    Awakening the Law: Unmasking Free Exercise Exceptionalism

    The U.S. Constitution protects myriad, often intertwined, individual rights. Sometimes, protected fundamental rights collide, yet the Constitution lacks a methodology to resolve such clashes. Indeed, an internal tension exists even within the rights included in the First Amendment, as whenever the government acts to protect Free Exercise it advances religion. Rather than adopt a methodology that respects and considers all constitutional rights at issue in instances when constitutional rights are in collision, the Court has embraced Free Exercise Exceptionalism (“FEE”), a doctrine pursuant to which the Court elevates Free Exercise above all rights, including the prohibition expressed in the Establishment Clause. This FEE is evident in recent rulings. In the 2020 Espinoza v. Montana Department of Revenue case, the Court ruled that the no-aid provision of tuition assistance programs for parents who enroll children in religious schools discriminated based on religious status rather than religious use. The Court, using a strict scrutiny standard, changed the question from whether a state may choose to fund religious activity to whether it must. A forceful dissent decried the majority opinion for holding, for the first time, that the Constitution requires the government to provide funds directly to a church. Two years later, Carson expanded Espinoza’s holding by mandating the funding of religious activities and institutions where such funding is available to nonsectarian institutions. Another forceful dissent emphasized that prohibiting a state from excluding religious schools from participating in a state tuition program made available to secular schools effects a violation of the Free Exercise Clause of the First Amendment and the breakdown of the separation of church and state. As evidenced in Carson, the consequence is hugely problematic in that the now-state-funded religious institutions, rather than be bound by general nondiscrimination laws, will be free to openly discriminate against students, staff, teachers, and parents alike. This Article proposes a new paradigm to resolve tensions and conflicts in constitutional rights that takes account of and seeks to preserve all constitutional values. Awakening the law is a multilayered process that seeks to find justice in complex legal conflicts; it is an ongoing process that requires buy-in from all affected constituencies. The resolution of constitutional tensions requires consideration of all interests involved in a constitutional conflict. The embrace of the proposed awakened paradigm, informed by established human rights norms and the First Amendment’s own history, allows for the recognition, exposure, deliberation, and resolution of the injustices effected by FEE

    La presente investigación acción nació de la necesidad de los docentes de inglés de escuelas secundarias de enriquecer su desarrollo profesional en el campo de la enseñanza a estudiantes con discapacidad auditiva. Este estudio propone el diseño y la implementación de una propuesta didáctica basada en backward design como posible estrategia para enriquecer el desarrollo profesional de ocho profesores de inglés. Esta propuesta tiene como bases teóricas la Ley de Inclusión, educación inclusiva y backward design enmarcado por Understanding by design (UbD). Adicionalmente, está enfocada en orientaciones pedagógicas para la enseñanza a estudiantes sordos. Luego, la investigadora procedió a implementar la propuesta didáctica y analizó los datos recogidos a través de instrumentos cualitativos los cuales generaron como conclusión que es posible enriquecer el desarrollo profesional de los docentes de inglés por medio de la activación de una conciencia inclusiva y de la reflexión sobre la propias prácticas de enseñanza para encontrar alternativas que fomenten el aprendizaje del inglés en estudiantes sordos, como fue establecido en la propuesta didáctica.The current action research was born from the need of English teachers at secondary school of enriching their professional development in the field of teaching to hearing impaired students. This study proposes the design and implementation of a didactic proposal based on backward design as a possible strategy to enrich eight secondary school English teachers‘ professional development. This proposal has as theoretical basis Law of Inclusion, inclusive education and backward design framed by Understanding by design (UbD). Additionally, it is focused on pedagogical guidelines for teaching to deaf students. Then researcher proceeded to implement the didactic proposal and analyzed the data gathered through qualitative instruments which generated as conclusion that it is possible to enrich English teachers‘ professional development through the activation of an inclusive awareness and the reflection on own teaching practices to find alternatives to foster deaf students‘ English learning as it was stated in the didactic proposal

    Macraucheniidae y Proterotheriidae (Mammalia, Litopterna) de Quebrada Fiera (Oligoceno tardío), Mendoza, Argentina

