In this article, the author describes his experience of working in a community on the premises to the Local Centre of Communitary Services in the region of Matane, in Gaspesie. Commercial credit has been given many different forms over the years and the various financial instruments are being constantly refined. By the same token, loan agreements have become increasingly complex documents. The main thrust of this paper is to examine the legal nature, legality and usefulness of a number of financial instruments and clauses usually found in a typical agreement, in the light of basic civil law rules and principles. The first part of this paper deals with a number of financial instruments, namely the open credit agreement, the banker's acceptance, the letter of credit and the letter of guaranty. Secondly the author analyses the typical loan agreement focusing on the convenant 'sfundamentals elements and discussing its relationship with the use of sureties. In particular, two civil law mechanisms that are of some interest in connection with the loan agreement namely novation and subrogation are examined. The third and fourth parts of this paper deal with a number of standard clauses in the open credit and loan agreements

    Programmation architecturale et architecture virtuelle

    Get PDF
Architectural programming is often the first stage of a bigger and more complex set of necessary actions to building edification. This article aims at spotting from the new practice of virtual architecture, the essential elements, which differentiate its architectural programming from a traditional architecture. The paper introduces initially programming, and then defines virtual architecture, for then describing the application of programming to virtual architecture

Driedger's 'Modern Principle' at the Supreme Court of Canada: Interpretation, Justification, Legitimization

    Get PDF
Un résumé en français est également disponible[À l'origine dans / Was originally part of : Fac. Droit - Coll. facultaire - Théories du droit]In the last 20 years, Elmer Driedger’s “modern principle” has emerged as THE expression of the Supreme Court of Canada’s preferred approach to statutory interpretation. The authors examine this fundamental development in Canadian law, including the variable relations between Driedger’s quote and the Court’s use of it, the different circumstances in which the principle is invoked and its influence on the caselaw of other superior courts in the country. Follows an appraisal of the impact of the “modern principle” on Canadian law. The principle is shown to serve three clearly different functions. It is used in the interpretation of statutes, it provides judges with a justification framework for interpretive decisions, and it is also instrumental in the legitimization of the judicial function in statutory interpretation. No doubt, the “modern principle” has brought about some advances in the law relating to statutory interpretation in Canada. However, the author reckon that it constitutes an over-simplified reflection of the actual practice of Canadian jurists, including judges. As a result, Driedger’s principle provides neither a valid method for interpreting statutes nor a suitable structure for the courts’ justification of interpretive decisions. One should not see in it more than a good starting point for statutory interpretation

The Role of Simple Rules in the Conduct of Canadian Monetary Policy

    Get PDF
The third strategy employed by the Bank when dealing with uncertainty is the consideration of appropriate simple reaction functions or "rules" for the setting of the policy interest rate. Since John Taylor's presentation of his much-discussed rule, research on simple policy rules has exploded. Simple rules have several advantages. In particular, they are easy to construct and communicate and are believed by some to be robust, in the sense of generating good results in a variety of economic models. This article provides an overview of the recent research regarding the usefulness and robustness of simple monetary policy rules, particularly in models of the Canadian economy. It also describes and explains the role of simple rules in the conduct of monetary policy in Canada.

The Game FAVR: A Framework for the Analysis of Visual Representation in Video Games

    Get PDF
This paper lays out a unified framework of the ergodic animage, the rule-based and interactiondriven part of visual representation in video games. It is the end product of a three-year research project conducted by the INTEGRAE team, and is divided into three parts. Part 1 contextualizes the research on graphics and visuality within game studies, notably through the opposition between fiction and rules and the difficulties in finding common vocabulary to discuss key visual concepts such as perspective and point of view. Part 2 discusses a number of visual traditions through which we frame video game graphics (film, animation, art history, graphical projection and technical drawing), highlighting their relevance and shortcomings in addressing the long history of video games and the very different paradigms of 2D and 3D graphics. Part 3 presents the Game FAVR, a model that allows any game’s visual representation to be described and discussed through a common frame and vocabulary. The framework is presented in an accessible manner and is organized as a toolkit, with sample case studies, templates, and a flowchart for using the FAVR provided as an annex, so that researchers and students can immediately start using it
