    Complejidades y contradicciones de la política migratoria hacia la migración venezolana en el Perú

    Objetivo/contexto: el objetivo de este artículo es describir cómo la política migratoria peruana hacia la población venezolana se inscribe en una lógica de control migratorio. Se analizan la ley de migraciones y la de refugio, así como el mecanismo político-jurídico del permiso temporal de permanencia a la luz de los conceptos de “política de control con rostro humano y gobernabilidad migratoria. Metodología: el trabajo se basa en el análisis de una serie de entrevistas a distintos actores clave del Estado y de los organismos internacionales en tres ciudades del país (Lima, Tumbes y Tacna) realizadas entre enero y marzo de 2020. Este análisis se complementa con la revisión detallada del marco normativo e institucional peruano y diversas entrevistas y declaraciones públicas de la Presidencia de la República alrededor de la migración venezolana. Conclusiones: se concluye que, a pesar de contar con una renovada legislación migratoria, las respuestas del Estado peruano frente a la migración venezolana están ancladas en los conceptos de control y utilidad de la migración. Asimismo, la política de asilo, supuestamente más protectora, se ve también impactada por los discursos y las prácticas de control. Originalidad: este trabajo propone un análisis integral de las políticas hacia la población venezolana, incluyendo la de asilo. Con ello, permite entender las complejas relaciones entre esta y la política migratoria. Además de centrarse en el rol del Estado en la construcción de estas políticas, se incluye la perspectiva de la Organización Internacional para las Migraciones (OIM) y del Alto Comisionado de las Naciones Unidas para los Refugiados (Acnur) como actores fundamentales de este proceso. Con ello, el trabajo abre nuevos caminos de investigación sobre el rol de actores internacionales en la gestión de la migración en la región.Objective/Context: This article aims to describe how the Peruvian migration policy towards the Venezuelan population is part of migration control logic. Migration and refugee laws are analyzed, and the political-legal mechanism of the Temporary Permit of Permanence in the light of the concepts of “control policy with a human face” and migratory governance. Methodology: the work is based on analyzing a series of interviews with different key actors of the State and international organizations in 3 cities of the country (Lima, Tumbes, and Tacna) carried out between January and March 2020. This analysis is complemented by the detailed review of the Peruvian regulatory and institutional framework and various interviews and public statements by the Office of the President of the Republic on Venezuelan migration. Conclusions: it is concluded that, despite having a renewed immigration legislation, the responses of the Peruvian State to Venezuelan migration are anchored in the concepts of control and utility of migration. Likewise, asylum policy, supposedly more protective, is also impacted by discourses and control practices. Originality: this work proposes a comprehensive analysis of the policies towards the Venezuelan population, including that of asylum. This approach allows us to understand the complex relationships between immigration and asylum policy. In addition to focusing on the State’s role in the construction of these policies, the perspective of the International Organization for Migration (IOM) and the United Nations High Commissioner for Refugees (UNHCR) are included as key actors in this process. With this, the work opens new avenues of research on international actors’ role in managing migration in the region.Objetivo/contexto: o objetivo deste artigo é descrever como a política migratória do Peru para a população venezuelana se insere em uma lógica de controle migratório. São analisadas as leis de migração e refugiados, bem como o mecanismo político-jurídico da Autorização de Permanência Temporária à luz dos conceitos de “política de controle com rosto humano” e governança migratória. Metodologia: o trabalho se baseia na análise de uma série de entrevistas com diferentes atores-chave do Estado e de organismos internacionais em três cidades do país (Lima, Tumbes e Tacna) realizadas entre janeiro e março de 2020. Essa análise é complementada pela revisão detalhada do marco regulatório e institucional do Peru e de várias entrevistas e declarações públicas da Presidência da República sobre a migração venezuelana.Conclusões: conclui-se que, apesar de ter uma legislação migratória renovada, as respostas do Estado peruano à migração venezuelana estão ancoradas nos conceitos de controle e utilidade da migração. Da mesma forma, a política de asilo, supostamente mais protetora, também é impactada por discursos e práticas de controle. Originalidade: este trabalho propõe uma análise abrangente das políticas para a população venezuelana, incluindo as políticas de asilo. Com isso, permite-nos compreender as complexas relações entre a política de imigração e asilo. Além de enfocar o papel do Estado na construção dessas políticas, a perspectiva da Organização Internacional para as Migrações (OIM) e do Alto Comissariado das Nações Unidas para os Refugiados (ACNUR) figuram como atores-chave nesse processo.     Addressing Overlapping Migratory Categories within New Patterns of Mobility in Peru

