    La judicialización de adictos captados para el microtráfico

    The problem of drug trafficking and consumption overwhelms today's societies, producing repercussions on the criminal legal system and public health of the different countries at a global level. Within this framework, within Ecuador, the Reform of article 220 of the Comprehensive Organic Criminal Code was implemented, which sought to provide a differential approach between consumers and dispensers of narcotic substances. However, at present the problems of micro-trafficking and drug use have intensified within the national context. Consequently, the present investigation proposes to define how crime rates vary and the consumption of cataloged substances subject to control with the Reform of article 220 of the Organic Comprehensive Criminal Code. Through a bibliographical investigation of the main legal - criminal and academic conceptions regarding the punishable conduct of trafficking in scheduled substances subject to control and the public health problem that the consumption of said substances represents. In this context, a proposal was made to reform article 220 of the Organic Comprehensive Criminal Code in Ecuador.La problem√°tica del tr√°fico y consumo de estupefacientes agobia a las sociedades actuales, produciendo repercusiones sobre el sistema Jur√≠dico Penal y de salud p√ļblica de los diferentes pa√≠ses a nivel global. En este marco dentro del Ecuador, se implement√≥ la Reforma del art√≠culo 220 del C√≥digo Org√°nico Integral Penal, en donde se buscaba dar un enfoque diferencial entre consumidores y expendedores de sustancias estupefacientes. No obstante, en la actualidad los problemas de microtr√°fico y consumo de drogas se han intensificado dentro del contexto nacional.     The present work was developed around the incidence of the crime of embezzlement in which the association between real punishability and the occurrence of the crime of embezzlement in the public administration is investigated. The contribution of this study is based on the investigation of why the crime of embezzlement has increased in recent years and to establish what factors have intervened in this phenomenon where the sanctions and reparations to the state are relatively tenuous. The study was carried out under a qualitative approach with an in-depth bibliographic review, where analytical-synthetic, inductive-deductive, comparative, and dogmatic methods are applied, as well as bibliographic review and signing techniques. Additionally, the results of the investigation show that article 278 of the Organic Comprehensive Criminal Code (COIP) does not detail the form of reparation to the state against crimes of embezzlement and how this article is susceptible to interpretations that lead to sentences where the punishment is nugatory. It is found that a reform in the COIP around this article is essential.El presente trabajo se desarroll√≥ en torno a la incidencia del delito de peculado en el cual se investiga la asociaci√≥n entre punibilidad real y ocurrencia del delito de peculado en la administraci√≥n p√ļblica. La contribuci√≥n de este estudio se basa en la investigaci√≥n del porque se ha incrementado en los √ļltimos a√Īos el delito de peculado y establecer que factores han intervenido en este fen√≥meno en donde las sanciones y reparaciones al estado son relativamente tenues. El estudio se realiz√≥ bajo un enfoque cualitativo con una profunda revisi√≥n bibliogr√°fica, donde se aplican los m√©todos anal√≠tico-sint√©tico, inductivo deductivo comparativo y dogm√°tico, as√≠ como las t√©cnicas de revisi√≥n bibliogr√°fica y fichaje. Adicionalmente los resultados de la investigaci√≥n muestran que el art√≠culo 278 del C√≥digo Org√°nico Integral Penal (COIP) no detalla la forma de reparaci√≥n al estado frente a delitos de peculado y como este art√≠culo es susceptible a interpretaciones que conllevan a sentencias donde la punici√≥n es nugatoria. Se constata que se hace indispensable una reforma en el COIP en torno a este art√≠culo.O presente trabalho foi desenvolvido em torno da incid√™ncia do crime de peculato no qual √© investigada a associa√ß√£o entre a punibilidade real e a ocorr√™ncia do crime de peculato na administra√ß√£o p√ļblica. A contribui√ß√£o deste estudo se baseia na investiga√ß√£o da raz√£o pela qual o crime de peculato aumentou nos √ļltimos anos e para estabelecer quais fatores intervieram neste fen√īmeno onde as san√ß√Ķes e repara√ß√Ķes ao Estado s√£o relativamente fracas. O estudo foi realizado sob uma abordagem qualitativa com uma revis√£o bibliogr√°fica aprofundada, onde foram aplicados os m√©todos anal√≠tico-sint√©tico, indutivo-dedutivo-comparativo e dogm√°tico, bem como as t√©cnicas de revis√£o bibliogr√°fica e arquivamento de arquivos.     Análisis crítico de la reparación integral de las víctimas indirectas en los casos de femicidio en el Ecuador

