    Supervision in an alternative paradigm

    Original article can be found at: http://www.textjournal.com.au/speciss/issue6/content.htmIn this paper we express our framing of supervision as preparation and training for professional practice as a researcher, rather than the culmination of tertiary education. Instead of discussing the supervisory activity, performance and best practice, we focus on the uniqueness of practice as a researcher in the creative arts as being constituted by an emerging and novel research paradigm. We develop the theoretical framework of Guba and Lincoln, contrasting their use of the term ‘paradigm’ with that of Kuhn. We identify research in the creative arts as being a so-called ‘alternative paradigm’ but having its own unique characteristics. However, we claim that these characteristics are not discretionary but related to generic characteristics of research. By developing Guba and Lincoln’s model, we argue that the characteristics of research in the creative arts cannot simply be translated or inferred from the characteristics of research in cognate disciplines, but must be derived from the worldview and values of the arts community. This involves identifying both generic and discipline-specific characteristics. We claim that the discipline-specific characteristics reflect the values that are found in professional practice, and the generic characteristics reflect the values that are found in academic research across disciplines. As a result of establishing criteria for the evaluation of activities as research in a novel paradigm such as the creative arts, we present a critical framework for thesis production that facilitates the inclusion of the researcher’s own creative work in the doctoral study. A number of issues arising from the experience of the authors as supervisors and examiners are discussed. Finally, a template for a seven-chapter thesis in the creative arts is proposed, which addresses common problems such as weaknesses in the single-case study approach and researcher bias in participant-observation studies.Peer reviewe

    Expanding and Strengthening Legal Clinical Education in Ukraine

    On June 21, 2017, I submitted a report to USAID Nove Pravosuddya Justice Sector Reform Program (New Justice) titled A Role for Regulations, Standards, Best Practices, and Monitoring in Building Strong Clinical Legal Education Programs. That report centered on an analysis of three documents: (1) the Draft Model Regulation on Legal Clinic of a Higher Educational Institution as posted by the Ukrainian Ministry of Education and Science (MOE) on April 19, 2017; (2) the Standards for Legal Clinics Functioning in Ukraine developed by the Association of Legal Clinics of Ukraine (ALCU) (hereafter Standards); (3) a draft instrument to monitor law school clinics being developed by the ALCU (hereafter Monitoring Instrument). In my 2018 work on clinical legal education (CLE) with New Justice, I considered two documents: (1) a Draft Syllabus for a Fundamentals of Legal Clinical Practice course developed at Yaroslav Mudryi National Law University and (2) a CLE Manual on which a group of Ukrainian clinicians had worked with Iryna Ivankiv from OSCE Project Co-ordinator in Ukraine (OSCE) for some time. I worked from an English translation of the Draft Syllabus. For the multi-chapter Manual, I worked from an English translation of the Table of Contents and an oral summary of each chapter’s content. I also had been asked by New Justice to prepare an overview of relevant international and European good practices concerning an “LCE course” for law students for use in analyzing the Ukrainian “draft curriculum” as well as presenting recommendations to stakeholders. My preliminary analysis and recommendations on the Draft Syllabus and Manual were presented at a meeting at New Justice’s Kyiv office on September 14, 2018. While New Justice, ALCU representatives, and I discussed developments with regard to the three documents that were the subject of my June 2017 report during my September 2018 visit to Ukraine, this report does not concern the current status of these three very valuable documents or return to their substance. This report, though, continues my June 2017 report’s discussion of the role of standards, best practice, and monitoring in building strong clinical legal education programs as focusing on integration of clinical education courses in the Ukrainian law school curriculum

    FDTL voices : drawing from learning and teaching projects

    This publication draws on insights and experiences from individuals and teams within learning and teaching development projects in higher education. It considers lessons learnt from the processes, outcomes and tangible outputs of the projects across the spectrum of the FDTL initiative, with the intention that colleagues can draw on and benefit from this experience. The overriding theme at the heart of every FDTL project has been the desire to achieve some form of positive and meaningful change at the level of the individual, institution or discipline. The continuing legacy of the programme has been to create wider community involvement as projects have engaged with the higher education sector on multiple levels - personal, institutional, practice, and policy. This publication has remained throughout a collaborative endeavour, supported by Academy colleagues.     How does one do a Practice-Based PhD in Filmmaking?

