Beyond Nondiscrimination: AT&T Mobility LLC v. Concepcion and the Further Federalization of U.S. Arbitration Law
The article presents information on the court case of AT&T Mobility LLC v. Concepcion that was decided by the U.S. Supreme Court and which questioned the preemption of state law and the Federal Arbitration Act related to the enforcement of arbitration agreement. The unconscionability doctrine, the case law related to arbitration and the contract law is discussed. The interpretation of arbitration law is also discussed
The Dust Content of Galaxy Clusters
We report on the detection of reddening toward z ~ 0.2 galaxy clusters. This
is measured by correlating the Sloan Digital Sky Survey cluster and quasar
catalogs and by comparing the photometric and spectroscopic properties of
quasars behind the clusters to those in the field. We find mean E(B-V) values
of a few times 10^-3 mag for sight lines passing ~Mpc from the clusters'
center. The reddening curve is typical of dust but cannot be used to
distinguish between different dust types. The radial dependence of the
extinction is shallow near the cluster center suggesting that most of the
detected dust lies at the outskirts of the clusters. Gravitational
magnification of background z ~ 1.7 sources seen on Mpc (projected) scales
around the clusters is found to be of order a few per cent, in qualitative
agreement with theoretical predictions. Contamination by different spectral
properties of the lensed quasar population is unlikely but cannot be excluded.Comment: 4 pages, 3 figure
The 3-53 keV Spectrum of the Quasar 1508+5714: X-rays from z = 4.3
We present a high-quality X-ray spectrum in the 3--53 keV rest-frame band of
the radio-loud quasar 1508+5714, by far the brightest known X-ray source at z >
4. A simple power-law model with an absorption column density equal to the
Galactic value in the direction of the source provides an excellent and fully
adequate fit to the data; the measured power-law photon index Gamma = 1.42
(+0.13,-0.10). Upper limits to Fe K alpha line emission and Compton-reflection
components are derived. We offer evidence for both X-ray and radio variability
in this object and provide the first contemporaneous radio spectrum (alpha =
-0.25). The data are all consistent with a picture in which the emission from
this source is dominated by a relativistically beamed component in both the

Synthesis and characterization of a series of nickel(II) alkoxide precursors and their utility for Ni(0) nanoparticle production
A series of nickel(ii) aryloxide ([Ni(OAr)2(py)x]) precursors was synthesized from an amide-alcohol exchange using [Ni(NR2)2] in the presence of pyridine (py). The H-OAr selected were the mono- and di-ortho-substituted 2-alkyl phenols: alkyl = methyl (H-oMP), iso-propyl (H-oPP), tert-butyl (H-oBP) and 2,6-di-alkyl phenols (alkyl = di-iso-propyl (H-DIP), di-tert-butyl (H-DBP), di-phenyl (H-DPhP)). The crystalline products were solved as solvated monomers and structurally characterized as [Ni(OAr)2(py)x], where x = 4: OAr = oMP (1), oPP (2); x = 3: OAr = oBP (3), DIP (4); x = 2: OAr = DBP (5), DPhP (6). The excited states (singlet or triplet) and various geometries of 1-6 were identified by experimental UV-vis and verified by computational modeling. Magnetic susceptibility of the representative compound 4 was fit to a Curie Weiss model that yielded a magnetic moment of 4.38(3)ÎĽB consistent with a Ni2+ center. Compounds 1 and 6 were selected for decomposition studied under solution precipitation routes since they represent the two extremes of coordination. The particle size and crystalline structure were characterized using transmission electron microscopy (TEM) and powder X-ray diffraction (PXRD). The materials isolated from 1 and 6 were found by TEM to form irregular shape nanomaterials (8-15 nm), which by PXRD were found to be Ni0 hcp (PDF: 01-089-7129) and fcc (PDF: 01-070-0989), respectively
Functional identification of an aggression locus in the mouse hypothalamus
Electrical stimulation of certain hypothalamic regions in cats and rodents can elicit attack behaviour, but the exact location of relevant cells within these regions, their requirement for naturally occurring aggression and their relationship to mating circuits have not been clear. Genetic methods for neural circuit manipulation in mice provide a potentially powerful approach to this problem, but brain-stimulation-evoked aggression has never been demonstrated in this species. Here we show that optogenetic, but not electrical, stimulation of neurons in the ventromedial hypothalamus, ventrolateral subdivision (VMHvl) causes male mice to attack both females and inanimate objects, as well as males. Pharmacogenetic silencing of VMHvl reversibly inhibits inter-male aggression. Immediate early gene analysis and single unit recordings from VMHvl during social interactions reveal overlapping but distinct neuronal subpopulations involved in fighting and mating. Neurons activated during attack are inhibited during mating, suggesting a potential neural substrate for competition between these opponent social behaviours
Feasibility and Informative Value of Environmental Sample Collection in the National Children\u27s Vanguard Study
