    Victims' Access to Justice in Trinidad and Tobago: An exploratory study of experiences and challenges of accessing criminal justice in a post-colonial society

    This thesis investigates victims' access to justice in Trinidad and Tobago, using their own narratives. It seeks to capture how their experiences affected their identities as victims and citizens, alongside their perceptions of legitimacy regarding the criminal justice system. While there have been some reforms in the administration of criminal justice in Trinidad and Tobago, such reforms have not focused on victims' accessibility to the justice system. Using grounded theory methodology, qualitative data was collected through 31 in-depth interviews with victims and victim advocates. The analysis found that victims experienced interpersonal, structural, and systemic barriers at varying levels throughout the criminal justice system, which manifested as institutionalized secondary victimization, silencing and inequality. This thesis argues that such experiences not only served to appropriate conflict but demonstrates that access is often given in a very narrow sense. Furthermore, it shows a failure to encompass access to justice as appropriated conflicts are left to stagnate in the system as there is often very little resolution. Adopting a postcolonial lens to analyse victims' experiences, the analysis identified othering practices that served to institutionalize the vulnerability and powerlessness associated with victim identities. Here, it is argued that these othering practices also affected the rights consciousness of victims, delegitimating their identities as citizens. Moreover, as a result of their experiences, victims had mixed perceptions of the justice system. It is argued that while the system is a legitimate authority victims' endorsement of the system is questionable, therefore victims' experiences suggest that there is a reinforcement of the system's legal hegemony. The findings suggest that within the legal system of Trinidad and Tobago, legacies of colonialism shape the postcolonial present as the psychology and inequalities of the past are present in the interactions and processes of justice. These findings are relevant for policymakers in Trinidad and Tobago and other regions. From this study it is recognized that, to improve access to justice for victims, there needs to be a move towards victim empowerment that promotes resilience and enhances social capital. Going forward it is noted that there is a need for further research

    Lift EVERY Voice and Sing: An Intersectional Qualitative Study Examining the Experiences of Lesbian, Gay, Bisexual, and Queer Faculty and Administrators at Historically Black Colleges and Universities

    While there is minimal literature that address the experiences of lesbian, gay, bisexual, and trans* identified students at Historically Black Colleges and Universities (HBCUs), the experiences of Black, queer faculty and administrators at HBCUs has not been studied. This intersectional qualitative research study focused on the experiences of lesbian, gay, bisexual, and queer identified faculty and administrators who work at HBCUs. By investigating the intersections of religion, race, gender, and sexuality within a predominantly Black institution, this study aims to enhance diversity, equity, and inclusion efforts at HBCUs by sharing the experiences of the LGBQ faculty and administrators that previously or currently work at an HBCU as a full-time employee. The research questions that guided this study were 1) How have LGBQ faculty and staff negotiated/navigated their careers at HBCUs? and 2) How do LGBQ faculty and staff at HBCUs influence cultural (relating to LGBQ inclusion) change at the organizational level? The main theoretical framework used was intersectionality and it shaped the chosen methodology and methods. The Politics of Respectability was the second theoretical framework used to describe the intra-racial tensions within the Black/African American community. The study included 60-120 minute interviews with 12 participants. Using intersectionality as a guide, the data were coded and utilized for thematic analysis. Then, an ethnodramatic performance engages readers. The goals of this study were to encourage policy changes, promote inclusivity for LGBQ employees at HBCUs, and provide an expansion to the body of literature in the field pertaining to the experiences of LGBQ faculty and administrators in higher education

    Valores Públicos e Performance Financeira das Entidades Públicas: Proposta de Modelo de Análise na Perspetiva do Relato

