    Voluntary Client Testimony as a Privilege Waiver: Is Ohio\u27s Law Caught in a Time Warp

    The question of whether Ohio should retain the waiver through voluntary testimony rule-assuming that is the current rule-is neither close nor difficult. The relevant statute dates back to the middle of the nineteenth century when Ohio enacted its first code of civil procedure, and if it in fact leads to a waiver, has been substantively unchanged in the intervening one hundred fifty plus years. The rule undermines the policies the attorney-client privilege was designed to further, and the policy on which the rule apparently was based-preventing perjured testimony-no longer has the primacy it did in the mid-nineteenth century and, in any event, is addressed in several other ways.Ohio\u27s General Assembly would be well advised, as described in the prior section, to repeal or revise Ohio Revised Code § 2317.02(A)(1) so as to clearly disavow a rule that the mere act of a client giving voluntary testimony waives the attorney-client privilege

    Influence of organic carbon and microorganisms on iron and sulfide concentrations in groundwater

    This study was undertaken to evaluate the feasibility of using a fluidized sand bed to coprecipitate the insoluble phosphorus complex of hydroxylapatite with calcium carbonate on the surface of sand grains to form dry chemical pebbles. It was found that the operation of such a new technique was simple and it required a contact time of only 5 min. At pH 10.0, the concentration of P in raw sewage was reduced from 8 mg/L to about 3 mg/L. Also, about 50-70 percent of calcium carbonate was able to plate out on the surface of sand grains. If the influent was allowed to settle for 1 hr, the residual P was further reduced to 1 mg/L, and most of the remaining suspended solids could settle out effectively.Project # B-077-MO Agreement # 14-31-0001-360

    Model Robust Calibration: Method and Application to Electronically-Scanned Pressure Transducers

    This article presents the application of a recently developed statistical regression method to the controlled instrument calibration problem. The statistical method of Model Robust Regression (MRR), developed by Mays, Birch, and Starnes, is shown to improve instrument calibration by reducing the reliance of the calibration on a predetermined parametric (e.g. polynomial, exponential, logarithmic) model. This is accomplished by allowing fits from the predetermined parametric model to be augmented by a certain portion of a fit to the residuals from the initial regression using a nonparametric (locally parametric) regression technique. The method is demonstrated for the absolute scale calibration of silicon-based pressure transducers

    This study departs from the phenomenon that the villages in the district governance Silimoindicated Yahukimo Papua Province has not been effective . This condition seems to be related to severalfactors inhibiting . Thus , this study aims to : ( 1 ) To determine the effectiveness of village governance ;and ( 2 ) . To determine the factors inhibiting the achievement of effective governance at the village SilimoDistrict Yahukimo .This study used a qualitative approach to the application of descriptive methods . Data andinformation gathered through interviews with 16 informants techniques , and equipped with observationand documentation , then analyzed by applying descriptive analysis techniques .Based on the analysis of data , it is known that : Implementation of the village administration .Particularly in Silimo District Yahukimo generally not effective . This condition can be seen from thereality of the interview in which the criteria for effectiveness penyelnggaraan village administration hasnot been implemented to the maximum .Thus , it can be concluded that there is some obstacle , namely : low accessibility factors , quantityand quality of human resources village government officials are inadequate , infrastructure andgovernment facilities were inadequate , and still strong patriarchal values that characterize the activity ofthe community , especially government officials village that gave birth to the paternalistic culture asinhibitors of achieving effectiveness village governanceTherefore , it is suggested that regional governments need to reform Yahukimo in several sectors , amongothers : land transportation network , infrastructure , equipment , facilities and budget supporting thedelivery of village governance , improving the quality and quantity of resources and village governmentofficials to build a culture system oriented achievement through religious guidance

    Factors Influencing Arthropod Diversity on Green Roofs

    Green roofs have potential for providing substantial habitat to plants, birds, and arthropod species that are not well supported by other urban habitats. Whereas the plants on a typical green roof are chosen and planted by people, the arthropods that colonize it can serve as an indicator of the ability of this novel habitat to support a diverse community of organisms. The goal of this observational study was to determine which physical characteristics of a roof or characteristics of its vegetation correlate with arthropod diversity on the roof. We intensively sampled the number of insect families on one roof with pitfall traps and also measured the soil arthropod species richness on six green roofs in the Boston, MA area. We found that the number of arthropod species in soil, and arthropod families in pitfall traps, was positively correlated with living vegetation cover. The number of arthropod species was not significantly correlated with plant diversity, green roof size, distance from the ground, or distance to the nearest vegetated habitat from the roof. Our results suggest that vegetation cover may be more important than vegetation diversity for roof arthropod diversity, at least for the first few years after establishment. Additionally, we found that even green roofs that are small and isolated can support a community of arthropods that include important functional groups of the soil food web