    This article reflects on the construction and application of different migratory categories in the Peruvian context, including irregular migrants, refugees, victims of trafficking, and smuggled migrants. Through legal analysis and interviews with key migration actors in the country, the paper explores the ways in which Peru responds to migrants in these different categories, in view of the recent changes in human mobility in the country. The article aims to shed light on the fragmentation of migratory categories and the negative effects this has on migrants’ human rights. It is exploratory in nature and serves as a starting point for further debate on the subject

    Towards a typology of social protection for migrants and refugees in Latin America during the COVID-19 pandemic

This paper comparatively examines what type of social protection has been provided, by whom, and to what extent migrant and refugee populations have been included in these programmes in seven countries of the region during the COVID-19 pandemic, between March and December 2020. We develop a typology of models of social protection highlighting the assemblages of actors, different modes of protection and the emerging migrants’ subjectification in Brazil, Chile, Colombia, Ecuador, Mexico, Peru, and Uruguay in relation to Non-Contributory Social Transfer (NCST) programmes and other actions undertaken by state and non-state actors. The analysis is based on 85 semi-structured interviews with representatives of national and local governments, International Organisations, Civil Society Organisations, and migrant-led organisations across 16 cities, and a systematic review of regulatory frameworks in the country-case studies. The proposed typology shows broad heterogeneity and complexity regarding different degrees of inclusion of migrant and refugee populations, particularly in pre-existing and new NCST programmes. These actions are furthering notions of migrant protection that are contingent and crisis-driven, imposing temporal limitations that often selectively exclude migrants based on legal status. It also brings to the fore the path-dependent nature of policies and practices of exclusion/inclusion in the region, which impact on migrants’ effective access to social and economic rights, while shaping the broader dynamics of migration governance in the region.https://doi.org/10.1186/s40878-021-00265-x9pubpu

    El presente artículo propone analizar la normativa peruana en materia de tráfico de migrantes desde una perspectiva de derechos humanos. Debido a las múltiples aristas del tema y las obligaciones del Derecho Internacional, el Estado ha adoptado de manera progresiva un conjunto de normas para atender dicha problemática. Este marco normativo enfrenta una serie de retos, en primer lugar, responde a una realidad poco conocida, debido a la falta de datos confiables sobre el tráfico; en segundo lugar, se superpone en cada momento con la trata de personas lo que resulta en una invisibilización del tráfico; y en tercer lugar, no llega a entender el tráfico como una problemática de derechos humanos para las personas migrantes

    This article proposes to analyze Peruvian regulations regarding migrant trafficking from a human rights perspective. Due to the multiple aspects of the issue and the obligations of International Law, the State has progressively adopted a set of norms to address this problem. This regulatory framework faces a series of challenges, firstly, it responds to a little-known reality, due to the lack of reliable data on traffic; secondly, it overlaps at every moment with human trafficking, which results in an invisibilization of trafficking; and thirdly, it fails to understand trafficking as a human rights problem for migrants

    The humanitarian, political, and socio-economic crisis in Venezuela has generated an unprecedented migration to other South American countries. In the last six years, Peru has become the second receptor of Venezuelan people after Colombia and the first regarding asylum seekers. In this article, we follow recent contributions regarding the concept of care circulation to ask: how the case of older Venezuelans on the move illustrates the multidimensionality of care circulation? How these care arrangements can be understood from an age and gender perspective? Through three life stories, we discuss how older Venezuelans on the move practice care for the benefit of the whole family based on family arrangements and negotiations and how, as a result, care circulates in multiple directions and can generate conflicts and power imbalance for the older ones
