    Surveillance, big data and democracy: lessons for Australia from the US and UK

    This article argues that current laws are ill-equipped to deal with the multifaceted threats to individual privacy by governments, corporations and our own need to participate in the information society. Introduction In the era of big data, where people find themselves surveilled in ever more finely granulated aspects of their lives, and where the data profiles built from an accumulation of data gathered about themselves and others are used to predict as well as shape their behaviours, the question of privacy protection arises constantly. In this article we interrogate whether the discourse of privacy is sufficient to address this new paradigm of information flow and control. What we confront in this area is a set of practices concerning the collection, aggregation, sharing, interrogation and uses of data on a scale that crosses private and public boundaries, jurisdictional boundaries, and importantly, the boundaries between reality and simulation. The consequences of these practices are emerging as sometimes useful and sometimes damaging to governments, citizens and commercial organisations. Understanding how to regulate this sphere of activity to address the harms, to create an infrastructure of accountability, and to bring more transparency to the practices mentioned, is a challenge of some complexity. Using privacy frameworks may not provide the solutions or protections that ultimately are being sought. This article is concerned with data gathering and surveillance practices, by business and government, and the implications for individual privacy in the face of widespread collection and use of big data. We will firstly outline the practices around data and the issues that arise from such practices. We then consider how courts in the United Kingdom (‘UK’) and the United States (‘US’) are attempting to frame these issues using current legal frameworks, and finish by considering the Australian context. Notably the discourse around privacy protection differs significantly across these jurisdictions, encompassing elements of constitutional rights and freedoms, specific legislative schemes, data protection, anti-terrorist and criminal laws, tort and equity. This lack of a common understanding of what is or what should be encompassed within privacy makes it a very fragile creature indeed. On the basis of the exploration of these issues, we conclude that current laws are ill-equipped to deal with the multifaceted threats to individual privacy by governments, corporations and our own need to participate in the information society

    The ontological revolution: On the phenomenology of the internet

    Cogitation described as calculation, the living being described as a machine, cognitive functions considered as algorithmic sequences and the ‘mechanization’ of the subjective were the theoretical elements that late heideggerian anti–humanism, especially in France was able to utilize[1], even more so, after the second cybernetics or post-cybernetics movement of the late ‘60s introduced the concepts of the autopoietic and the allopoietic automata[2]. Recently, neurologists pose claims on the traditional epistemological field of philosophy, proceeding from this ontological decision, the equation of human cognition to cybernetic systems. The emergence of the world-wide-web in the 1990s and the global expansion of the internet during the first decades of the 21st century indicate the fallacies of the cybernetics programme to mechanize the mind. We stand witnesses to a semantic colonization of the cybernetic system, a social imaginary creation and expansion within the digital ensemblistic – identitarian organization that cannot be described by mechanical or cybernetic terms. Paradoxically, cyberspace, as a new being, a form of alterity, seems to both exacerbate and capsize the polarization between the operational and the symbolic. The creation of the internet might be more than an epistemological revolution, to use the terminology of Thomas Kuhn. It might be an ontological revolution. I will try to demonstrate that the emergence of the Internet refutes any such claims, since its context and utility can only be described by means of a social epistemology based on the understanding of social significances as continuous creations of an anonymous social imaginary proposed by Cornelius Castoriadis (1922-1997). I will try to explore some social-semantic aspects of the cyberspace as a nexus of social representations of the individual identity that forms a new sphere of being, where the subjective and the objective merge in a virtual subjective objectivity with unique epistemological attributes and possibilities

    Graffiti Networks: A Subversive, Internet-Scale File Sharing Model

    The proliferation of peer-to-peer (P2P) file sharing protocols is due to their efficient and scalable methods for data dissemination to numerous users. But many of these networks have no provisions to provide users with long term access to files after the initial interest has diminished, nor are they able to guarantee protection for users from malicious clients that wish to implicate them in incriminating activities. As such, users may turn to supplementary measures for storing and transferring data in P2P systems. We present a new file sharing paradigm, called a Graffiti Network, which allows peers to harness the potentially unlimited storage of the Internet as a third-party intermediary. Our key contributions in this paper are (1) an overview of a distributed system based on this new threat model and (2) a measurement of its viability through a one-year deployment study using a popular web-publishing platform. The results of this experiment motivate a discussion about the challenges of mitigating this type of file sharing in a hostile network environment and how web site operators can protect their resources

    Dark clouds on the horizon:the challenge of cloud forensics

    We introduce the challenges to digital forensics introduced by the advent and adoption of technologies, such as encryption, secure networking, secure processors and anonymous routing. All potentially render current approaches to digital forensic investigation unusable. We explain how the Cloud, due to its global distribution and multi-jurisdictional nature, exacerbates these challenges. The latest developments in the computing milieu threaten a complete “evidence blackout” with severe implications for the detection, investigation and prosecution of cybercrime. In this paper, we review the current landscape of cloud-based forensics investigations. We posit a number of potential solutions. Cloud forensic difficulties can only be addressed if we acknowledge its socio-technological nature, and design solutions that address both human and technological dimensions. No firm conclusion is drawn; rather the objective is to present a position paper, which will stimulate debate in the area and move the discipline of digital cloud forensics forward. Thus, the paper concludes with an invitation to further informed debate on this issue

    From Sensor to Observation Web with Environmental Enablers in the Future Internet

    This paper outlines the grand challenges in global sustainability research and the objectives of the FP7 Future Internet PPP program within the Digital Agenda for Europe. Large user communities are generating significant amounts of valuable environmental observations at local and regional scales using the devices and services of the Future Internet. These communities’ environmental observations represent a wealth of information which is currently hardly used or used only in isolation and therefore in need of integration with other information sources. Indeed, this very integration will lead to a paradigm shift from a mere Sensor Web to an Observation Web with semantically enriched content emanating from sensors, environmental simulations and citizens. The paper also describes the research challenges to realize the Observation Web and the associated environmental enablers for the Future Internet. Such an environmental enabler could for instance be an electronic sensing device, a web-service application, or even a social networking group affording or facilitating the capability of the Future Internet applications to consume, produce, and use environmental observations in cross-domain applications. The term ?envirofied? Future Internet is coined to describe this overall target that forms a cornerstone of work in the Environmental Usage Area within the Future Internet PPP program. Relevant trends described in the paper are the usage of ubiquitous sensors (anywhere), the provision and generation of information by citizens, and the convergence of real and virtual realities to convey understanding of environmental observations. The paper addresses the technical challenges in the Environmental Usage Area and the need for designing multi-style service oriented architecture. Key topics are the mapping of requirements to capabilities, providing scalability and robustness with implementing context aware information retrieval. Another essential research topic is handling data fusion and model based computation, and the related propagation of information uncertainty. Approaches to security, standardization and harmonization, all essential for sustainable solutions, are summarized from the perspective of the Environmental Usage Area. The paper concludes with an overview of emerging, high impact applications in the environmental areas concerning land ecosystems (biodiversity), air quality (atmospheric conditions) and water ecosystems (marine asset management)
