This paper aims at monitoring the evolution of three European ODR providers that were studied in our previous paper "Mediation for B2C Disputes: Results of a Study of Three European ODR Providers". We focus on quantitative data such as the number of disputes managed, their type and their nature for 2007, 2008 and 2009 to see if any development has taken place. The question of whether the world financial crisis has affected these institutions and some facts in this respect are presented, as well as other issues such as the specialization of the organisation for the success of the service. Summary: In this article, we present the first study on PALM-UP from the perspective of discourse markers in Catalan Sign Language (LSC). In the sample extracted from the LSC Corpus, we observed that PALM-UP is polyfunctional. It frequently expresses nonconnective purposes, that is, it is used to punctuate discourse or to participate in the exchange between signers. We have not found correspondences between the handshape of PALM-UP (one handed or two handed) and its functions. We have neither observed any combination of nonmanuals that allows us to distinguish one function from the other. This finding underlines the importance of context in order to assign a specific function to this discourse marker. Keywords: PALM-UP, discourse marker, functional description, handshape, nonmanual

L'anàlisi s'inicia amb l'exposició del marc teòric aplicable, tot contextualitzant el progressiu increment de la utilització de la mediació i d'altres ADR en dret administratiu. A continuació, fa una breu repassada de la regulació de la mediació administrativa dins de l'àmbit d'alguns sistemes de dret comparat. Finalment, fa una anàlisi de les possibilitats de la mediació en el context del dret aplicable a Catalunya. El capítol distingeix entre la mediació extrajudicial (ja sigui dins del procediment administratiu o no) i la mediació processal o intrajudicial. Online dispute resolution in 2010 : a cyberspace odyssey?

This paper presents some results of a research on Online Dispute Resolution (ODR) and mediation online that was undertaken for the White Book on Mediation in Catalonia. The research shows the state of the art of ODR today. It presents the technologies, processes and products currently existing in the global market. A survey of 34 ODR providers is presented with information on service models, communication types, functionalities, ADR services and other off-ADR services such as seals of quality or formation activities. The survey shows that in most ODR services, IT is not fully employed and web 2.0/web 3.0 tools are barely used at all. Consequently, ODR systems do not yet benefit from the opportunities these technologies could provide. Our survey also shows that there are less active ODR services providers today than only a few years ago

Tecnologies per a la mediació en línia : estat de l'art, usos i propostes

Aquest capítol recull la recerca que l'equip de mediació i tecnologia (ET11) ha realitzat en el marc del Llibre Blanc. Els objectius generals del capítol són presentar, d'una banda, una panoràmica de les tecnologies, processos i productes actualment existents en l'àmbit de la resolució en línia de conflictes (Online Dispute Resolution, ODR) i, d'altra, analitzar els usos de tecnologia i les necessitats dels proveïdors de serveis de mediació a Catalunya. El resultat de la recerca ha permès també desenvolupar un prototipus de plataforma online per a la mediació que figura com a Annex del capítol. En darrera instància, la nostra aportació al Llibre Blanc ha consistit a identificar i explorar noves oportunitats tecnològiques i a oferir algunes recomanacions que potenciïn l'eficiència i l'eficàcia dels serveis de mediació, així com la satisfacció dels usuaris envers aquests serveis

Una cartografia completa de les experiències en mediació en tots els àmbits socials, de les escoles als hospitals, de les empreses als nuclis familiars, de la mediació comunitària als conflictes de consum o laborals, de la mediació penal a la mediambiental. També s'hi ha incorporat una anàlisi dels costos de la mediació i de la seva configuració jurídica. La conjunció de les fotografies en relleu i dels estudis més teòrics han fet possible la reflexió ulterior, les interpretacions crítiques i, en darrer terme, les conclusions i les recomanacions, que ens ajudaran a progressar. La mediació permet detenir l'escalada dels conflictes i sostreure'ls de la resolució judicial, per implicar les parts i fer-les protagonistes actives de les solucions a què arribin. When the meaning of SAME is not restricted to likeness : A preliminary study from the perspective of discourse relational devices in two sign languages

This paper presents a study of a discourse relational device, namely same, in French Belgian Sign Language and Catalan Sign Language. Three aspects of same are examined including its distribution across genres, its functional description and its position in discourse. Two comparable samples were extracted from the reference corpora of these two sign languages. An annotation protocol and a segmentation model designed for the study of discourse relational devices in the spoken modality were used with the necessary adaptations to the signed modality. The results show a different distribution of same across genres in each sign language and several possible positions. Although same is polyfunctional in the two datasets, the most frequent function in the French Belgian Sign Language dataset (i.e., addition) is not found in the Catalan Sign Language dataset. This finding indicates that equivalent discourse relational devices in the signed modality also have language-specific functions as their counterparts in the spoken modality do

What can discourse markers tell us about genres and vice versa? A corpus-driven study of French Belgian Sign Language (LSFB)

This paper focuses on the use of three discourse markers – namely list buoys, PALM-UP and SAME – across genres in French Belgian Sign Language. Our sample contains argumentative, explanatory, metalinguistic and narrative dialogues produced by six signers. We present a functional description of the three discourse markers and their distribution across genres. PALM-UP and SAME are highly polyfunctional, whereas list buoys express fewer functions in the dataset. In our sample, there are few differences in frequency of use of the three discourse markers and their functions across genres.Qu’est-ce que les marqueurs de discours peuvent nous dire sur les genres et réciproquement ? Une étude de corpus sur la langue des signes de Belgique francophone (LSFB) Cet article étudie l’utilisation de trois marqueurs de discours — les balises-liste, le palm‑up et le signe aussi — à travers les genres en langue des signes de Belgique francophone. Notre échantillon est composé de dialogues argumentatifs, explicatifs, métalinguistiques et narratifs qui sont produits par six signeurs. Nous présentons une description des fonctions des trois marqueurs de discours et de leur distribution à travers les quatre genres. palm-up et aussi peuvent exprimer des fonctions variées, tandis que les fonctions des balises-liste sont plus restreintes. Dans notre échantillon, nous observons qu’il y a peu de différences dans la fréquence d’utilisation des trois marqueurs de discours et de leurs fonctions à travers les genres
