Дисертація присвячена дослідженню та обґрунтуванню теоретичних основ захисту авторських прав у правовідносинах, які виникають у зв’язку з рекламою. У ній проаналізовано стан цивілістичних наукових та практичних джерел, в яких було в тій чи іншій мірі досліджено захист авторських прав у правовідносинах, які виникають у зв’язку з рекламою. У дисертації визначаються поняття та специфіка правовідносин, які виникають у зв’язку з рекламою, суб’єкти та об’єкт досліджуваних правовідносин. Проаналізовано ознаки реклами як об’єкта авторського права, співвідношення реклами та об’єктів авторського права, договірні засади використання об’єктів авторського права у правовідносинах, які виникають у зв’язку з рекламою. Розглянуто правове забезпечення захисту авторських прав, форми та способи захисту авторських прав, доцільність поширення практики неюрисдикційної форми захисту авторських прав, захист авторських прав у судовому порядку. Диссертационная работа посвящена исследованию защиты авторских прав в правоотношениях, возникающих в связи с рекламой. В работе на основании исследования научных трудов, которые касаются проблематики диссертационного исследования, а так же анализа нормативно-правовые актов, регулирующих защиту авторских прав в правоотношениях, возникающих в связи с рекламой, выявлены существующие коллизии и пробелы в действующем законодательстве. Анализ понятия и содержания правоотношений, возникающих в связи с рекламой, позволил выделить их специфику, которая обусловлена: наличием большого количества нормативных актов, в которых содержатся требования к рекламе, выделением законодателем из круга участников гражданского оборота специальных субъектов правоотношений (рекламодателя, производителя, распространителя и потребителя рекламы), наделением указанных субъектов специальными правами и обязанностями. Определено понятие, виды, признаки, субъекты и объект правоотношений, возникающих в связи с рекламой. В работе уточнено понятие рекламы, недобросовестной рекламы. Анализ практики использования объектов авторского права в рекламе позволил сделать вывод о соотношении рекламы и объектов авторского права: во-первых, реклама рассматривается как самостоятельный объект авторского права; во-вторых, объекты авторского права рассматриваются как рекламная информация; в-третьих, рассматривается использование объектов авторского права в рекламе. Исследованы признаки рекламы как объекта авторского права, договорные основы использования объектов авторского права в правоотношениях, которые возникают в связи с рекламой. Рассмотрены правовые основы защиты авторских прав, формы и способы защиты авторских прав, защита авторских прав в судебном порядке. Обосновывается целесообразность распространения практики неюрисдикционной формы защиты авторских прав. The comprehensive analysis of the legal nature of legal relations arising from advertisement, the correlation of advertisement and copyright objects as well as copyright protection was made in the thesis. Concept, kinds, features, subjects and objects of legal relations arising from advertising practice were defined therein. The concepts of advertisement and false advertisement received a more clear definition. The features of the advertisement as an object of copyright, contractual principles of using the copyright object in advertisement bound legal relations were researched here. The work deals with the legal principles of copyright protection, forms and methods of copyright, expedience of practice of no jurisdictional form of copyright protection and judicial copyright protection. On the basis of the research the proposals on the improvement of copyright and advertisement regulations were formulated

    Vermicompost effect on the trace elements distribution in the luvic chernozem of the Krasnoyarsk forest-steppe

    n the field experiment (2016-2018) in the conditions of the Krasnoyarsk forest-steppe the number of trace elements mobile forms were determined and the effect of soil organic matter and increasing doses of vermicompost on their distribution in luvic chernozem was studied. It is established that the studied vermicompost does not pollute the soil, which allows its widespread use in agriculture. The correlation and regression analysis obtained linear regression equations that reflect the relationship of the chemical element and organic matter in the soil after using increasing doses of vermicompost adequately. Elements with positive correlation and high significance level include Mn, Cu, Co and Zn

Among new promising anticancer drugs, special attention is paid to the ribonucleases (RNases) which possess selective cytotoxicity against malignant cells. It is found that besides enzymatic activity conformational state of RNase molecules plays a role in the anticancer activity. Balnase, a new RNase from Bacillus altitudinis, is a close homolog of Bacillus pumilus RNase (binase) which selectively kills malignant cells expressing oncogenes KIT, ras, AML1/ETO, and FLT3. Earlier, homogeneous sample of balnase was obtained. Here, we have characterized structural organization of balnase. It was shown that it is a natural dimer. The enzyme has the same conformational state as binase but balnase dimers are less stable

