German works councils old and new: incidence, coverage and determinants

Although works councils are a core element of the German system of industrial relations, there is little reliable information on their incidence and coverage. This paper uses data from the nationally representative IAB establishment panel to fill this gap. We examine the frequency of works councils by establishment size and broad sector for eastern and western Germany, while at the same time charting the determinants of their presence. Furthermore, we identify newly established works councils and provide the first econometric analysis of the circumstances of their formation. Finally, we discuss the consequences of our findings for economic analysis of the institution and for public policy. -- Trotz ihrer großen Bedeutung im deutschen System der Arbeitsbeziehungen gibt es kaum gesicherte Erkenntnisse über den Verbreitungsund Deckungsgrad von Betriebsräten. Diese Forschungslücke soll in der vorliegenden Arbeit durch Verwendung von repräsentativen Daten des IABBetriebspanels geschlossen werden. Dabei wird die Verbreitung von Betriebsräten nach Firmengröße und Sektoren sowie für West- und Ostdeutschland ebenso analysiert wie deren Bestimmungsgründe. Zudem wird erstmals die Einrichtung neuer Betriebsräte ökonometrisch untersucht. This study considers the nexus between import pressure and changes in the structure of employment in 26 manufacturing industries in the Federal Republic of Germany between 1976 and 1983. We look at changes in the proportion of skilled labour and in the proportion of employees working in production oriented services (e. g. research and development or marketing) and test for influences of import pressure and varions adjustment strategies. The long awaited reform of the German works constitution act

'German law guaranteeing works councils is not a datum. The thrust of legislation has changed significantly on a number of occasions since 1920. The most recent legal change in the form of the Works Constitution Reform Act marks a controversial swing in favor of works council formation and authority. The present paper evaluates the new legislation from an economic perspective. We link the crucial terms of the new legislation to extant empirical evidence on the incidence of works councils, the availability of alternative employee involvement mechanisms, and the impact of the institution on performance by establishment size. Given the limitations of the evidence, which are shown to have relaxed the constraints on legislative innovation, we also offer some new empirical findings based on a matched-plants approach, using a nationally representative sample of establishments. This empirical strategy in principle offers improved estimates of the effects of works councils on establishment performance. Although the results of this exercise differ somewhat from earlier analyses, they provide little support for the recent legislative changes.' (author's abstract)Seit 1920 hat es vielfaeltige Reformen des deutschen Betriebsverfassungsgesetzes gegeben. Ziel der vorliegenden Arbeit ist es, eine Bewertung der aktuellen Reform des Gesetzes aus wirtschaftlicher Sicht vorzunehmen. Die kontrovers diskutierte Reform bringt insgesamt mehr Vorteile fuer die Autoritaet der Betriebsraete. Auf der Grundlage einer repraesentativen Stichprobe von parallelisierten Firmen in Deutschland ergibt eine empirische Gegenueberstellung der wesentlichen Bestimmungen des neuen Gesetzes mit der jetzigen Situation der Betriebsraete, den Moeglichkeiten alternativer Mitbestimmung und den Auswirkungen auf die Unternehmensleistung in Abhaengigkeit von der Betriebsgroesse, dass die kontroversen neuen Gesetzesaenderungen des Betriebsverfassungsgesetzes aus oekonomischer Perspektive wenig Unterstuetzung finden.
