    The responsibility to protect human rights and the RtoP: prospective and retrospective responsibility

    This article argues that -- contrary to the way that it is often framed -- the first pillar of the Responsibility to Protect (RtoP) is not best understood as an instantiation of a broader international responsibility to protect human rights. Firstly, the RtoP reverts to a discourse of powerful savours and passive victims, which runs against advocates' claim that the RtoP is a 'rights-based norm'. Secondly, although it distinguishes between prevention and response, the RtoP is still fundamentally a discussion of retrospective responsibility. The responsibility to protect human rights, by contrast, is importantly prospective. The article's separation of prospective/retrospective responsibility from the responsibility to prevent and to respond is an independent contribution, with broader significance beyond the RtoP context. Thirdly, the RtoP becomes activated when atrocity is building, imminent or underway; whereas the responsibility to protect human rights may be breached even without a clear causal link to harm

    The pulvinar nucleus of the thalamus is suspected to have an important role in visual attention, based on its widespread connectivity with the visual cortex and the fronto-parietal attention network. However, at present, there remain many hypotheses on the pulvinars specific function, with sparse or conflicting evidence for each. Here we characterize how the human pulvinar encodes attended and ignored objects when they appear simultaneously and compete for attentional resources. Using multivoxel pattern analyses on data from two functional magnetic resonance imaging (fMRI) experiments, we show that attention gates both position and orientation information in the pulvinar: attended objects are encoded with high precision, while there is no measurable encoding of ignored objects. These data support a role of the pulvinar in distractor filtering--suppressing information from competing stimuli to isolate behaviourally relevant objects

    Uberrimae Fidei and Adverse Selection: the equitable legal judgment of Insurance Contracts

    This paper examines uberrimae fidei (utmost good faith) with adverse selection in an insurance market. If consumers know their risk type (they know their expected loss), and if they understand the concept of uberrimae fidei, adverse selection is completely eliminated. However, if uberrimae fidei is strictly enforced by the courts, insurers have no incentive to do any underwriting whatsoever. Therefore, whether consumers know their risk type or not, and whether they understand uberrimae fidei, is of paramount importance. If consumers don’t know their risk type or don’t understand uberrimae fidei, then the (equitable) non-strict enforcement (judicial ruling) of contracts of insurance can be efficiency enhancing as it can create an ex-ante incentive for insurers to underwrite. With an ex-ante positive probability that a court may rule equitably in favor of the insured, the insurer engages in underwriting as part of its profit maximization objective, helping insureds to discover their risk type and/or educating potential insureds on the requirements of a contract of uberrimae fidei.     The financial leverage of Insurers subject to price regulation: evidence from Canada

    The variation in the degree of price regulation in the property-liability insurance market in Canada varies across time and space, creating an opportunity to test a recurring theory in regulatory economics: that price regulated firms have higher levels of financial leverage. Using an instrumental variable for the stringency of price-regulation, this paper utilizes a panel data set of Canadian property-liability insurers over ten years of time, 1997-2006. The results support the theory but do not conclude on whether the increase in financial leverage is a strategic decision or a natural reaction to worsening business conditions brought-on by price-regulation.Price Regulation, Insurance, Financial Leverage, Capital Structure, Bankruptcy

    Financing transportation with land value taxes: Effects on development intensity

    A significant portion of local transportation funding comes from the property tax. The tax is conventionally assessed on both land and buildings, but transportation increases only the value of the land. A more direct, efficient way to fund transportation projects is to tax land at a higher rate than buildings. The lower tax on buildings would allow owners to retain more of the profits of their investment in construction, and have the expected side effect of increased development intensity.     A parallel compact-TVD method for compressible fluid dynamics employing shared and distributed-memory paradigms

    A novel multi-block compact-TVD finite difference method for the simulation of compressible flows is presented. The method combines distributed and shared-memory paradigms to take advantage of the configuration of modern supercomputers that host many cores per shared-memory node. In our approach a domain decomposition technique is applied to a compact scheme using explicit flux formulas at block interfaces. This method offers great improvement in performance over earlier parallel compact methods that rely on the parallel solution of a linear system. A test case is presented to assess the accuracy and parallel performance of the new method
