    Exercising Abilities

    Get PDF
According to one prominent view of exercising abilities (e.g., Millar 2009), a subject, S, counts as exercising an ability to ϕ if and only if S successfully ϕs. Such an ‘exercise-success’ thesis looks initially very plausible for abilities, perhaps even obviously or analytically true. In this paper, however, I will be defending the position that one can in fact exercise an ability to do one thing by doing some entirely distinct thing, and in doing so I’ll highlight various reasons (epistemological, metaphysical and linguistic) that favor the alternative approach I develop over views that hold that the exercise of an ability is a success notion in the sense Millar maintains

The Brutal Murder of George J. Bushman

In the fall of 1918 there occurred in Adams County a singularly brutal murder that brought the County and the town of Gettysburg to a shocked standstill. The tentacles of this event would reach into four Pennsylvania counties: Adams, Cumberland, Dauphin, and Philadelphia, and eventually the Pennsylvania Supreme Court. The investigation of the crime and the trial of the perpetrators involved so many public officials and families, as well as the extended judicial system and geographical locations within and without the County, that we have included a Cast of Characters and Locations to assist the reader in following this convoluted tale

Government Speech and the War on Terror

    Get PDF
This Article examines how the government’s speech in the War on Terror can threaten free speech, equal protection, and due process values. It focuses primarily on the constitutional harms threatened by the government’s speech itself (what some call a form of “soft law”), rather than on situations in which the government’s speech may be evidence of a constitutionally impermissible motive for its “hard law” actions

Mapping the information-coping trajectory of young people coping with long term illness: An evidence based approach

    Get PDF
Purpose - Purpose: We explore the relationship between information and coping information from the experiences of young people coping with long term illness. Design/methodology/approach - Methodology: Situational Analysis was used as a methodological approach. It has roots in the Chicago Symbolic Interactionism School. Cartographic approaches enabled the analysis, mapping the complexities emerging from the data. Findings - Findings: As the young people became more informed about their health conditions, and gained knowledge and understanding both about their illnesses, their own bodies and boundaries, their confidence and capacity to cope increased. Gaining confidence, the young people often wanted to share their knowledge becoming information providers themselves. From the data we identified five positions on an information-coping trajectory (1) Information deficiency (2) Feeling ill-informed (3) Needing an injection of information (4) Having information health and (5) Becoming an information donor. Research limitations/implications - Research limitations/implications: The research was limited to an analysis of thirty narratives. The research contributes to information theory by mapping clearly the relationship between information and coping. Originality/value - Originality/value: The information theories in this study have originality and multi-disciplinary value in the management of health and illness, and information studies

As educational technology has improved, the effective use of simulations has greatly increased to the point where simulations should be considered a valuable, mainstream pedagogical tool. Simulations, in concert with other experiential teaching tools, allow lecturers to facilitate learning more effectively. Simulation is all about representing the real world which includes grasping the complex issues and solving intricate problems and it affects students employability rate in a way of preparing the students base on the market needs. This paper will looked into simulation content development which is all about developing, enriching and the applications of internet protocols in order to enrich the work-related competencies experience among graduate in the field of logistics and transportations and will focus on the real challenges inputs to the generic workflow of the simulation content development. The study was carried out within multi-national and local manufacturing companies, third party companies (3PL) and government agency which are selected from Peninsular Malaysia. A qualitative approach was mainly conducted to gather data in the study. It was then discovered from the study that the systems used in process of outbound and inbound are System Application Products (SAP) and Material Requirement Planning (MRP). It was further discovered that there are only four companies using Enterprises Resources Planning (ERP) and Electronic Data Interchange (EDI) as part of the Suppliers Own Inventories (SOI) networking as a result of globalized business between one country to another. It was further shown that the resources involved in the outbound and inbound processes are computerized documentation i.e. email, telephones and fax well trained staff handling the processes in computer system and dealing with suppliers and customers. The study contributes to the body of knowledge on the enrichment of the students employability. It also provided practical recommendations in the area of training for the organizations and curriculum adapting and development for the universities

Woke Pedagogy: A Framework for Teaching and Learning

    Get PDF
The sociopolitical context of schooling demands that teachers acknowledge the ways their students’ and their own experiences are shaped by the intersections of racism, classism, sexism, heterosexism, and other discriminatory factors. This is especially true during times of heightened civil unrest resulting from pervasive and persistent injustice experienced by minoritized populations. To engage students in pedagogy that connects with their lived experiences and that equips them to critically examine inequities, teachers must refute colorblind pedagogy in favor of woke pedagogy. Woke pedagogy, like critical multicultural education, is defined by teaching practices that integrate critiques of contemporary justice-related issues with academic content in a learning environment that encourages introspection, interrogation, and insurgence. This theoretical framework for woke pedagogy outlines a wide range of knowledge, skills, and dispositions that equip teachers to promote critical thinking about complex issues—in other words, to be woke pedagogues. Grounded in Black feminist ideology, woke pedagogy distinguishes itself from critical multicultural education in important ways: 1) both teachers and students view their lived experiences as sources of knowledge and tools for knowledge creation, 2) teachers and students analyze injustice from an intersectional perspective, and 3) teachers exhibit activist care. This conceptual treatise includes suggestions for empirical research studies that will yield results that are crucial to the effective practice of woke pedagogy, a 21stcentury approach to critical multicultural education

True Believers at Law: National Security Agendas, the Regulation of Lawyers, and the Separation of Powers

Ideological agendas distort the deliberation required for sound legal advice about national security. Elite government lawyers after September 11 advanced a theory at the expense of context, labeling legal constraints as lawfare against American interests. The lawfare critics failed to recognize that legal constraints can empower decision makers by reinforcing reputational and other long-term values. They also failed their history test, ignoring the lessons of presidents from Jefferson to Kennedy who rejected a rigid adherence to ideology in the national security realm. By discounting context, the construction of the lawfare paradigm produced dire results, including the torture memos drafted by the Justice Department\u27s Office of Legal Counsel ( OLC ) and the destruction of CIA interrogation tapes. Unfortunately, this elevation of ideology over context has failed to yield adequate remedies. Tort litigation, exemplified by Jose Padilla\u27s recent lawsuit against former OLC attorney John Yoo, risks personalizing the problem and neglecting systemic issues. The informal norms approach suggested by a number of OLC alumni, while offering a number of excellent proposals such as citing and distinguishing adverse authority, has not attracted stakeholders across the political spectrum. A structural reform approach that replaces OLC with an adjudicative entity may produce an inquisitorial tribunal that lacks sharp adversarial inputs and loses influence to more pliable players such as White House counsel. To transcend these difficulties, lawyers should turn to a model of dialogic equipoise relying on two values: transparency and tailoring. Dialogic equipoise allows the President to take action that is consistent with the most accurate reading of sources of authority. Action, however, must be both interstitial-with a clear exit strategy and publicly disclosed. To implement the dialogic equipoise model, this Article recommends an integrated approach, including a safe harbor for publicly disclosed legal opinions, consideration of institutional consequences, assertion of the least drastic rationale for executive power, and an ex ante role for Inspectors General and the OLC in document preservation. This blended regime can counter ideology\u27s corrosive influence on legal deliberation about war, peace, and national security
