NEW TRIAL - USE OF TESTIMONY OF JURORS TO SET ASIDE VERDICT
Whether or not testimony of a juror is admissible for the purpose of setting aside a verdict is a question upon which the cases are in conflict. Much of the contrariety of opinion is due to a failure of courts to distinguish between the two basic factual situations which present the problem. The juror\u27s testimony may be sought to be introduced to show either: (1) that, due to some misunderstanding, his own thought processes were misdirected in arriving at his final vote; or, (2) that he observed the open misconduct of a fellow juror. At the outset it should be noted that the majority rule is to exclude all testimony of jurors whether it goes to prove misunderstanding or misconduct. However, the American Law Institute in its Model Code of Evidence adopted a rule correctly recognizing the distinction pointed out and squarely opposing the majority rule as to misconduct. It stated that every member of the jury may testify to any material matter, including any statement or conduct ... of any member of the jury ... whether during deliberations of the jury, or in reaching or reporting its verdict .... Because of the number of eminent authorities who aided in this draft it is appropriate to reconsider the policies lying behind the majority rule
EVIDENCE - OFFICE CUSTOM TO PROVE FACT OF MAILING
Plaintiff agreed to purchase land from defendant by a contract in which it was stipulated that the performance of the mechanics of purchase would be completed through a third party, Webster. Plaintiff deposited the purchase money with Webster with instructions to deliver it to defendant only after he (Webster) had, inter alia, procured a policy of title insurance. Webster absconded with the funds. In a suit to determine the incidence of loss, plaintiff sought to prove that Webster had procured the policy before he absconded and therefore held the purchase money as agent for defendant. The proof that plaintiff relied upon to establish that Webster had received such a policy was: (1) that X Insurance Company had received an application from Webster for insurance and that the policy had been properly filled out; and (2) that it was the office custom of X Insurance Company to mail such policies when completed. Defendant claimed there had been insufficient proof of mailing. The lower court rendered judgment for defendant. On appeal, held, affirmed. Proof of an office custom with respect to mailing is insufficient to prove posting without establishing compliance with that custom in the specific instance. Lieb v. Webster, (Wash. 1948) 190 P. The spectrum of N2O between 800 and 5200 cm(-1)
An atlas of N2O lines between 800 and 5200/cm obtained from low-pressure, long-path-length samples at 296K is presented. Many of the line centers were marked and their positions were tabulated. The peak absorptances of the weaker lines in the atlas are similar to those expected in an extreme path through the atmosphere
Interacting Dark Matter and Dark Energy
We discuss models for the cosmological dark sector in which the energy
density of a scalar field approximates Einstein's cosmological constant and the
scalar field value determines the dark matter particle mass by a Yukawa
coupling. A model with one dark matter family can be adjusted so the
observational constraints on the cosmological parameters are close to but
different from what is predicted by the Lambda CDM model. This may be a useful
aid to judging how tightly the cosmological parameters are constrained by the
new generation of cosmological tests that depend on the theory of structure
formation. In a model with two families of dark matter particles the scalar
field may be locked to near zero mass for one family. This can suppress the
long-range scalar force in the dark sector and eliminate evolution of the
effective cosmological constant and the mass of the nonrelativistic dark matter
particles, making the model close to Lambda CDM, until the particle number
density becomes low enough to allow the scalar field to evolve. This is a

Atmospheric water vapor absorption at 12 CO2 laser frequencies
Measurements of the absorption of CO2 laser radiation in the 9.4 micron band by pressure broadened water vapor samples are summarized. The water vapor temperatures used were 25, 30, and 35 C
A double-lined spectroscopic orbit for the young star HD 34700
We report high-resolution spectroscopic observations of the young star HD
34700, which confirm it to be a double-lined spectroscopic binary. We derive an
accurate orbital solution with a period of 23.4877 +/- 0.0013 days and an
eccentricity of e = 0.2501 +/- 0.0068. The stars are found to be of similar
mass (M2/M1 = 0.987 +/- 0.014) and luminosity. We derive also the effective
temperatures (5900 K and 5800 K) and projected rotational velocities (28 km/s
and 22 km/s) of the components. These values of v sin i are much higher than
expected for main-sequence stars of similar spectral type (G0), and are not due
to tidal synchronization. We discuss also the indicators of youth available for
the object. Although there is considerable evidence that the system is young
--strong infrared excess, X-ray emission, Li I 6708 absorption (0.17 Angstroms
equivalent width), H alpha emission (0.6 Angstroms), rapid rotation-- the

Stiff Stability of the Hydrogen atom in dissipative Fokker electrodynamics
We introduce an ad-hoc electrodynamics with advanced and retarded
Lienard-Wiechert interactions plus the dissipative Lorentz-Dirac
self-interaction force. We study the covariant dynamical system of the
electromagnetic two-body problem, i.e., the hydrogen atom. We perform the
linear stability analysis of circular orbits for oscillations perpendicular to
the orbital plane. In particular we study the normal modes of the linearized
dynamics that have an arbitrarily large imaginary eigenvalue. These large
eigenvalues are fast frequencies that introduce a fast (stiff) timescale into
the dynamics. As an application, we study the phenomenon of resonant
dissipation, i.e., a motion where both particles recoil together in a drifting
circular orbit (a bound state), while the atom dissipates center-of-mass energy
only. This balancing of the stiff dynamics is established by the existence of a
quartic resonant constant that locks the dynamics to the neighborhood of the
recoiling circular orbit. The resonance condition quantizes the angular momenta
in reasonable agreement with the Bohr atom. The principal result is that the
emission lines of quantum electrodynamics (QED) agree with the prediction of

Quasienergy Spectroscopy of Excitons
We theoretically study nonlinear optics of excitons under intense THz
irradiation. In particular, the linear near infrared absorption and resonantly
enhanced nonlinear sideband generation are described. We predict a rich
structure in the spectra which can be interpreted in terms of the quasienergy
spectrum of the exciton, via a remarkably transparent expression for the
susceptibility, and show that the effects of strongly avoided quasienergy
crossings manifest themselves directly, both in the absorption and transmitted