    Abstract The following work consists of an analytical review of the set of comprehensive reparation measures provided in the Ecuadorian legal system for indirect victims of femicide. Considering the seriousness of such acts, violence against women in Ecuador is one of the most arduous challenges for the Ecuadorian justice system and its legal system in general, given that femicide deaths profoundly affect the victim's family and society in general. The study was approached through a qualitative approach, to identify the comprehensive reparation measures applicable to the indirect victims of the criminal offense to be analyzed. For this purpose, the analytical-synthetic, inductive-deductive, historical-logical and dogmatic methods were applied, as well as the literature review in order to highlight the level of applicability of the comprehensive reparation mechanisms in the convictions, and whether they effectively satisfy the indirect victims, from which, it was determined that these are insufficient to fully repair the victims, especially in the patrimonial aspect.El trabajo desarrollado a continuaci√≥n consiste en la revisi√≥n anal√≠tica del conjunto de medidas de reparaci√≥n integral previstas en el ordenamiento jur√≠dico ecuatoriano para las v√≠ctimas indirectas en los delitos de femicidio. Considerando la gravedad de tales hechos, la violencia contra la mujer en el Ecuador es uno de los retos m√°s arduos para el sistema de justicia ecuatoriano y su ordenamiento jur√≠dico en general, dado que las muertes por femicidio afectan profundamente al n√ļcleo familiar de la v√≠ctima y a la sociedad en general. El estudio fue planteado a trav√©s del enfoque cualitativo, en aras de identificar las medidas de reparaci√≥n integral aplicables a las v√≠ctimas indirectas del tipo penal a analizar. A tales efectos, fueron aplicados los m√©todos anal√≠tico-sint√©tico, inductivo-deductivo, hist√≥rico-l√≥gico y dogm√°tico, as√≠ como la revisi√≥n bibliogr√°fica con el prop√≥sito de destacar el nivel de aplicabilidad de los mecanismos de reparaci√≥n integral en las sentencias condenatorias, y si son capaces de satisfacer efectivamente a las v√≠ctimas indirectas, de lo cual, se determin√≥ que √©stas resultan insuficientes para reparar integralmente a las v√≠ctimas, especialmente en el aspecto patrimonial

