    Deemed Consent in Islamic Banking from Contract Law Perspective: A Sharia Analysis

    This paper is specifically focusing on the issue of deemed consent as applied in modern Islamic financial contracts. It has been recognized by some scholars and rejected by others. The purpose of this study is to examine the meaning of deemed consent in contract law and its recognition from the Sharia point of view. It begins with examining the meaning of sighah and deemed consent from civil law as well as Islamic law perspective and followed by the analysis of the effect of silence in the validity of acceptance in Islamic law of contract. The approach that is applied in this study is qualitative research in nature, with regards to documentation and secondary sources by reviewing and analyzing the fiqhi perspective of consent and silence in Islamic law; by taking into consideration current practice of financial industry. The findings of the study are that deemed consent in the law can be considered as an acceptance. It is understood by the buyer indicating his consent to the sale by his conduct or silence. Generally, absolute silence in banking transactions is not an acceptance, but that there must be evidences or clues indicating the consent of customers. As such the non-absolute silence can be considered as acceptance in the Islamic law by taking into consideration some Sharia parameters proposed in this study. Interestingly, this idea is also shared by the Common law. Accordingly, based on the analysis conducted in this study, tacit acceptance, or implied acceptance is one of the means of expressing contemporary consent that can be applied. This study develops Sharia parameters consisting of five items as important guidelines in applying deemed consent in the Islamic banking

    Postgraduate students’ perspective on supporting “learning from home” to solve the COVID-19 pandemic

    The objective of this present research was to reveal how the postgraduate student perceive of or respond to the online learning process. Quantitative method was adopted in this present research. The results showed that most students who had experienced of the online learning activities encountered some obstacles because they had never conducted Learning From Home (LFH) activities before. The respondents were 428 postgraduate students who actively joined in the LFH activities. There were 316 students used the platform Zoom as the supporting application in the LFH activities. Respondents filled in Google Form, then the collected data could be quickly and accurately processed. Other respondents preferred Google Classroom, WhatsApp and other applications in following the learning activities according to the agreement and features provided in each platform. There were 408 respondents experienced Two-ways communication between the lecturers and the students during the LFH activities. They stated that the limited internet network hindered the online lecturing. There were 31 respondents declared that technology limitations hampered the online lecturing and 105 students revealed that it is the limitations in using the application that caused the online lecturing to become obstacles.

    Multiple intelligence assessment in teaching English for young learners

    There are many schools in Indonesia that provide English as one of their subjects. English has been taught from elementary schools, even in Kindergarten. Ironically, teaching English in most rural schools still uses a conventional method such as memorizing and translating. Many teachers cannot afford to provide well-designed, meaningful exercises for students to use on a one-to-one learning basis. As a result, students seem not having interest in learning English. Based on this reason, this study was conducted to identify students’ intelligence through Multiple Intelligence Assessment to get effective approach in teaching English for young learners. The participants are an English teacher and students at an early childhood education center. This research focuses on presenting a deep description of the Multiple-Intelligence assessment to identify students’ intelligence in order to get an effective way of teaching English for young learners. In collecting the data, three instruments were used: observation, interview, and document analysis. The findings of this study show that students have different interests and nature; some students love singing, some others enjoy drawing, and others like role-playing. Multiple-Intelligence Assessment helps the teachers to identify students’ interests and bring them building some learning activities to attract them in learning English

    The main challenges for the HEIs are to provide a market driven academic programmes and able to respond to the changing needs of economic sectors. Apparently, the recent challenges require the staff to equip themselves with leadership quality in order to achieve organizational goals. Previous studies have shown several factors such as EI influenced effective leadership. Another significant issue in leadership is ethical behaviors. Therefore, this study intends to examine the relationship between EI and leadership practices when Islamic work ethic is practiced in Malaysian public universities. The respondents will consist of middle administrators in Malaysian public universities. Using qualitative and cross sectional approaches, surveys will be distributed to the stratified randomly selected respondents. Most of the past results suggested there were significant relationships between the variables. The findings are expected to have some contributions both to the practical and theoretical aspects and enable PHIs to improve their leadership training programmes

    The Dynamics of Learning Loss for Elementary Students Jakarta in the New Normal

    This study aims to determine the occurrence of learning loss in the new normal era due to sudden changes in the online learning process for elementary school students in Jakarta. This study uses a case study qualitative research method to analyse the causes of learning loss in elementary school students. There are five research stages: test questions, observation, questionnaires, interviews, and documentation. The research subjects were 30 grade IV elementary school students in Jakarta and one grade IV teacher. The results of this study stated that as many as 33.33% of elementary school students did not experience learning loss, and as many as 66.67% of students experienced learning loss