Estes valores públicos, amplos, complexos e divergentes, devem integrar o modelo de governança democrática, suportar a tomada de decisão e servir de referência para a Administração Pública, na prossecução do interesse público. Tendo por base os modelos de governação pública, a Teoria do Valor Público e a Teoria do Interesse Público, bem como as dimensões dos valores públicos apontadas por stakeholders e influencers da informação financeira pública, procurou estudar-se de que forma os valores públicos, que materializam o interesse público, podem integrar na sua função de accountability, a avaliação e a análise da performance financeira na perspetiva da prestação de contas das entidades públicas. Nesse sentido, o estudo pretendeu identificar quais os valores públicos de natureza económica e financeira que interessam aos stakeholders e enquadrá-los num modelo estruturado de análise da financeira, que contribua para o reforço da performance accountability e transparência do relato financeiro público. A partir de uma estratégia de investigação mista, materializada na realização de entrevistas semiestruturadas e no ensaio aplicado sobre os dados financeiros do Município de Cascais, a investigação desenvolveu um modelo de análise e relato da performance financeira com vista a integrar a prestação de contas das entidades públicas, tendo como referência basilar não a ótica contabilística da estrutura e conteúdo das demonstrações financeiras, mas os «valores públicos» que consubstanciam o «interesse público». Conclui-se que este modelo favorece a adequação do relato financeiro público aos valores públicos, bem como representa um contributo para a normalização da avaliação da performance, reduzindo a discricionariedade do relato, melhorando o benchmarking financeiro e o robustecimento do sistema de avaliação do desempenho das entidades públicas previsto na Lei de Enquadramento Orçamental.The creation of public value, in which the Public Administration plays a key role, should translate the citizens' interest and be guided by a comprehensive set of public values. These public values, broad, complex and divergent, should integrate the democratic governance model, support decision-making, and serve as a reference for the Public Administration in the pursuit of public interest. Based on the models of public governance, the Public Interest Theory and the Theory of Public Values, as well as the dimensions of public values pointed out by stakeholders and influencers of public financial information, we sought to study how public values, which materialize public interest, can integrate into the function of accountability, the evaluation and analysis of financial performance from the perspective of accountability of public entities. In this sense, the study intended to identify which public values of economic and financial nature are of interest to the stakeholders and frame them in a structured model of financial performance analysis, which contributes to the strengthening of accountability and transparency of public financial reporting. Based on a mixed research strategy, materialized in semi-structured interviews and the test applied on the financial data of the Municipality of Cascais, the research developed a model of analysis and reporting of the financial performance to integrate the accountability of public entities. This was done having as an essential reference not the accounting perspective of the structure and content of the financial statements, but the "public values" that embody the "public interest". The conclusion is that this model favours the adequacy of public financial reporting to public values and represents a contribution to the standardization of performance evaluation, reducing the discretion of reporting, improving financial benchmarking, and strengthening the performance evaluation system of public entities foreseen in the Budgetary Framework Law.N/

Por lo tanto, el análisis de los factores básicos de los juegos se convierte en algo esencial a la hora de definir y utilizar la gamificación como estrategia de mediación del inglés como lengua extranjera para fortalecer rasgos específicos de pronunciación en los estudiantes de pregrado de la UPTC Sogamoso. El procedimiento de estudio se basa en la investigación acción mediante la implementación de la estrategia de gamificación para la mediación en la pronunciación del inglés, orientada a treinta estudiantes de diferentes programas de ingeniería, administración y tecnología con niveles heterogéneos de dominio del inglés. Las actividades se centran principalmente en la producción de sonidos, el ritmo, el acento y la entonación, los rasgos de pronunciación segmental y suprasegmental. Los resultados arrojaron una evidente mejora en las características segméntales y suprasegmentales de la percepción en la pronunciación de los participantes así como la contribución del objetivo de los juegos a la instrucción fonética y fonológica, la sensación en el juego a la motivación para mejorar la pronunciación, el reto establecido en los juegos a la actitud positiva de los participantes, y la sociabilidad a la exposición practica de la pronunciación inglesa.Gamification is a relatively new term that often denotes the use of game components in situations unrelated to the game itself to create enjoyable, fun, and motivating learning experiences for students (Werbach and Hunter, 2012). Therefore, analyzing the games' basic factors becomes essential when defining and using gamification as a strategy for English as Foreign Language mediation to strengthen specific pronunciation features in UPTC Sogamoso undergraduate students. The study procedure is based on action research by implementing the gamification strategy for mediation in English pronunciation, oriented to thirty students from different engineering, management, and technology programs at heterogeneous levels of English proficiency. The activities mainly focus on sound production, rhythm, stress, and intonation, segmental and suprasegmental pronunciation features. The results showed an evident improvement in the segmental and suprasegmental features of the participants' pronunciation perception as well as the contribution of game goals to phonetics and phonological instruction, the game sensation to the motivation for pronunciation improvement, the game challenge to the participants' positive attitude, and the sociality to the English pronunciation exposure practice

    TOWARDS AN UNDERSTANDING OF EFFORTFUL FUNDRAISING EXPERIENCES: USING INTERPRETATIVE PHENOMENOLOGICAL ANALYSIS IN FUNDRAISING RESEARCH

    Physical-activity oriented community fundraising has experienced an exponential growth in popularity over the past 15 years. The aim of this study was to explore the value of effortful fundraising experiences, from the point of view of participants, and explore the impact that these experiences have on people’s lives. This study used an IPA approach to interview 23 individuals, recognising the role of participants as proxy (nonprofessional) fundraisers for charitable organisations, and the unique organisation donor dynamic that this creates. It also bought together relevant psychological theory related to physical activity fundraising experiences (through a narrative literature review) and used primary interview data to substantiate these. Effortful fundraising experiences are examined in detail to understand their significance to participants, and how such experiences influence their connection with a charity or cause. This was done with an idiographic focus at first, before examining convergences and divergences across the sample. This study found that effortful fundraising experiences can have a profound positive impact upon community fundraisers in both the short and the long term. Additionally, it found that these experiences can be opportunities for charitable organisations to create lasting meaningful relationships with participants, and foster mutually beneficial lifetime relationships with them. Further research is needed to test specific psychological theory in this context, including self-esteem theory, self determination theory, and the martyrdom effect (among others)