    In this contribution we present new specimens of Litopterna recovered during the last decade in Quebrada Fiera (Mendoza Province, Argentina), whose fossiliferous sediments, currently recognized as the base of Agua de la Piedra Formation, are assignable to Late Oligocene (Deseadan South American Land Mammal Age). Two remains mentioned in the first publication on this locality were neither detailed nor described, and they have not been located in the corresponding repository. The new material consists of postcranial fragmentary remains (astragali, calcaneum, and metapodials) of Macraucheniidae (Cramaucheniinae) and an incomplete upper molar (M3) of Proterotheriidae (Proterotheriinae). These few remains of litopterns contrast with the abundance of notoungulates at Quebrada Fiera. A comparative study was carried out with material from Patagonia (Argentina) and taxa recorded in Bolivia and Peru for the same temporal interval. The specimens of Cramaucheniinae are assigned to Coniopternium andinum and the molar of Proterotheriinae to cf. Lambdaconus suinus. This contribution allows us to extend the geographical range of Coniopternium, filling the gap between the Patagonian and lower latitude localities (Bolivia and Peru) in which this genus was found. The record of L. suinus in Quebrada Fiera expands the geographical range of this species outside from Patagonia.En este trabajo se describen nuevos ejemplares de Litopterna recuperados durante la última década en la localidad de Quebrada Fiera (Mendoza, Argentina). Los sedimentos fosilíferos, actualmente reconocidos como la base de la Formación Agua de la Piedra, son asignables al Oligoceno tardío (Edad Mamífero Deseadense). Los dos restos mencionados en la primera publicación sobre esta localidad nunca se detallaron ni describieron, y no han sido localizados en el repositorio correspondiente. El nuevo material consiste en restos poscraneanos fragmentarios (astrágalos, calcáneo y metápodos) de Macraucheniidae (Cramaucheniinae) y un molar superior incompleto (M3) de un Proterotheriidae (Proterotheriinae). Esta escasez de litopternos contrasta con la abundancia de notoungulados en Quebrada Fiera. Se realizó un estudio comparativo con materiales de la Patagonia (Argentina) y de taxones registrados en Bolivia y Perú para el mismo lapso. Los restos de Cramaucheniinae se asignan a Coniopternium andinum y el molar de Proterotheriinae a cf. Lambdaconus suinus. Esta contribución permite ampliar el rango geográfico de Coniopternium a un área intermedia entre las localidades patagónicas y de latitudes más bajas (Bolivia y Perú) en donde se ha registrado este género.     New postcranial remains of large toxodontian notoungulates from the late Oligocene of Mendoza, Argentina and their systematic implications

    During the last decade, the Deseadan (late Oligocene) Quebrada Fiera locality, Mendoza Province, Argentina, has provided a large amount of mammal remains. Taxonomic studies have shown the presence of faunal elements common with other Deseadan associations from Patagonia and lower latitudes (Salla, Bolivia), as well as endemic taxa of different groups of mammals (Notohippidae, Leontiniidae, Homalodotheriidae, Hegetotheriidae, and Metatheria) and even a gastropod. In this work, we present a taxonomic and phylogenetic analysis of a set of postcranial fossils of three families of the suborder Toxodontia (Notoungulata). The postcranial elements are assigned to taxa previously recognized at Quebrada Fiera, such as the leontiniid Gualta cuyana and the homalodotheriid Asmodeus petrasnerus, but also to the family Toxodontidae that is represented by Proadinotherium sp. and another larger toxodontid; a few dental remains of Proadinotherium are also included as this is the first time that toxodontids from Quebrada Fiera are described. In the case of A. petrasnerus, an almost complete calcaneum allows us to expand the diagnosis of this taxon. The bones assigned to G. cuyana enlarge the anatomical knowledge of this species. In turn, the presence of the genus Proadinotherium extends its geographic distribution in Argentina and adds to the extra-Patagonian record of P. saltoni from Salla, Bolivia. Phylogenetic results do not differ much from previous analyses using postcranial characters, and the obtained consensus trees show low node supports. The various phylogenetic analyses performed here provide a more robust framework to interpret the relationships of the studied taxa.Fil: Hernández del Pino, Santiago Ezequiel.     Este trabajo presenta los alcances de la implementación de un ambiente de aprendizaje apoyado en TIC, para movilizar el pensamiento espacial, desde el objeto matemático: los movimientos rígidos en el plano, en estudiantes de séptimo grado. Este proceso reflexivo de transformación de las prácticas en el aula, se realiza desde un enfoque investigativo mixto, inmersos en la metodología Escuela Nueva que hace parte del contexto educativo institucional, estableciendo diferentes momentos de interacción de los estudiantes con el objeto matemático, mediante el software GeoGebra, promoviendo el aprendizaje activo y participativo