    This research work focused on the analysis of the violation of the constitutional principles non bis in idem (not being tried twice for the same cause) and non-discrimination, when the constitutive aggravating circumstance is applied to the infraction of numeral 20 article 47 of the Comprehensive Criminal Organic Code. Under this perspective, it is necessary to examine theories, concepts, law, doctrine, jurisprudence, among other documents that will allow to demonstrate the problem raised in this academic work. In addition, it is a topical issue since everyone prosecuted for an infraction has the right to the effective application of due process, so that the State, through its responsible bodies, guarantees the legal security of those who are immersed in this situation. This research work was conducted through a mixed approach: qualitative and quantitative; its level of depth will be based on the descriptive exploratory, contributing to the proposed topic. The methods that were applied were the inductive - deductive, analytical - synthetic and legal dogmatic. Data will also be obtained through the survey technique using the questionnaire as an instrument.Este trabajo de investigaci√≥n se enfoc√≥ en el an√°lisis de la vulneraci√≥n de los principios constitucionales non bis in √≠dem (no ser juzgado dos veces por la misma causa) y de no discriminaci√≥n, cuando se aplica la agravante constitutiva a la infracci√≥n del numeral 20 art√≠culo 47 del C√≥digo Org√°nico Integral Penal. Bajo esta perspectiva, es necesario examinar teor√≠as, conceptos, ley, doctrina, jurisprudencia, entre otros documentos que permitir√°n demostrar el problema planteado en este trabajo acad√©mico. Adem√°s, es un tema de actualidad puesto que todo procesado por una infracci√≥n tiene derecho a la aplicaci√≥n eficaz del debido proceso, con la finalidad que el Estado a trav√©s de sus √≥rganos responsables, garantice la seguridad jur√≠dica de quienes se encuentran inmersos en esta situaci√≥n.     International audienceBuilt on top of the Geant4 toolkit, GATE is collaboratively developed for more than 15 years to design Monte Carlo simulations of nuclear-based imaging systems. It is, in particular, used by researchers and industrials to design, optimize, understand and create innovative emission tomography systems. In this paper, we reviewed the recent developments that have been proposed to simulate modern detectors and provide a comprehensive report on imaging systems that have been simulated and evaluated in GATE. Additionally, some methodological developments that are not specific for imaging but that can improve detector modeling and provide computation time gains, such as Variance Reduction Techniques and Artificial Intelligence integration, are described and discussed

    Ofatumumab versus Teriflunomide in Multiple Sclerosis

    BACKGROUND: Ofatumumab, a subcutaneous anti-CD20 monoclonal antibody, selectively depletes B cells. Teriflunomide, an oral inhibitor of pyrimidine synthesis, reduces T-cell and B-cell activation. The relative effects of these two drugs in patients with multiple sclerosis are not known. METHODS: In two double-blind, double-dummy, phase 3 trials, we randomly assigned patients with relapsing multiple sclerosis to receive subcutaneous ofatumumab (20 mg every 4 weeks after 20-mg loading doses at days 1, 7, and 14) or oral teriflunomide (14 mg daily) for up to 30 months. The primary end point was the annualized relapse rate. Secondary end points included disability worsening confirmed at 3 months or 6 months, disability improvement confirmed at 6 months, the number of gadolinium-enhancing lesions per T1-weighted magnetic resonance imaging (MRI) scan, the annualized rate of new or enlarging lesions on T2-weighted MRI, serum neurofilament light chain levels at month 3, and change in brain volume. RESULTS: Overall, 946 patients were assigned to receive ofatumumab and 936 to receive teriflunomide; the median follow-up was 1.6 years. The annualized relapse rates in the ofatumumab and teriflunomide groups were 0.11 and 0.22, respectively, in trial 1 (difference, -0.11; 95% confidence interval [CI], -0.16 to -0.06; P<0.001) and 0.10 and 0.25 in trial 2 (difference, -0.15; 95% CI, -0.20 to -0.09; P<0.001). In the pooled trials, the percentage of patients with disability worsening confirmed at 3 months was 10.9% with ofatumumab and 15.0% with teriflunomide (hazard ratio, 0.66; P‚ÄČ=‚ÄČ0.002); the percentage with disability worsening confirmed at 6 months was 8.1% and 12.0%, respectively (hazard ratio, 0.68; P‚ÄČ=‚ÄČ0.01); and the percentage with disability improvement confirmed at 6 months was 11.0% and 8.1% (hazard ratio, 1.35; P‚ÄČ=‚ÄČ0.09). The number of gadolinium-enhancing lesions per T1-weighted MRI scan, the annualized rate of lesions on T2-weighted MRI, and serum neurofilament light chain levels, but not the change in brain volume, were in the same direction as the primary end point. Injection-related reactions occurred in 20.2% in the ofatumumab group and in 15.0% in the teriflunomide group (placebo injections). Serious infections occurred in 2.5% and 1.8% of the patients in the respective groups. CONCLUSIONS: Among patients with multiple sclerosis, ofatumumab was associated with lower annualized relapse rates than teriflunomide.
