    This essay explores the nature, the functioning, and the economic and policy implications of markets for technology. Today, the outsourcing of research and development activities is more common than in the past, and specialized technology suppliers have emerged in many industries. In a sense, the Schumpeterian vision of integrating R&D with manufacturing and distribution is being confronted by the older Smithian vision of division of labor. The existence and efficacy of markets for technology can profoundly influence the creation and diffusion of new knowledge, and hence, economic growth of countries and the competitive position of companies. The economic and managerial literatures have touched upon some aspects of the nature of these markets. However, a thorough understanding of how markets for technology work is still lacking. In this essay we address two main questions. First, what are the factors that enable a market for technology to exist and function effectively? Specifically we look at the role of industry structure, the nature of knowledge, and intellectual property rights and related institutions. Second, we ask what the implications of such markets are for the boundaries of the firm, the specialization and division of labor in the economy, industry structure, and economic growth. We build on this discussion to develop the implications of our work for public policy and corporate strategy

    Technology market intermediaries to facilitate external technology exploitation: The case of IP auctions

    Recently the phenomena of external technology exploitation (ETE) has started to attract attention from scholars, businesses and politicians likewise alongside with a growth of the markets for technology. However, the markets for technology are still characterized by inhibiting obstacles that lead to high transaction costs, thus prohibit efficient transactions and result in market failure. Although, on the one hand the presence of obstacles lead to high transaction costs, the large market potential on the other hand provides incentives for technology market intermediaries (TMI) to develop new exploitation models to facilitate ETE transactions by reducing transaction costs. Throughout this paper we address the general research question of whether and how new exploitation models can actually facilitate ETE. To address this question, in a first step we generate insights into TMIs acting on the markets for technology and derived a conceptual basis for a further understanding of TMIs. Having carried out a detailed review of the literature, we develop a theory based typology for six TMI archetypes. Throughout this exercise we gain insights into the variety of different functions TMIs have on the markets for technology and various new ways how TMIs try to facilitate ETE transactions. Throughout the second part of this paper, we focus on IP auctions as one particular business model of the archetype “IP Broker”. We investigate this “young” business model presenting first insights into two qualitative studies. In a first step we derive a generic IP auction process based on a qualitative, empirical analysis of IP auction processes. We then translate these results into a theory based process view and derive a generic IP auction process as a specific type of an ETE process. Having thus generated a close understanding of the transaction process, we presented results from four cases of successful transactions, i.e. where patents were sold for particular high prices from two SMEs and two MNCs. The case studies are analyzed according to four main aspects including characteristics of the companies that exploited patented technologies (including motives and selection processes), the patented technology as such, the organization of the transaction and the companies’ perceptions regarding the success of the transactions. --

    What drives contract design in strategic alliances? Taking stock and how to proceed

    We collect and assess prior empirical evidence on contract design in alliances that has been published since Parkhe’s (1993) seminal study on inter-firm contracts. We elaborate on the effects of transaction-related factors, experience gained from prior relationships, and deliberate learning efforts on contracts. Our paper offers three contributions. First, we systematically review the existing literature on alliance contracts and summarize our findings. Second, while prior research has traditionally focused on contractual complexity, we place the content of contracts center stage and identify three contractual functions. While existing studies on contractual functions predominantly refer to safeguarding as a response to appropriation concerns, we also consider coordination and contingency adaptability as outcomes of adaptation concerns. Third, we disentangle the differential influences of previous experiences on distinct contractual functions and show that experience gained from prior relationships has different effects on safeguarding and contingency adaptability than on coordination. Overall, we add to the systematization of the current debate on alliance contract design and trace promising avenues for future research on the impact of transaction- and experience-related factors on the complexity and content of alliance contracts

In the course of its case investigations and legislative reviews the European Commission became aware of changes in the use of intellectual property, in particular the use of patents. It was noted that firms’ uses of intellectual property are becoming increasingly strategic. This raised concerns about the implications of firms’ patenting behaviour for enterprise and competition policy. I rapporten visas att hushållens livscykel bestämmer mycket av bostadspreferenser.Livsform, här utbildningsnivå och hemort, påverkar livscykelns skeenden. Livsstil är till stor del en produkt av livscykel och livsform. De grupper som har störst resurser har också störst möjlighet att utveckla livsstilar med betydelse för bostadsval. 8 olika konsumentgrupper beskrivs, huvudsakligen ur Stockholmsperspektiv. Barnfamiljers starka önskan om småhus framträder, särskilt då andra barnet kommer. Högutbildade ensamstående kvinnor vill bo i innerstad nära kulturutbud, medan ensamstående män vill bo centralt ur kommunikationssynpunkt. De äldre par som säljer familjevillan har önskemål utöver sjönära bostadsrätt. Resultaten bidrar till att öka kunskapen också om de skiftande bostadsbehov som inte ger sig till känna på marknaden.     Patent Systems for Encouraging Innovation: Lessons from Economic Analysis

    Economic theory views patents as policy instruments aimed at fostering innovation and diffusion. Three major implications are drawn regarding current policy debates. First, patents may not be the most effective means of protection for inventors to recover R&D investments when imitation is costly and first mover advantages are important. Second, patentability requirements, such as novelty or non-obviousness, should be sufficiently stringent to avoid the grant of patents for inventions with low social value that increase the social cost of the patent system. Third, the trade-off between the patent policy instruments of length and breadth could be used to provide sufficient incentives to develop inventions with high social value. Beyond these three implications, economic theory also pleads for a mechanism design approach: an optimal patent system could be based on a menu of different degrees of patent protection where stronger protection would involve higher fees, allowing self-selection by inventors.Patent subject matter, patentability requirements, sequential innovation, incentive mechanism, license fee
