Rekomendacje OECD jako ramy etyczne i prawne dla rozwoju sztucznej inteligencji
New technologies using artifi cial intelligence play an increasingly important role in
everyday life and are a source of profound social change. The prospect of the expansion
of ‚intelligent’ machines that think and make decisions on their own is a source
of concern not only for their users and manufacturers. It is necessary to determine and
promote an ethical framework that guarantees respect for human values and interests
by those developing technologies involving artifi cial intelligence. In the light of the
rapidly increasing use of artifi cial intelligence in many sectors of the economy and its
global reach, this is an extremely urgent issue. Th e article below presents the efforts
made by the OECD to set global standards for developing artificial intelligence. The
choice of this organisation is justifi ed by the advanced level of work on guidelines for
the development of artifi cial intelligence and the broad territorial coverage of the agreement
between the international partners involved in this process. The OECD’s recommendations
on artifi cial intelligence have been accepted by 44 countries, including all
leaders in the implementation of these technologies into the economy. They are therefore
global in scope and provide a solid foundation for future regulation. Th e central
pillar of the OECD recommendations are the principle of respect for human autonomy
and dignity, human rights and democratic values. Th ey promote artificial intelligence
systems that can be considered trustworthy.Nowe technologie wykorzystujące sztuczną inteligencję odgrywają coraz poważniejszą
rolę w życiu codziennym i są źródłem głębokich zmian społecznych. Perspektywa upowszechnienia
„inteligentnych” maszyn, samodzielnie myślących i podejmujących decyzje,
stanowi źródło niepokoju nie tylko dla ich użytkowników i producentów. Konieczne
jest wyznaczenie i upowszechnienie ram etycznych gwarantujących poszanowanie
ludzkich wartości i interesów przez podmioty rozwijające technologie wykorzystujące
sztuczną inteligencję. W obliczu dynamicznie wzrastających zastosowań sztucznej inteligencji
w wielu sektorach gospodarki oraz jej globalnego zasięgu, jest to niezwykle
pilne zagadnienie. W poniższym tekście przedstawione zostały wysiłki podejmowane
przez OECD w zakresie wyznaczenia globalnych standardów rozwoju sztucznej inteligencji.
Wybór tej organizacji jest podyktowany zaawansowanym stopniem prac nad
wytycznymi dotyczącymi rozwijania sztucznej inteligencji oraz szerokim zasięgiem terytorialnego
porozumienia pomiędzy partnerami międzynarodowymi uczestniczącymi w tym procesie. Rekomendacje OECD dotyczące sztucznej inteligencji zaakceptowały
44 państwa, w tym wszyscy liderzy we wdrażaniu tych technologii do gospodarki.

This paper provides an analysis of the rules of consumer sales guarantees in polish civil law,
which evolved under the infl uence of the Consumer Sales Directive. Implementation of the Consumer
Sales Directive in the area of guarantees didn’t have a positive effect in Poland. Before the
implementation, polish legal system off ered advanced system of rules on consumer sales guarantees.

The purpose of that article is to analyze the scope of application of the new directive on
package travel and linked travel arrangements. The new directive aims to modernise the
rules on package travel currently contained in Directive 90/314/EEC, by increasing the
protection o f consumers purchasing online travel combinations. The inclusion of customised
combinations of travel services, in particular those purchased on-line, in the scope
of the new directive will change significantly the scope of application of the protection
offered to travelers. It is estimated that the new directive will double the share o f protected
contracts from 23% to 46% in the EU travel market. New directive will increase legal
certainty and transparency for both travellers and businesses, reduce consumer detriment
associated with such combinations and ensure fairer competition between travel businesses.
New directive will be based on full harmonisation, with a few limited exceptions
where, because of different legal traditions or approaches, Member States will be allowed
to maintain different solutions. The process of implementation of the new directive will
be difficult because of the complexity of that legal text and its serious consequences for
the whole tourism industry in Poland.Niniejsza praca m a na celu analizowanie zakresu stosowania nowej dyrektywy w sprawie
imprez turystycznych i powiązanych usług turystycznych. Celem dyrektywy jest modernizacja
przepisów dotyczących imprez turystycznych w dyrektywie 90/314/EEC przez
zwiększenie ochrony konsumentów, kupujących podróży przez Internet. Obejmowanie
zakresem dyrektywy opracowanych usług turystycznych, zwłaszcza tych kupowanych
przez Internet, znacznie zmieni zakres ochrony zapewnianej podróżnikom. Szacuje się,
że nowa dyrektywa zwiększy udział umów chronionych z 23% do 46% rynku podróży
w Unii Europejskiej. Nowa dyrektywa zwiększy poziom pewności i przejrzystości dla podróżników,
jak i przedsiębiorstw, zredukuje problemy konsumentów i zapewni bardziej
uczciwą konkurencję między przedsiębiorstwami turystycznymi. Nowa dyrektywa będzie
polegała na całkowitej harmonizacji, z kilkoma ograniczonymi wyjątkami, gdzie państwa
członkowskie będą miały możliwość dostosowania innych rozwiązań z powodu innych
systemów prawnych. Implementacja nowej dyrektywy będzie niełatwa z powodu złożoności
tekstu prawnego i skutków prawnych dla całego rynku turystycznego w Polsce
Alternatywne metody rozstrzygania sporów konsumenckich w prawie Unii Europejskiej
Consumer protection legislation at EU and Member States’ level has been significantly
strengthened in the past decades. However, existing system of court proceedings discourage
consumers from trying to seek redress when their rights are violated. This is because
consumers believe court proceedings to be expensive, time-consuming and their
outcome uncertain. The new legislative initiative in the EU will reform the system of
alternative resolution of consumer disputes. The basic role plays ADR directive which
will ensure that consumers can turn to quality alternative dispute resolution entities
for all kinds of contractual disputes that they have with traders. The ODR Regulation
will set up an EU-wide online platform for handling consumer disputes that arise from online transactions. The platform will link all the national alternative dispute resolution
entities and facilitate consumer access to their on line services. Member States have
24 months to implement the directive, while the ODR platform will be operational at
the end of 2015