    The crisis of cultural authority in museums : contesting human remains in the collections of Britain

    Museums in Britain have displayed and researched human remains since the eighteenth century. However, in the last two decades human remains in collections have become subject to claims and controversies. Firstly, human remains associated with acquisition during the colonial period have become increasingly difficult to retain and have been transfered to culturally affiliated overseas indigenous groups. Secondly, a group of British Pagans have formed to make claims on ancient human remains in collections. Thirdly, human remains that are not requested by any community group, and of all ages, have become the focus of concerns expressed about their treatment by members of the profession. A discourse arguing for 'respect' has emerged, which argues that all human remains should be treated with new care. The claims made on human remains have been vigourously but differentially contested by members of the sector, who consider the human remains to be unique research objects. This thesis charts the influences at play on the contestation over human remains and examines its construction. The academic literature tends to understand changes to museums as a result of external factors. This thesis argues that this problem is influenced by a crisis of legitimacy and establishes that there are strong internal influences. Through a weak social constructionist approach I demonstrate that the issue has been promoted by influential members of the sector as part of a broader attempt to distance themselves from their foundational role, as a consequence of a crisis of cultural authority stimulated by external and internal factors. The symbolic character of human remains in locating this problem is informed by the unique properties of dead bodies and is influenced by the significance of the body as a scientific object; its association with identity work and as a site of political struggle, in the high modem period

    A productive response to legacy system petrification

    Requirements change. The requirements of a legacy information system change, often in unanticipated ways, and at a more rapid pace than the rate at which the information system itself can be evolved to support them. The capabilities of a legacy system progressively fall further and further behind their evolving requirements, in a degrading process termed petrification. As systems petrify, they deliver diminishing business value, hamper business effectiveness, and drain organisational resources. To address legacy systems, the first challenge is to understand how to shed their resistance to tracking requirements change. The second challenge is to ensure that a newly adaptable system never again petrifies into a change resistant legacy system. This thesis addresses both challenges. The approach outlined herein is underpinned by an agile migration process - termed Productive Migration - that homes in upon the specific causes of petrification within each particular legacy system and provides guidance upon how to address them. That guidance comes in part from a personalised catalogue of petrifying patterns, which capture recurring themes underlying petrification. These steer us to the problems actually present in a given legacy system, and lead us to suitable antidote productive patterns via which we can deal with those problems one by one. To prevent newly adaptable systems from again degrading into legacy systems, we appeal to a follow-on process, termed Productive Evolution, which embraces and keeps pace with change rather than resisting and falling behind it. Productive Evolution teaches us to be vigilant against signs of system petrification and helps us to nip them in the bud. The aim is to nurture systems that remain supportive of the business, that are adaptable in step with ongoing requirements change, and that continue to retain their value as significant business assets

    Theorising Christian Anarchism A Political Commentary on the Gospel

    This thesis argues that there is a tradition in political theology and in political theory that deserves to be called "Christian anarchism." The various thinkers that contribute to this tradition have never before been considered to be part of a theoretical movement or tradition, and the originality of this thesis is to weave these thinkers together and present a generic theory of Christian anarchism. . Taken together, thinkers like Tolstoy, Ellul, Elliott and Andrews put forward a comprehensive exegesis of Jesus' teaching and example as implying a critique of the state and a vision of a stateless society. Based on this understanding of the Gospel, they accuse both the state and the church of contradicting, betraying and corrupting the essence of Christianity. Some Christian anarchists - Eller in particular - even see Romans 13 and the "render unto Caesar" passage as not discrediting but indeed confirming their interpretation, and although more activist Christian anarchists sometimes disagree on the potential role of civil disobedience, they do all stress that what matters above all is obedience to God Moreover, they all call for the "true" church to lead the Christian anarchist revolution by example, despite the very demanding sacrifices which this involves. They point to numerous examples of similar witness ever since the early church, and themselves strive to emulate such examples in their own lives - the Catholic Worker movement being perhaps the most notable example in this regard Thus, Christian anarchist thinkers' critique of the current order and appeal to follow God's radical commandments echoes the voices of the prophets of old, calling society to return to God's covenant. By weaving their scattered voices together - by theorising Christian anarchism - this thesis provides a political commentary on the Gospel which contributes as much to political theory as it does to political theology
