspensi贸n de la sustanciaci贸n del proceso, una violaci贸n a los derechos de las v铆ctimas de violencia intrafamiliar

    Introduction: In the present work, the pertinence of the application of the legal figure of the suspension of the substantiation of the process in crimes of violence against women or members of the family group was analyzed. Methodology: This research was projected in a qualitative approach by conducting a thorough bibliographic review, in addition to the analytical-synthetic, inductive-deductive, historical-logical, and dogmatic methods, as well as the techniques of bibliographic review and the application of the interview. Summary: After the critical study it was justified that, with the application of the suspension of the substantiation of the process, there are no guarantees that it is a voluntary request of the victim, since it is not denied that she has been threatened or conditioned by her aggressor to request the application of such legal figure, constituting violation of rights, such as: the right to personal integrity and comprehensive reparation. Conclusions: Additionally, it was considered that the competent judge should request the intervention of the technical office to make reports on the condition of the victim and members of the family group to establish the level of risk that the victim may run, and the judge may issue his pronouncement based on a reality on such request.Introducci贸n: En el presente trabajo se analiz贸 la pertinencia de la aplicaci贸n de la figura jur铆dica de la suspensi贸n de la sustanciaci贸n del proceso en delitos de violencia contra la mujer o miembros del grupo familiar. Metodolog铆a: Esta investigaci贸n se proyect贸 en un enfoque cualitativo realizando una minuciosa revisi贸n bibliogr谩fica, adem谩s se aplicaron los m茅todos anal铆tico - sint茅tico, inductivo - deductivo, hist贸rico 鈥 l贸gico y dogm谩tico, as铆 como las t茅cnicas de revisi贸n bibliogr谩fica y la aplicaci贸n de la entrevista. Resumen: Luego del estudio cr铆tico se justific贸 que, con la aplicaci贸n de la suspensi贸n de la sustanciaci贸n del proceso, no existen garant铆as de que sea una petici贸n voluntaria de la v铆ctima, ya que no se desmiente que esta haya sido amenazada o condicionada por su agresor para que solicite la aplicaci贸n de dicha figura legal, constituyendo vulneraci贸n a derechos, tales como:  el derecho a la integridad personal y a la reparaci贸n integral. Conclusiones: Adicionalmente se consider贸 que el juez competente debe solicitar la intervenci贸n de la oficina t茅cnica para que realice informes sobre la condici贸n de la v铆ctima y miembros del grupo familiar para establecer el nivel de riesgo que puede correr la v铆ctima y el juez pueda emitir su pronunciamiento en base a una realidad sobre dicha petici贸n. 脕rea de estudio general: Derecho, 脕rea de estudio espec铆fica: Derecho Procesal

    Male-dominated law and legal knowledge essentially characterized the whole of pre-modern history in that the patriarchy represented the axis of social relations in both the private and public spheres. Indeed, modern and even contemporary law still have embedded elements of patriarchal heritage, even in the secular modern legal systems of Western developed countries, either within the content of legislation or in terms of its implementation and interpretation. This is true to a greater or lesser extent across legal systems, although the secular modern legal systems of the Western developed countries have made great advances in terms of gender equality. The traditional understanding of law has always been self-evidently dominated by men, but modern law and its understanding have also been more or less 鈥渕alestreamed.鈥 Therefore, it has become necessary to overcome the given 鈥渕askulinity鈥 of legal thought. In contemporary legal and political orders, gender mainstreaming of law has been of the utmost importance for overcoming deeply and persistently embedded power relations and gender-based, unequal social relations. At the same time and equally importantly, the gender mainstreaming of legal education 鈥 to which this book aims to contribute 鈥 can help to gradually eliminate this male dominance and accompanying power relations from legal education and higher education as a whole. This open access textbook provides an overview of gender issues in all areas of law, including sociological, historical and methodological issues. Written for students and teachers around the globe, it is intended to provide both a general overview and in-depth knowledge in the individual areas of law.     The series of European Colloquia on Crime and Criminal Policy was launched in 1988 by Professor Roger Hood at Oxford University. Ten years later, HEUNI had the pleasure to organize the VI Colloquium in Helsinki. In planning the agenda, HEUNI decided to focus on five topics that are to be dealt with in the framework of the Tenth United Nations Congress on the Prevention of Crime and the Treatment of Offenders, to be held in Vienna on 10-17 April 2000. The Congress will feature four workshops, dealing, respectively, with combatting corruption; crimes related to the computer network; community involvement in crime prevention; and women in the criminal justice system. In addition, HEUNI decided that one topic should be the development of indicators of crime trends and the operation of criminal justice
