Ius Commune y Common Law

En este trabajo se analizan algunas causas del origen y evolución de las dos grandes tradiciones jurídicas de Occidente: ius commune y common law. Desde Bolonia hasta París y Salamanca, empezó a estudiarse un ius commune con vocación universal, cuyas dos caras fueron, Derecho romano y Derecho canónico. El Derecho romano, a partir del siglo XI, fue recibido en todo el continente europeo. Inglaterra no lo incorporó a su orden jurídico consuetudinario. Como tampoco lo hizo con el Derecho canónico, por el temor de la monarquía a perder la unidad y el control de su derecho, frente al derecho de la Iglesia. Las constituciones de Clarendon, impuestas por Enrique II a Becket, son un símbolo del freno al derecho de la Iglesia, ante el derecho de la Corona en Inglaterra.The two great legal western traditions - ius commune and common law -, along with some of their causes, origin and aspects of their evolution are analyzed here. From Bologna to Paris and Salamanca, ius commune, whose two faces were Roman law and Canonical law, began to being studied with an universal vocation. The Roman Law was received in all the European continent from the 11th century on. England did not incorporate it to its customary legal order. Neither did the canonical law, through the monarchy’s fears to lose the unit and the control of his law, against the Church’s law. The Clarendon constitutions, imposed by Henry the 2nd to Becket, are a symbol of the brake imposed to the Church’s law, before the English Crown’s law.Dans ce travail on analyse quelques causes de l’origine et l’évolution des deux grandes traditions juridiques d’Occident : ius commune et common law. Dès Bologna jusqu’à Paris et à Salamanque, on a commencé à étudier un ius commune avec vocation universelle, dont les deux faces ont été le Droit romain et le Droit Canon. Le Droit romain, à partir du XIème siècle, a été reçu dans tout le continent européen. L’Angleterre ne l’a pas incorporé à son ordre juridique coutumier. Comme ne l’a pas fait non plus avec le Droit canon, par la crainte de la monarchie à perdre l’unité et le contrôle de son droit, face au droit de l’Église. Les constitutions de Clarendon, imposées par Henry II à Becket, sont un symbole du frein au droit de l’Église, devant le droit de la Couronne en Angleterre.Einige Ursachen von Ursprung und Entwicklung der beiden großen Rechtstraditionen des Abendlandes liegen dieser Arbeit zugrunde, nämlich das Ius Commune und das Common Law. Von Bologna ausgehend bis Paris und Salamanca begann das Studium eines Ius Commune mit universeller Berufung, dessen zwei Gesichter das Römische wie das Kanonische Recht verkörperten. Seit dem 11. Jahrhundert wurde in ganz Europa das Römische Recht rezipiert. England machte dieses indes nicht zu einem Teil seiner gewohnheitsrechtlich geprägten Ordnung. Ebenso wenig tat es dies mit dem Kanonischen Recht aus Angst, die englische Monarchie könnte -im Hinblick auf das Recht der Kirche- die Einheit und die Kontrolle über ihr Recht verlieren. Potential of a sunflower seed by-product as animal fat replacer in healthier Frankfurters

Upcycled defatted sunflower seed flour (SUN), a by-product obtained from sunflower oil extraction, was used as an animal fat replacer to develop healthier frankfurters. For that end, animal fat was replaced (~50%) with water and 2% or 4% of SUN. Nutritional composition, technological, structural and sensorial properties were evaluated. SUN incorporation led to a significant increase in protein, minerals (magnesium, potassium, copper and manganese) and a decrease in fat content (~37% less than control with all animal fat). The incorporation of SUN in frankfurters promoted the presence of phenolic compounds. Increasing SUN addition lead to an increasingly (p < 0.05) darker frankfurter colour. Samples with SUN at 4% were firmer than the control according to TPA and sensory analysis results and showed the highest lipid disorder attributed to more lipid interactions in the meat matrix. SUN addition as an animal fat replacer in frankfurters is a feasible strategy to valorise sunflower oil by-products and obtain healthier frankfurters

Random Forests para detección de fraude en medios de pago

Los conjuntos de clasificadores constituyen una de las técnicas más eficaces y sencillas para resolver problemas de clasificación. Se basan en la construcción de una serie de clasificadores cuya combinación, bajo unas ciertas condiciones, mejora el resultado obtenido por cada uno de ellos individualmente. Este trabajo se centra en el estudio de por qué y cuáles son las condiciones necesarias para que este tipo de técnicas resulten ser tan eficaces. El resultado del estudio teórico hace que el algoritmo random forest sea elegido como el más adecuado para ser aplicado al problema de clasificación de fraude, el cual se caracteriza por el significativo desbalanceo entre sus clases y el gran volumen de datos manejado. Para ello, se ha desarrollado una librería en C, con la que han sido llevados a cabo experimentos sobre transacciones bancarias reales con dos objetivos principales: por un lado, comparar el rendimiento obtenido por random forest con otros algoritmos tanto lineales como no lineales y por otro, analizar el impacto del valor de sus parámetros sobre el rendimiento final del conjunto

Do roads alter the trophic behavior of the mesocarnivore community living close to them?

