The European Citizens' Initiative: An Early Assessment of the European Union's New Participatory Democracy Instrument

The world's first transnational, digital right of initiative, the European Citizens' Initiative (ECI) took effect on April 1, 2012, when the EU Regulation on the citizen's initiative (No 2011/2011) entered into force. The ECI gives citizens within European Union (EU) Member States the right to call on the European Commission to propose new or change existing EU legislation. For an ECI to be considered, the subject matter must be within the Commission's legislative competence and organizers must gather at a minimum 1 million signatures (0.2 percent of the EU's population of 502 million) from at least 1?4 of EU Member States (currently seven) in one year. Nine months on, the new instrument has met with several difficulties in this experimental phase of implementation, and only eight ECIs have been able to start online signature collection

The Ground on Which We All Stand: A Conversation About Menstrual Equity Law and Activism

This essay grows out of a panel discussion among five lawyers on the subject of menstrual equity activism. Each of the authors is a scholar, activist or organizer involved in some form of menstrual equity work. The overall project is both enriched and complicated by an intersectional analysis. This essay increases awareness of existing menstrual equity and menstrual justice work; it also identifies avenues for further inquiry, next steps for legal action, and opportunities that lie ahead. After describing prior and current work at the junction of law and menstruation, the contributors evaluate the successes and limitations of recent legal changes. The authors then turn to conceptual issues about the relationship between menstrual equity and gender justice, as well as the difference between equity and equality. The essay concludes with consideration of the future of menstrual equity and menstrual justice work. The authors envision an expanded, inclusive group of individuals working for greater gender justice

Bringing the outside(r) in: Law’s appropriation of subversive identities

This article explores some of the ways in which law appropriates subversive identities. Drawing on work from geographical, feminist and critical race approaches to property, I put forward an understanding of property as a relation of belonging ‘held up’ by space. Building on this understanding, I argue that identity can operate as property in the same way that land and material objects can, and that law appropriates subversive identities by bringing them into its hegemonic space of recognition and regulation. Law’s appropriations have a range of effects on both the individual subjects directly involved in legal proceedings and the broader spaces in and through which those subjects forge their identities. Specifically this article explores the appropriation of gay and lesbian identities in the context of immigration law, and of aboriginal identities in the context of Australia’s Northern Territory National Emergency Response Act 2007 (Cth) (NTNERA)

Case Study: School Discipline Reform in California

At the core of The California Endowment's (TCE) work is their Health Happens Here strategy. Health Happens in Neighborhoods, in Schools, and with Prevention -- and Health Happens with All Our Sons and Brothers. TCE sponsored a case study of school discipline reform in California, and engaged Nancy Latham (LFA's Chief Learning Officer) and two other consultants (Tia Martinez and Arnold Chandler) to research and write the study. The case study tells the story of how community and youth organizers, public interest lawyers, and statewide advocates came together to support school discipline reform. In a remarkably short period of time during 2011 and 2012, this issue went from the fringes to the center of policy debate -- with ten bills introduced, seven passed, and five ultimately signed into law. These new policies are an important milestone in the effort to back away from overly punitive "zero tolerance" school discipline that fuels high drop-out rates among young people of color. These policies will make it easier for schools to support and educate, rather than marginalize, our sons and brothers

The Social Construction of Sarbanes-Oxley

The closer one looks at SOX and its origins in the financial scandals of the early 2000s, the blurrier the picture, which lets commentators see what they want to see and draw inferences accordingly. That is why social construction is so crucial. My aim in this paper is to illuminate the social nature of SOX\u27s diffusion into practice. I will leave to the reader the judgment about whether this has been or will be good or bad, and for whom. If I seem to challenge SOX\u27s critics more than its supporters, it is because the critics have been more venomous than is fair. Venom aside, the bite still deserves attention

How Civil Society Organizations Works Politically to Promote Pro-Poor Policies in Decentralized Indonesian Cities

This paper examines how civil society organizations (CSOs) have taken advantage of the increased opportunities created by decentralization to influence the role and functions of local administrations in urban areas of Indonesia. The paper utilizes evidence from two cities in Central Java where policies were passed that expanded health insurance coverage for the poor: Semarang (pop. 1.5 million) and Pekalongan (pop. 300,000). The paper argues that CSOs are increasingly able to influence local policy outcomes -- regardless of the leadership qualities among elected officials -- by working politically. We describe the political context of each city, which varies greatly. We provide evidence of how pro-poor advocates expanded their capital by identifying allies, building coalitions and taking advantage of critical junctures in order to influence social policy. We demonstrate how developing constituent interest in public policy has helped CSOs hold government accountable to the poor. We present a fiscal analysis of municipal revenue and spending produced by CSO partners, which illustrates both the challenges of increasing allocations, as well as the outcomes in terms of expanded coverage of health services. In conclusion, we offer implications for development programming going forward

Blue-Green Coalitions: Fighting for Safe Workplaces and Healthy Communities

[Excerpt] My goal in this book is to examine the formation of labor-environmental alliances that focus on health issues. Health concerns are increasingly a common ground on which blue-green coalitions are developing across the United States. Activists from both movements often see health issues through different lenses, which lends a particular slant to how they approach potential solutions for reducing exposures to toxics. The coalition framework emphasizes the fundamental link between occupational and environmental health, providing an internal cohesion and a politically persuasive agenda based on the centrality of health-related issues. By engaging labor and environmental activists in a common dialogue regarding the need for cooperative action to reduce the risks of community and workplace exposures, blue-green coalitions are creating new opportunities for progressive social change
