Mens Rea in Corpore Reo: An Exploration of the Rapists Charter

The issue of rape has long been at the forefront of the feminist movement. Legal doctrine and legal procedure relevant to rape have been strongly attacked by a variety of critics.\u27 The most obvious recent trend has been a movement from the traditional liberal concern with the protection of the accused from unjustified conviction, to victim-oriented efforts which are designed to ensure that the number of guilty offenders who evade responsibility for rape is reduced as much as possible. 2 The bases of calls for victim orientation have ranged from the view, most eloquently expressed by Susan Brownmiller, that the fact of rape is a pattern of conduct by which all men keep all women in a state of fearful subjection, 3 to the view that present rape laws, suitable amended, will provide as much protection from rape as can reasonably be expecte

Deferred Compensation under the Tax Reform Act of 1969

Executive compensation covers a broad range of benefits, including current cash payments, stock bonuses and options in their various forms, qualified pension plans, life insurance and even such fringe benefits as use of company provided automobiles and aircraft. A significant portion of the compensation picture encompasses contracts and plans which defer the receipt of income until a taxable period later than the period to which the services giving rise to the compensation are related. Although only one of many compensation devices, deferred compensation is of considerable importance to American industry as a form of executive pay. A recent study of executive remuneration of the Fortune Top 100 industrial companies showed that fifty-nine of the companies offered their executives some form of deferred compensation contract or plan

    ISU Compost Facility

    Get PDF
In 2008 Iowa State University constructed a new facility for composting organic waste materials from several campus sources. The facility was planned as part of the new ISU Dairy Farm to handle solid dairy manure in an environmentally responsible manner. It is designed to handle more than 10,000 tons of organic wastes annually. The facility is located west of the ISU Dairy Farm

The Law Reform Commission of Canada, Barnes and Marlin, and the Value-Consensus Model: More about Ideology

Barnes and Marlin have attacked the original paper written by me about the Law Reform Commission of Canada and the ideology of criminal process reform. The discussion which follows is not limited to being my response to their response: such a discussion would be fruitless and introverted to the point of boredom. Thus, although some of the discussion begins with Barnes and Marlin, it is not intended to end there, for indeed Barnes and Marlin have not really discussed much of the original comment at all. Their paper contains some discussion of the notion of consensus although, it is submitted, their discussion is largely a product of misunderstanding. However, Barnes and Marlin have not discussed any other attribute of the value-consensus model at all, nor have they dealt with the specific examples and criticisms raised in the original paper. Barnes and Marlin do not deal with the quite substantial body of literature, referred to and discussed in the original paper, which has surrounded the debate concerning the ideology of the criminal process and the criminal law, both as it is and as it should be

What makes a 'good group'? Exploring the characteristics and performance of undergraduate student groups

    Get PDF
Group work forms the foundation for much of student learning within higher education, and has many educational, social and professional benefits. This study aimed to explore the determinants of success or failure for undergraduate student teams and to define a ‘good group’ through considering three aspects of group success: the task, the individuals, and the team. We employed a mixed methodology, combining demographic data with qualitative observations and task and peer evaluation scores. We determined associations between group dynamic and behaviour, demographic composition, member personalities and attitudes towards one another, and task success. We also employed a cluster analysis to create a model outlining the attributes of a good small group learning team in veterinary education. This model highlights that student groups differ in measures of their effectiveness as teams, independent of their task performance. On the basis of this, we suggest that groups who achieve high marks in tasks cannot be assumed to have acquired team working skills, and therefore if these are important as a learning outcome, they must be assessed directly alongside the task output

Abnormalities of the ventilatory equivalent for carbon dioxide in patients with chronic heart failure

Introduction. The relation between minute ventilation (VE) and carbon dioxide production (VCO2) can be characterised by the instantaneous ratio of ventilation to carbon dioxide production, the ventilatory equivalent for CO2 (VEqCO2). We hypothesised that the time taken to achieve the lowest VEqCO2 (time to VEqCO2 nadir) may be a prognostic marker in patients with chronic heart failure (CHF). Methods. Patients and healthy controls underwent a symptom-limited, cardiopulmonary exercise test (CPET) on a treadmill to volitional exhaustion. Results. 423 patients with CHF (mean age 63±12 years; 80% males) and 78 healthy controls (62% males; age 61±11 years) were recruited. Time to VEqCO2 nadir was shorter in patients than controls (327±204 s versus 514±187 s; P=0.0001). Univariable predictors of all-cause mortality included peak oxygen uptake (X 2 =53.0), VEqCO2 nadir (X 2 =47.9), and time to VEqCO2 nadir (X 2 =24.0). In an adjusted Cox multivariable proportional hazards model, peak oxygen uptake (X 2 =16.7) and VEqCO2 nadir (X 2 =17.9) were the most significant independent predictors of all-cause mortality. Conclusion. The time to VEqCO2 nadir was shorter in patients with CHF than in normal subjects and was a predictor of subsequent mortality. © 2012 Lee Ingle et al