    Barnase and binase: Twins with distinct fates

    RNases are enzymes that cleave RNAs, resulting in remarkably diverse biological consequences. Many RNases are cytotoxic. In some cases, they attack selectively malignant cells triggering an apoptotic response. A number of eukaryotic and bacterial RNase-based strategies are being developed for use in anticancer and antiviral therapy. However, the physiological functions of these RNases are often poorly understood. This review focuses on the properties of the extracellular RNases from Bacillus amyloliquefaciens (barnase) and Bacillus intermedius (binase), the characteristics of their biosynthesis regulation and their physiological role, with an emphasis on the similarities and differences. Barnase and binase can be regarded as molecular twins according to their highly similar structure, physical-chemical and catalytic properties. Nevertheless, the 'life paths' of these enzymes are not the same, as their expression in bacteria is controlled by diverse signals. Binase is predominantly synthesized under phosphate starvation, whereas barnase production is strictly dependent on the multifunctional Spo0A regulator controlling sporulation, biofilm formation and cannibalism. Barnase and binase also have some distinctions in practical applications. Barnase was initially suggested to be useful in research and biotechnology as a tool for studying protein-protein interactions, for RNA elimination from biological samples, for affinity purification of RNase fusion proteins, for the development of cloning vectors and for sterility acquisition by transgenic plants. Binase, as later barnase, was tested for antiviral, antitumour and immunogenic effects. Both RNases have found their own niche in cancer research as a result of success in targeted delivery and selectivity towards tumour cells. A number of eukaryotic and bacterial RNase-based strategies are being developed for use in anticancer and antiviral therapy. However, the physiological functions of these RNases are often poorly understood. Barnase and binase can be regarded as molecular twins according to their highly similar structural, physical-chemical and catalytic properties.     Secretome of Intestinal bacilli: A natural guard against pathologies

Current studies of human gut microbiome usually do not consider the special functional role of transient microbiota, although some of its members remain in the host for a long time and produce broad spectrum of biologically active substances. Getting into the gastrointestinal tract (GIT) with food, water and probiotic preparations, two representatives of Bacilli class, genera Bacillus and Lactobacillus, colonize epithelium blurring the boundaries between resident and transient microbiota. Despite their minor proportion in the microbiome composition, these bacteria can significantly affect both the intestinal microbiota and the entire body thanks to a wide range of secreted compounds. Recently, insufficiency and limitations of pure genome-based analysis of gut microbiota became known. Thus, the need for intense functional studies is evident. This review aims to characterize the Bacillus and Lactobacillus in GIT, as well as the functional roles of the components released by these members of microbial intestinal community. Complex of their secreted compounds is referred by us as the "bacillary secretome." The composition of the bacillary secretome, its biological effects in GIT and role in counteraction to infectious diseases and oncological pathologies in human organism is the subject of the review

    Binase-like guanyl-preferring ribonucleases are new members of Bacillus PhoP regulon

Extracellular low-molecular weight guanyl-preferring ribonucleases (LMW RNases) of Bacillus sp. comprise a group of hydrolytic enzymes that share highly similar structural and catalytic characteristics with barnase, a ribonuclease from Bacillus amyloliquefaciens, and binase, a ribonuclease from Bacillus intermedius. Although the physical-chemical and catalytic properties of Bacillus guanyl-preferring ribonucleases are very similar, there is considerably more variation in the environmental conditions that lead to the induction of the genes encoding these RNases. Based on structural differences of their genes the guanyl-preferring ribonucleases have been sub-divided into binase-like and barnase-like groups. Here we show the ability of the key regulator of phosphate deficiency response, PhoP, to direct the transcription of the binase-like RNases but not barnase-like RNases. These results, together with our demonstration that binase-like RNases are induced in response to phosphate starvation, allow us to categorise this group of ribonucleases as new members of Bacillus PhoP regulon. In contrast, the barnase-like ribonucleases are relatively insensitive to the phosphate concentration and the environmental conditions that are responsible for their induction, and the regulatory elements involved, are currently unknown