Roads have impacts on the fauna arising from habitat fragmentation, roadkill and the barrier effect. Furthermore, roads lead species to change their activity with repercussions on predator– prey interactions and trigger indirect effects that are currently unknown. This study analyzes the effect of a motorway on the trophic behavior of the terrestrial carnivore community of its surroundings. Monthly scat sampling was conducted over a year at three distances from a motorway (0–50 m, 500–550 m and 1000–1050 m). We collected 498 scats, these originating from red fox (39.16%), cat (24.50%), stone marten (24.09%) and badger (12.25%). The relative abundance of the trophic resources in them was estimated together with the trophic diversity and niche overlap of the carnivore species. The results showed a distinct effect of distance from the road on trophic behavior of carnivores, as well as differences between species and seasons. The scats nearest the road had 10–20% more biomass of small mammals, equivalent in relative terms to a 21–48% increase in small mammals’ biomass when compared with scats collected further from the road. This finding indicates changes in predator–prey interactions near the road and shows that the human-generated structural and functional changes to ecosystems spread throughout trophic networks.info:eu-repo/semantics/publishedVersio

Antioxidant activity of hydroxytyrosol in frankfurters enriched with n-3 polyunsaturated fatty acids

8 páginas,6 tablas.The capacity of hydroxytyrosol (HXT) to inhibit lipid oxidation in cooked pork meat batter, oil-in-water emulsions and potential functional frankfurters formulated with a healthier oil combination (as animal fat replacer) was studied during chilling storage, and its effect compared with those produced by synthetic antioxidants (BHA/BHT). Although efficiency varied, HXT was an effective antioxidant during chilling storage in the three food matrices studied. In general the order of inhibition capacity of HXT against lipid oxidation (thiobarbituric acid-reactive substances-TBARS) was cooked meat batter > oil-in-water emulsion > frankfurters, whereas in the case of BHA/BHT (with lower inhibitory activity than HXT) it was cooked meat batter > oil-in-water emulsion, and there was no antioxidative effect in frankfurters. Whereas significant correlations were established between lipid oxidation (TBARS) and antioxidative capacity measured by photochemiluminescence (PCL) in frankfurters supplemented with HXT and BHA/BHT, no significant correlations were found between ferric reducing/antioxidant power assay (FRAP) and TBARS and PCL.This research was supported by the projects AGL2008-04892- CO3-01 and Consolider Ingenio 2010: CARNISENUSA (CSD2007- 00016).Peer reviewe

Estrategia de marca Laagam: identidad e imagen de la marca Laagam.

En los últimos años, se ha observado entre los influencers una tendencia creciente al emprendimiento, de modo que, muchos de ellos han creado sus propias marcas. El objetivo principal de este trabajo se basa en conocer las estrategias comunicativas, que ha utilizado la marca online nacida en Instagram, Laagam, liderada por la influencer Inés Arroyo, para alcanzar el éxito. Lo cual se ha conseguido mediante un profundo análisis tanto del posicionamiento de la marca, como de las plataformas utilizadas por la misma para difundir su contenido cualitativo. Por último, se ha realizado una encuesta dirigida a una muestra de 150 mujeres, con la finalidad de conocer la opinión real de las consumidoras sobre la marca. En cuanto a los resultados obtenidos, destaca, en primer lugar, que Laagam ha conseguido transmitir de manera correcta su identidad de marca, puesto que de la encuesta se ha obtenido que la imagen de marca de las consumidoras coincide con la misma. Por otro lado, destaca el sentimiento de identificación de las consumidoras con la marca, ya que comparten un sentimiento, unos valores y un estilo de consumo, es decir, algo más allá del gusto por la moda. Por último, es importante señalar la alta valoración que las consumidoras dan a su experiencia de compra, de modo que, a pesar de ser una marca online, ha sido capaz de ofrecer a sus consumidoras todos los servicios necesarios.<br /

Are motorways potential stressors of roadside wood mice (Apodemus sylvaticus) populations?

Linear infrastructures represent one of the most important human impacts on natural habitats and exert several effects on mammal populations. Motorways are recognized as a major cause of habitat fragmentation and degradation and of biodiversity loss. However, it is unknown whether motorways lead to increased physiological stress reactions in wild animal populations. We analysed faecal corticosterone metabolites (FCM) in wild populations of wood mice (Apodemus sylvaticus) living in a well-preserved Mediterranean agro-pastoral woodland at different distances (verge, 500 m and 1000 m) from the AP-51 motorway in Spain. Wood mice were captured with Sherman live traps, and fresh faecal samples from 424 individuals were collected and analyzed in the laboratory. The quantification of FCM was performed by a 5a-pregnane-3b,11b, 21-triol-20-one enzyme immunoassay. Results showed that females had higher FCM levels than males, and these levels were higher in breeding females. In addition, FCM levels were positively correlated with body weight of individuals. Wood mice captured where cattle were present showed higher FCM levels than individuals living where cattle were not detected. FCM levels were higher in non-breeding individuals living close to the motorway compared with FCM levels in those individuals captured further from the motorway. This is the first study showing evidence of the motorways' impact on physiological stress reactions in wild wood mice populations. Understanding how free-living animals are influenced by human interventions could help to understand other subtle changes observed in wild animal populations.
