Making the Impractical, Practical: A Modest and Overdue Approach to Reforming Fourth Amendment Consent Search Doctrine

At some point in your life, you may have a personal encounter with a police officer. During that moment, you may feel utterly powerless, especially if you do not know your rights. One important right that police are not required to inform people of is their right to deny an officer’s request to search their property. Forty-eight years ago, the Supreme Court made its position clear in Schneckloth v. Bustamonte that requiring law enforcement to provide citizens with this warning would be “thoroughly impractical.” Since then, the relationship between law enforcement and society—especially communities of color—has gradually deteriorated, and states have slowly turned away from Schneckloth’s rationale. As such, this Note revisits Schneckloth and takes a closer look at the inconsistencies within the Court’s current consent search doctrine. This Note also explores the Court’s problematic and unrealistic “totality of the circumstances” approach and the realities of consenting as a person of color. Ultimately, this Note proposes that all states adopt a modest approach to consent searches by requiring all police officers to provide warnings before requesting consent

Towards using NMR to screen for spoiled tomatoes stored in 1,000 L, aseptically sealed, metal-lined totes.

Nuclear magnetic resonance (NMR) spectroscopy is used to track factory relevant tomato paste spoilage. It was found that spoilage in tomato paste test samples leads to longer spin lattice relaxation times T1 using a conventional low magnetic field NMR system. The increase in T1 value for contaminated samples over a five day room temperature exposure period prompted the work to be extended to the study of industry standard, 1,000 L, non-ferrous, metal-lined totes. NMR signals and T1 values were recovered from a large format container with a single-sided NMR sensor. The results of this work suggest that a handheld NMR device can be used to study tomato paste spoilage in factory process environments

Relationship of Proportion Independent Commissioners on Company Risk and Management Risk Committee as a Moderation

The objective of this paper is looking for correlation of both proportion independent commissioners and presence of a risk management committee (RMC) which influences company risk. Company risk, proxy in trade accounts receivable and inventories. Accounts receivable and inventories have a possibility of errors in valuation, which can increase financial reporting risk. The samples used manufacturing industries, various industrial sectors; automotive sub-sectors ten numbers that listing on IDX or Indonesia Stock Exchange based on the outcome of purposive sampling for 3 years of research namely 2015-2017. The data taken from financial annual report and logistic regression analysis. The outcome of the logistic regression describes that portion of independent commissioners are significantly definite related to company risk. RMC variable is proven to strengthen the influence of relation both of proportions independent commissioners on company risk. The Berezin range of a bounded operator $T$ acting on a reproducing kernel Hilbert space $\mathcal{H}$ is the set $B(T)$ := $\{\langle T\hat{k}_{x},\hat{k}_{x} \rangle_{\mathcal{H}} : x \in X\}$, where $\hat{k}_{x}$ is the normalized reproducing kernel for $\mathcal{H}$ at $x \in X$. In general, the Berezin range of an operator is not convex. Primarily, we focus on characterizing the convexity of the Berezin range for a class of composition operators acting on the Fock space on $\mathbb{C}$ and the Dirichlet space of the unit disc $\mathbb{D}$. We prove an analogue of the elliptic range theorem for the unitarily equivalent Berezin range of an operator on a two-dimensional reproducing kernel Hilbert space and characterize the convexity of the unitarily equivalent Berezin range for a bounded operator $T$ on a reproducing kernel Hilbert space $\mathcal{H}$.Comment: 20 Page

Justifying the Concept of Fair Value as a Theory through International Financial Reporting Standard (IFRS)

The objective of the study is to justify the concept of fair value as a theory through International financial Reporting Standard (IFRS). This paper examined what effect would this newly adopted measurement of valuing assets and liabilities have on reported profit disclosed in the financial statement. Three theories that are of interest to this study, depreciation theory, asset theory and profitability theory were reviewed. The study used ex-post factor research design using data analysis of financial information extracted from audited financial statement for the  periods 2009 to 2011 (Pre-IFRS) and 2012 to 2014 (Post-IFRS) which was used to examine how independent variables affects dependent variables during N-GAAP and after adoption of IFRS. In order to arrive at conclusion data of twelve (12) companies in the consumers sector of the manufacturing industry quoted on the Nigerian Stock Exchange analyzed using multiple regression. Findings revealed that Pre-IFRS adoption strengthens the determinants of reported profits as compared to the reported profit during Post-IFRS. It is recommended that companies should be encouraged to use fair value accounting when preparing their financial report. In general, the Berezin range of an operator is not convex. In this paper, we discuss the convexity of range of the Berezin transforms. We characterize the convexity of the Berezin range for a class of composition operators acting on the Hardy space and the Bergman space of the unit disk. Also for so-called superquadratic functions, we prove the Berezin set mapping theorem for positive self-adjoint operators $A$ on the reproducing kernel Hilbert space $\mathcal{H}(\Omega)$, namely we prove that $f(\mathrm{Ber}(\Phi(A)))=\mathrm{Ber}(\Phi(f(A)))$, where $\Phi:\mathcal{B}\mathcal{\rightarrow}\mathcal{B}\left( \mathcal{K(}Q\mathcal{)}\right)$ is a normalized positive linear map.Comment: 21 pages, 8 figure
