    Historically, law and government regulation have established default rules for information policy, including constitutional rules on freedom of expression and statutory rights of ownership of information. This Article will show that for network environments and the Information Society, however, law and government regulation are not the only source of rule-making. Technological capabilities and system design choices impose rules on participants. The creation and implementation of information policy are embedded in network designs and standards as well as in system configurations. Even user preferences and technical choices create overarching, local default rules. This Article argues, in essence, that the set of rules for information flows imposed by technology and communication networks form a “Lex Informatica” that policymakers must understand, consciously recognize, and encourage

    Marketing education, distance learning and hypermedia: teaching current issues in marketing in a virtual campus

    This article reports on a project at the Universitat Oberta de Catalunya (UOC: The Open University of Catalonia, Barcelona) to develop an innovative package of hypermedia-based learning materials for a new course entitled 'Current Issues in Marketing'. The UOC is a distance university entirely based on a virtual campus. The learning materials project was undertaken in order to benefit from the advantages which new communication technologies offer to the teaching of marketing in distance education. The article reviews the main issues involved in incorporating new technologies in learning materials, the development of the learning materials, and their functioning within the hypermedia based virtual campus of the UOC. An empirical study is then carried out in order to evaluate the attitudes of students to the project. Finally, suggestions for improving similar projects in the future are put forward.Aquest article informa sobre un projecte de la Universitat Oberta de Catalunya per a desenvolupar un paquet innovador de materials didàctics hipermèdia basat en un nou curs titulat "Qüestions Actuals de Màrqueting". La UOC és una universitat a distància es basa íntegrament en un campus virtual. El projecte es va dur a terme els materials d'aprenentatge per tal de beneficiar-se dels avantatges que ofereixen les noves tecnologies de comunicació a l'ensenyament del màrqueting en l'educació a distància. L'article repassa els principals temes implicats en la incorporació de noves tecnologies en materials d'aprenentatge, el desenvolupament dels materials d'aprenentatge, i el seu funcionament dins del hipermèdia basat en el campus virtual de la UOC. Després s'ha portat a terme un estudi empíric per a avaluar les actituds dels estudiants del projecte.     Time for Cloud? Design and implementation of a time-based cloud resource management system

    The current pay-per-use model adopted by public cloud service providers has influenced the perception on how a cloud should provide its resources to end-users, i.e. on-demand and access to an unlimited amount of resources. However, not all clouds are equal. While such provisioning models work for well-endowed public clouds, they may not always work well in private clouds with limited budget and resources such as research and education clouds. Private clouds also stand to be impacted greatly by issues such as user resource hogging and the misuse of resources for nefarious activities. These problems are usually caused by challenges such as (1) limited physical servers/ budget, (2) growing number of users and (3) the inability to gracefully and automatically relinquish resources from inactive users. Currently, cloud resource management frameworks used for private cloud setups, such as OpenStack and CloudStack, only uses the pay-per-use model as the basis when provisioning resources to users. In this paper, we propose OpenStack Café, a novel methodology adopting the concepts of 'time' and booking systems' to manage resources of private clouds. By allowing users to book resources over specific time-slots, our proposed solution can efficiently and automatically help administrators manage users' access to resource, addressing the issue of resource hogging and gracefully relinquish resources back to the pool in resource-constrained private cloud setups. Work is currently in progress to adopt Café into OpenStack as a feature, and results of our prototype show promises. We also present some insights to lessons learnt during the design and implementation of our proposed methodology in this paper

    This Article follows on the heels of an article I recently wrote that focuses on the online advertising activities of The Gator Corporation and legal implications of the preliminary injunction issued in that case.4 I previously concluded that Gator’s pop-up advertising scheme did not violate copyright law,5 but that it did violate trademark law, based in large on survey results showing significant consumer confusion at that point in time.6 To remove consumer confusion, I recommended that Gator: (1) notify Internet users more prominently about downloading Gator software; (2) remind consumers that they authorized pop-up ads to appear; (3) adequately display its trademarks in its pop-up ads; and (4) disclaim affiliation with URLs that have not authorized its ads.

    Intellectual property rights (IPR) have been created as economic mechanisms to facilitate ongoing innovation by granting inventors a temporary monopoly in return for disclosure of technical know-how. Since the beginning of 1980s, IPR have come under scrutiny as new technological paradigms appeared with the emergence of knowledge-based industries. Knowledge-based products are intangible, non-excludable and non-rivalrous goods. Consequently, it is difficult for their creators to control their dissemination and use. In particular, many information goods are based on network externalities and on the creation of market standards. At the same time, information technologies are generic in the sense of being useful in many places in the economy. Hence, policy makers often define current IPR regimes in the context of new technologies as both over- and under-protective. They are over-protective in the sense that they prevent the dissemination of information which has a very high social value; they are under-protective in the sense that they do not provide strong control over the appropriation of rents from their invention and thus may not provide strong incentives to innovate. During the 1980s, attempts to assess the role of IPR in the process of technological learning have found that even though firms in high-tech sectors do use patents as part of their strategy for intellectual property protection, the reliance of these sectors on patents as an information source for innovation is lower than in traditional industries. Intellectual property rights are based mainly on patents for technical inventions and on copyrights for artistic works. Patents are granted only if inventions display minimal levels of utility, novelty and non-obviousness of technical know-how. By contrast, copyrights protect only final works and their derivatives, but guarantee protection for longer periods, according to the Berne Convention. Licensing is a legal aid that allows the use of patented technology by other firms, in return for royalty fees paid to the inventor. Licensing can be contracted on an exclusive or non-exclusive basis, but in most countries patented knowledge can be exclusively held by its inventors, as legal provisions for compulsory licensing of technologies do not exist. The fair use doctrine aims to prevent formation of perfect monopolies over technological fields and copyrighted artefacts as a result of IPR application. Hence, the use of patented and copyrighted works is permissible in academic research, education and the development of technologies that are complimentary to core technologies. Trade secrecy is meant to prevent inadvertent technology transfer to rival firms and is based on contracts between companies and employees. However, as trade secrets prohibit transfer of knowledge within industries, regulators have attempted to foster disclosure of technical know-how by institutional means of patents, copyrights and sui-generis laws. And indeed, following the provisions formed by IPR regulation, firms have shifted from methods of trade secrecy towards patenting strategies to achieve improved protection of intellectual property, as well as means to acquire competitive advantages in the market by monopolization of technological advances.economics of technology ;
