    Negotiated rulemaking appears by most accounts to have come of age. A procedure that once seemed confined to discussion among administrative law scholars has in the past decade captured the attention of policymakers throughout the nation\u27s capital. Congress officially endorsed regulatory negotiation in the Negotiated Rulemaking Act of 1990, and it permanently reauthorized the Act in 1996. Over the past few years, the executive branch has visibly supported regulatory negotiation, both through the Clinton administration\u27s National Performance Review (NPR) and through specific presidential directives to agency heads. Congress has also begun to mandate the use of negotiated rulemaking by certain agencies in the development of specific regulations. As a result of these and other efforts, federal agencies have begun to employ the consensus-based process known as negotiated rulemaking

    Satisfaction not Guaranteed - Institutions and Satisfaction with Democracy in Western Europe

    What determines citizens’ satisfaction with the “constitution in operation”? We make two contributions towards an answer to this important policy question. First, we place stronger emphasis than existing studies on quantitative interpretations of the importance of different factors. We use scenario analysis to show that a consensual system generally promotes satisfaction, but affects different types of citizens differently. Second, we focus on informal institutions and rules of the game in European societies. Corporatism and group membership as a measure of social capital are good for satisfaction, and people who live in countries with a high degree of income inequality tend to be less satisfied.     Expert consensus for respiratory physiotherapy management of mechanically ventilated adults with community-acquired pneumonia: A Delphi study

    Rationale and aims: Patients with community‐acquired pneumonia (CAP) are frequently admitted to an intensive care unit. Physiotherapy may be provided to optimize respiratory function; however, there is significant variability in clinical practice and limited research directing best practice for this cohort. This study aimed to determine expert consensus for best physiotherapy practice for invasively ventilated adults with CAP. Method: A modified Delphi technique involved an international expert panel completing three rounds of an online questionnaire. The initial 35‐statement questionnaire, based on a systematic literature review and survey of current clinical practice, covered physiotherapy assessment and treatment of intubated patients with CAP. Quantitative data using Likert scales determined level of agreement, with qualitative data collected through open‐ended responses. Consensus threshold was set a priori at 70%. Items not achieving consensus were modified and new items added based on themes from qualitative data. Quantitative data were analysed descriptively, with thematic analysis used on qualitative data. Results: The panel comprised 29 international clinical and academic experts in critical care physiotherapy. Response rate was more than 95% for each round. Outcome achieved was 38 consensus statements covering assessment and treatment, with 28 statements (74%) providing consensus on recommended clinical practice, two consensus disagreement statements (7%) for what practice is not recommended, and eight statements (21%) indicating which treatments may be beneficial. Conclusion: Expert consensus regarding physiotherapy for intubated adults with CAP patients provides an evidence‐based approach to guide clinical practice. The consensus statements can also be used to guide research evaluating physiotherapy interventions for patients with CAP

    Agenda Control in the Bundestag, 1980-2002

    We ïŹnd strong evidence of monopoly legislative agenda control by government parties in the Bundestag. First, the government parties have near-zero roll rates, while the opposition parties are often rolled over half the time. Second, only opposition parties’ (and not government parties’) roll rates increase with the distances of each party from the ïŹ‚oor median. Third, almost all policy moves are towards the government coalition (the only exceptions occur during periods of divided government). Fourth, roll rates for government parties sky- rocket when they fall into the opposition and roll rates for opposition parties plummet when they enter government, while policy movements go from being nearly 100 per cent rightward when there is a rightist government to 100 per cent leftward under a leftist government

    Consensus Strategies for Signed Profiles on Graphs

    The median problem is a classical problem in Location Theory: one searches for a location that minimizes the average distance to the sites of the clients. This is for desired facilities as a distribution center for a set of warehouses. More recently, for obnoxious facilities, the antimedian was studied. Here one maximizes the average distance to the clients. In this paper the mixed case is studied. Clients are represented by a profile, which is a sequence of vertices with repetitions allowed. In a signed profile each element is provided with a sign from {+,-}. Thus one can take into account whether the client prefers the facility (with a + sign) or rejects it (with a - sign). The graphs for which all median sets, or all antimedian sets, are connected are characterized. Various consensus strategies for signed profiles are studied, amongst which Majority, Plurality and Scarcity. Hypercubes are the only graphs on which Majority produces the median set for all signed profiles.