    This paper seeks to explore the issues raised by the process of engaging in a practice-based PhD in Filmmaking. As a sole practitioner the screenwriting doctoral student is able to explore her practice through the development of a screenplay, but what of the potential doctoral students who may wish to explore their specialist and professional filmmaking practices but who are unable to operate as sole practitioners, because of the collaborative requirements of the professional filmmaking model. Using the experience of the screenwriting doctoral investigation, and particularly the exploration of the relationship between methodology, exegesis and the creative artefact, we explore a potential model that would enable all filmmaking specialists to engage in doctoral research. Art students engaging in practice-based doctoral research do so in an environment formed by Government requirements that demand cultural, environmental and economic impacts as well as a methodology that to a large extent is formed by social science measures of value. Using this framework as a starting point we attempted to identify a suitable model that would enable filmmakers to undertake practice-based doctoral research

    Projektin kaupallinen johtaminen

    There is a growing interest in commercial management in project execution. Research questions of the thesis are: how can commercial management activities be effectively organized to support project execution, and how the commercial manager role affects the success of projects. The research contributes to project management literature, particularly from commercial viewpoint. The research method is to empirically study with a mixed-method approach commercial management throughout the case firm’s project execution. The case firm is a mining and metallurgical technology company providing equipment and complex plant projects. The qualitative part includes five case projects with commercial manager and three reference projects without commercial manager. In the quantitative part, 42 projects are analyzed, part of which having an appointed commercial manager. The empirical study suggests that project characteristics, such as the client, country, and contract type, generate the need and the shape for the commercial manager role. Commercial manager acts as an integrator of commercial topics, while input and involvement is required from respective project roles and support functions. The core of the role incorporates financial, change, claim, and risk management. In addition, supportive actions are required in sales phase, client relationship and communication management, and procurement. Commercial manager enables project manager to concentrate on holistic management, reduces the need for commercial knowledge transfer from support functions, and fosters commercial expertise within the project team. The thesis provides a model for statistical analysis. Obtained results are, however, not statistically significant, due to insufficient sample size. Nevertheless, the related proposition for variables and metrics lays a foundation for further studies with sufficient population of project samples. New knowledge is provided on commercial manager’s activities and the involvement of the role in these activities, as well as on success metrics of effective commercial management. For the case firm, the generic role description, as well as success metrics, are proposed to support global role implementation. Individual bias of case projects, limited variation in project characteristics, and small sample size constrain the reliability and the applicability of the empirical study. Hence, results are generalizable for major and complex projects only. The thesis provides a fair basis for future research in project-specific factors’ impact on the commercial manager role, and financial implications of effective commercial management.Kaupallinen näkökulma on korostuvasti esillä nykypäivän projektijohtamisessa. Tämän diplomityön tutkimuskysymykset ovat: miten kaupallinen johtaminen tukee tehokkaasti projektin toteutusta, ja millainen vaikutus kaupallisen projektipäällikön roolilla on projektien menestykseen. Tutkielma edistää projektihallinnan ja projektien kaupallisen johtamisen tutkimusta. Aihetta tutkittiin empiirisesti kvalitatiivisin ja kvantitatiivisin menetelmin kohdeyrityksen projektitoteutuksen kautta. Kohdeyrityksen ydinliiketoiminta on laite- ja tehdasprojektien myynti, suunnittelu ja toteutus mineraalien ja metallien prosessointiin. Kvalitatiiviseen tutkimukseen valittiin viisi case-projektia, joissa kaupallisen projektipäällikön roolia sovellettiin sekä kolme vertailuprojektia ilman kyseistä roolia. Kvantitatiivinen tutkimus koostui 42 projektista, joista osassa rooli oli mukana. Empiirinen tutkimus osoitti projektimuuttujien, kuten asiakas, maa ja sopimustyyppi, vaikuttavan kaupallisen projektipäällikön tarpeeseen sekä hänen roolinsa sisältöön. Kaupallinen projektipäällikkö toimii kaupallisen johtamisen kokoonpanevana voimana varmistaen asianmukaisen panostuksen muilta projektirooleilta. Hänen vastuullaan on projektin talouden, muutosten ja riskien hallinta. Lisäksi projektin myyntivaiheessa, asiakassuhteiden ja -viestinnän hallinnassa sekä hankinnoissa roolitehtävänä on tukea muuta projektitiimiä. Kaupallisen projektipäällikön nimittäminen mahdollistaa projektipäällikön keskittymisen projektin kokonaisuuden hallintaan, vähentää tarvetta projektin ulkopuolisen tukitoiminto-osaamisen hyödyntämiseen sekä kasvattaa projektihenkilöstön kaupallista osaamista. Diplomityössä on esitetty malli tilastolliseen analyysiin, mutta tulokset eivät olleet tilastollisesti merkittäviä otoskoon vähäisyyden seurauksena. Ehdotus mallin muuttujista ja mittareista luo kuitenkin perustan tuleville tutkimuksille. Tutkielma luo uutta tietoa kaupallisen projektipäällikön tehtävistä ja niiden toteutuksesta sekä onnistuneen kaupallisen johtamisen mittareista. Ehdotettu roolikuvaus ja sovellettavat mittarit avustavat tutkimusyritystä roolin perustamisessa. Case-projektien vähäinen määrä ja tarkastelun rajaaminen vain yhteen toimittavaan liiketoimintayksikköön heikensivät tutkimuksen merkitsevyyttä ja tutkimustulosten käytettävyyttä. Tulokset ovat yleistettävissä pääasiassa suuriin ja monimutkaisiin projekteihin.