Background: Birth cohort studies provide the opportunity to advance understanding of the impact of environmental factors on childhood health and development through prospective collection of environmental samples. Methods: We evaluated the feasibility and informative value of the environmental sample collection methodology in the initial pilot phase of the National Children\u27s Study, a planned U.S. environmental birth cohort study. Environmental samples were collected from January 2009–September 2010 at up to three home visits: pre-pregnancy (n¼306), pregnancy (n¼807), and 6-months postnatal (n¼117). Collections included air for particulate matter r2.5 mm (PM2.5), nitrogen dioxide, ozone, volatile organic compounds (VOCs), and carbonyls; vacuum dust for allergens/endotoxin; water for VOCs, trihalomethanes (THMs), and haloacetic acids (HAAs); and wipe samples for pesticides, semi-volatile organics, and metals. We characterized feasibility using sample collection rates and times and informative value using analyte detection frequencies (DF). Results: Among the 1230 home visits, environmental sample collection rates were high across all sample types (mean¼89%); all samples except the air PM2.5 samples had collection times o30 min. Informative value was low for water VOCs (median DF¼0%) and pesticide floor wipes (median DF¼5%). Informative value was moderate for air samples (median DF¼35%) and high for water THMs and HAAs (median DF¼91% and 75%, respectively). Conclusions: Though collection of environmental samples was feasible, some samples (e.g., wipe pesticides and water VOCs) yielded limited information. These results can be used in conjunction with other study design considerations, such as target population size and hypotheses of interest, to inform the method selection of future environmental health birth cohort studies
Characterisation of a new VUV beamline at the Daresbury SRS using a dispersed fluorescence apparatus incorporating CCD detection
The design and performance of a new normal incidence monochromator at the Daresbury Synchrotron Radiation Source, optimised for experiments requiring high flux of vacuum-UV radiation, are described. The re-developed beamline 3.1, based on the Wadsworth design of monochromator, is the source of tunable vacuum-UV photons in the range 4 – 31 eV, providing over two orders of magnitude more flux than the vacuum-UV, Seya monochromator in its previous manifestation. The undispersed and dispersed fluorescence spectra resulting from photoexcitation of N, CO, CF and CF are presented. Emitting species observed were N B - X, CO Aď€ - Xď€ and Bď€ - Xď€, CF Cď€T - Xď€T and Cď€T - Aď€T, CF* A - A, and CF Bď€A - Xď€E. A CCD multi-channel detector has significantly reduced the time period needed to record dispersed fluorescence spectra with a comparable signal-to-noise ratio
How Reasoning Aims at Truth
Many hold that theoretical reasoning aims at truth. In this paper, I ask what it is for reasoning to be thus aim-directed. Standard answers to this question explain reasoning’s aim-directedness in terms of intentions, dispositions, or rule-following. I argue that, while these views contain important insights, they are not satisfactory. As an alternative, I introduce and defend a novel account: reasoning aims at truth in virtue of being the exercise of a distinctive kind of cognitive power, one that, unlike ordinary dispositions, is capable of fully explaining its own exercises. I argue that this account is able to avoid the difficulties plaguing standard accounts of the relevant sort of mental teleology
A Spectroscopic Survey of Faint Quasars in the SDSS Deep Stripe: I. Preliminary Results from the Co-added Catalog
In this paper we present the first results of a deep spectroscopic survey of
faint quasars in the Sloan Digital Sky Survey (SDSS) Southern Survey, a deep
survey carried out by repeatedly imaging a 270 deg^2 area. Quasar candidates
were selected from the deep data with good completeness over 0<z<5, and 2 to 3
magnitudes fainter than the SDSS main survey. Spectroscopic follow-up was
carried out on the 6.5m MMT with Hectospec. The preliminary sample of this SDSS
faint quasar survey (hereafter SFQS) covers ~ 3.9 deg^2, contains 414 quasars,
and reaches g=22.5. The overall selection efficiency is ~ 66% (~ 80% at
g<21.5); the efficiency in the most difficult redshift range (2<z<3) is better
than 40%. We use the 1/V_{a} method to derive a binned estimate of the quasar
luminosity function (QLF) and model the QLF using maximum likelihood analysis.
The best model fits confirm previous results showing that the QLF has steep
slopes at the bright end and much flatter slopes (-1.25 at z<2.0 and -1.55 at
z>2.0) at the faint end, indicating a break in the QLF slope. Using a
luminosity-dependent density evolution model, we find that the quasar density
at M_{g}<-22.5 peaks at z~2, which is later in cosmic time than the peak of
z~2.5 found from surveys of more luminous objects. The SFQS QLF is consistent
with the results of the 2dF QSO Redshift Survey, the SDSS, and the 2dF-SDSS LRG
and QSO Survey, but probes fainter quasars. We plan to obtain more quasars from
future observations and establish a complete faint quasar sample with more than
1000 objects over 10 deg^2.Comment: 25 pages, 13 figures, accepted for publication in A
Abelson Phosphorylation of CLASP2 Modulates its Association With Microtubules and Actin
The Abelson (Abl) non-receptor tyrosine kinase regulates the cytoskeleton during multiple stages of neural development, from neurulation, to the articulation of axons and dendrites, to synapse formation and maintenance. We previously showed that Abl is genetically linked to the microtubule (MT) plus end tracking protein (+TIP) CLASP in Drosophila. Here we show in vertebrate cells that Abl binds to CLASP and phosphorylates it in response to serum or PDGF stimulation. In vitro, Abl phosphorylates CLASP with a Km of 1.89 µM, indicating that CLASP is a bona fide substrate. Abl-phosphorylated tyrosine residues that we detect in CLASP by mass spectrometry lie within previously mapped F-actin and MT plus end interaction domains. Using purified proteins, we find that Abl phosphorylation modulates direct binding between purified CLASP2 with both MTs and actin. Consistent with these observations, Abl-induced phosphorylation of CLASP2 modulates its localization as well as the distribution of F-actin structures in spinal cord growth cones. Our data suggest that the functional relationship between Abl and CLASP2 is conserved and provides a means to control the CLASP2 association with the cytoskeleton. © 2014 The Authors.
