    Who Owns the Virtual Items?

    Do you WoW? Because millions of people around the world do! Due to this increased traffic, virtual wealth amassed in MMORPGs are intersecting in our real world in unexpected ways. Virtual goods have real-life values and are traded in real-life markets. However, the market for trading in virtual items is highly inefficient because society has not created property rights for virtual items. This lack of regulation has a detrimental effect not just the market for virtual items, but actually the market for MMORPGs. Assuming we want to promote the production of MMORPGs as a market, society requires a set of distinct property rules to decrease the inefficiencies in the virtual market. In creating these regulation, we may be able to take cues from intellectual property laws, as many of the problems surrounding virtual goods are akin to intellectual property

    In today’s economy, consumers demand experiences. From Star Wars to Harry Potter, fans do not just want to watch or read about their favorite characters— they want to be them. They don the robes of Gryffindor, flick their wands, and drink the butterbeer. The owners of fantasy properties understand this, expanding their offerings from light sabers to the Galaxy’s Edge¼, the new Disney Star Wars immersive theme park opening in 2019. Since Star Wars, Congress and the courts have abetted what is now a $262 billion-a-year industry in merchandising, fashioning “merchandising rights” appurtenant to copyrights and trademarks that give fantasy owners exclusive rights to supply our fantasy worlds with everything from goods to a good time. But are there any limits? Do merchandising rights extend to fan activity, from fantasy-themed birthday parties and summer camps to real world Quidditch leagues? This Article challenges the conventional account, arguing that as the economic value of fantasy merchandising increases in the emergent “experience economy,” intellectual property owners may prove less keen on tolerating uncompensated uses of their creations. In fact, from Amazon’s Kindle Worlds granting licenses for fan fiction, to crackdowns on sales of fan art sold on internet sites like Etsy, to algorithms taking down fan videos from YouTube, the holders of intellectual property in popular fantasies are seeking to create a world requiring licenses to make, do, and play. This Article turns to social and cultural theories of art as experience, learning by doing, tacit knowledge, and performance to demonstrate that fan activity, from discussion sites to live-action role-playing fosters learning, creativity, and sociability. Law must be attentive to the profound effects these laws have on human imagination and knowledge creation. I apply the insights of these theories to limit merchandising rights in imaginative play through fair use, the force in the legal galaxy intended to bring balance to intellectual property law

    How does risk mediate the ability of adolescents and adults with intellectual and developmental disabilities to live a normal life by using the Internet?

    The focus of this position paper is Internet use by adolescents and adults with intellectual and developmental disabilities. Drawing on existing literature in the field we will identify problems with and gaps in the current research. Our review is framed by three main questions: What constitutes a ‘normal’ life for adolescents and adults with intellectual and developmental disabilities? What constitutes ‘normal’ use of the Internet for adolescents and adults with intellectual and developmental disabilities? How does risk mediate the ability of adolescents and adults with intellectual and developmental disabilities to live a normal life by using the Internet? The key focus of this review is the complex relationship between adolescents and adults with intellectual and developmental disabilities and those providing support; how they negotiate access to and use of the Internet and how perceptions regarding risk and normalcy mediate this negotiation. As a result of this review will argue that identified gaps and problems in the research field need to be addressed by expanding both methodological and conceptual approaches. In particular we will propose the need for more in-depth qualitative research that is inclusive in nature. We will also propose that an adapted positive risk-taking framework might be useful in framing the design, implementation and analysis of future research

    Julie Cohen\u27s Configuring the Networked Self is an extraordinarily insightful book. Cohen not only applies extant theory to law; she also distills it into her own distinctive social theory of the information age. Thus, even relatively short sections of chapters of her book often merit article-length close readings. I here offer a brief for the practical importance of Cohen’s theory, and ways it should influence intellectual property policy and scholarship

    ‘And if I don’t want to work like an artist...?’ How the study of artistic resistance enriches organizational studies

    An increasing number of artists, from theatre makers to painters, critique recent aesthetic developments in organizational life.* One of their topics is the relation between work and freedom, as employees, like artists, are required to bring fully into work their subjectivity and emotional motivation. This paper presents several contemporary examples and a case of the theatre maker Renïżœ Pollesch whose plays show the dark side of these role models, leaving the audience to draw its own, bitter conclusions. It is proposed in this paper that organizational studies should consider these forms of ?artistic resistance? more systematically. Artistic resistance goes beyond extant critical intellectual approaches to organization studies: Its presentational form provides an aesthetic experience, and conveys both embodied and tacit forms of knowing in fuller, richer and stimulating ways. The paper discusses implications for organizational theory building (for example with regard to work models and the use of arts for organizational development), and research methods (scholarly applications of arts-based methods for the generation and presentation of research findings)

    Taking great pains: critical theory, affective pedagogies and radical democracy

    The consolidation of neoliberal capitalism over the past decade has been intense, as has the articulation of critical and creative responses to it. One of the most remarkable is the turn towards forms of political resistance that seek liberation from the logics of state and capital while – or through – simultaneously creating alternative, radically democratic modes of existence. Many of these draw on anarchistic and autonomist traditions of critical theory which assert the possibility of prefiguring alternative political projects as well as critiquing existing ones, thus appearing to transcend what Herbert Marcuse described as a ‘vicious circle’ of liberation (1964, 1967). We have thus seen a proliferation of work on problems of prefigurative politics, autonomy, co-operation and self-valorisation; significantly, there is renewed attention to pedagogy in critical theory and as a political practice. However, there is still little attention to the affective and social labour that this type of prefigurative theory and practice requires, or to the systemic critique of the conditions of possibility for it to constitute a challenge to neoliberalism. My concern is that these lacunae can lead to misinterpretations of the meaning of radical democracy and of its possibilities and limitations as a challenge to the logics of neoliberal capitalism and other forms of dehumanising power. In this paper, I draw on work with British-based cultural workers who are active in radical-democratic projects to illustrate how bringing practical work into conversation with critical theories of political subjectivity, on the one hand, and theories of affective pedagogy and politics, on the other, can contribute to strengthening both theories and practices of radical democracy

    Las Vegas and Houston: Global Command Centers in the Sun Belt

    Apart from their notoriously hot summers, Las Vegas, Nevada and Houston, Texas appear to have little in common. Upon further scrutiny, however, the two cities have followed strikingly parallel trajectories. As a hub of commercial gaming today, Las Vegas faces challenges comparable to the obstacles Houston encountered in the 1970s and 1980s as a hub of oil and energy. The story of Houston since this downtime reflects a stunning transformation into a modern-day international city, and one that both parallels and portends a new Las Vegas. In this article, we argue that Houston provides a viable model for Las Vegas as a “global command center” of a major international industry – and that in many ways Las Vegas is already following this path
