    Biometric surveillance in schools : cause for concern or case for curriculum?

    This article critically examines the draft consultation paper issued by the Scottish Government to local authorities on the use of biometric technologies in schools in September 2008 (see http://www.scotland.gov.uk/Publications/2008/09/08135019/0). Coming at a time when a number of schools are considering using biometric systems to register and confirm the identity of pupils in a number of settings (cashless catering systems, automated registration of pupils' arrival in school and school library automation), this guidance is undoubtedly welcome. The present focus seems to be on using fingerprints, but as the guidance acknowledges, the debate in future may encompass iris prints, voice prints and facial recognition systems, which are already in use in non-educational settings. The article notes broader developments in school surveillance in Scotland and in the rest of the UK and argues that serious attention must be given to the educational considerations which arise. Schools must prepare pupils for life in the newly emergent 'surveillance society', not by uncritically habituating them to the surveillance systems installed in their schools, but by critically engaging them in thought about the way surveillance technologies work in the wider world, the various rationales given to them, and the implications - in terms of privacy, safety and inclusion - of being a 'surveilled subject'

    Detect the unexpected: a science for surveillance

    Purpose – The purpose of this paper is to outline a strategy for research development focused on addressing the neglected role of visual perception in real life tasks such as policing surveillance and command and control settings. Approach – The scale of surveillance task in modern control room is expanding as technology increases input capacity at an accelerating rate. The authors review recent literature highlighting the difficulties that apply to modern surveillance and give examples of how poor detection of the unexpected can be, and how surprising this deficit can be. Perceptual phenomena such as change blindness are linked to the perceptual processes undertaken by law-enforcement personnel. Findings – A scientific programme is outlined for how detection deficits can best be addressed in the context of a multidisciplinary collaborative agenda between researchers and practitioners. The development of a cognitive research field specifically examining the occurrence of perceptual “failures” provides an opportunity for policing agencies to relate laboratory findings in psychology to their own fields of day-to-day enquiry. Originality/value – The paper shows, with examples, where interdisciplinary research may best be focussed on evaluating practical solutions and on generating useable guidelines on procedure and practice. It also argues that these processes should be investigated in real and simulated context-specific studies to confirm the validity of the findings in these new applied scenarios

    Police SWAT teams and Military Special Forces face mounting pressure and challenges from adversaries that can only be resolved by way of ever more sophisticated inputs into tactical operations. Lethal Autonomy provides constrained military/security forces with a viable option, but only if implementation has got proper empirically supported foundations. Autonomous weapon systems can be designed and developed to conduct ground, air and naval operations. This monograph offers some insights into the challenges of developing legal, reliable and ethical forms of autonomous weapons, that address the gap between Police or Law Enforcement and Military operations that is growing exponentially small. National adversaries are today in many instances hybrid threats, that manifest criminal and military traits, these often require deployment of hybrid-capability autonomous weapons imbued with the capability to taken on both Military and/or Security objectives.     Expanding alliance: ANZUS cooperation and Asia–Pacific security

    Is an alliance conceived as a bulwark against a resurgence of Japanese militarism and which cut its military and intelligence teeth in the Cold War is still relevant to today’s strategic concerns? Overview The alliance between Australia and the US, underpinned by the formal ANZUS Treaty of 1951, continues to be a central part of Australian defence and security thinking and an instrument of American policy in the Asia–Pacific. How is it that an alliance conceived as a bulwark against a resurgence of Japanese militarism and which cut its military and intelligence teeth in the Cold War is still relevant to today’s strategic concerns? The answer is partly—and importantly—that the core values of the ANZUS members are strongly aligned, and successive Australian governments and American presidential administrations have seen great value in working with like-minded partners to ensure Asia–Pacific security. Far from becoming a historical curiosity, today it’s not just relevant, but of greater importance than has been the case in the past few decades. To explore new ideas on how to strengthen the US–Australia alliance, ASPI conducted a high-level strategic dialogue in Honolulu in July this year. Discussions canvassed the future strategic environment; the forthcoming Australian Defence White Paper; budget, sovereignty and expectation risks; and cooperation in the maritime, land, air, cyber, space and intelligence domains. A key purpose of the Honolulu dialogue was to help ASPI develop policy recommendations on the alliance relationship for government. This report is the product of those discussions

    In this paper we examine the role of code (software) in the spatial formation of collective life. Taking the view that human life and coded technology are folded into one another, we theorise space as ontogenesis. Space, we posit, is constantly being bought into being through a process of transduction – the constant making anew of a domain in reiterative and transformative practices - as an incomplete solution to a relational problem. The relational problem we examine is the ongoing encounter between individuals and environment where the solution, to a greater or lesser extent, is code. Code, we posit, is diversely embedded in collectives as coded objects, coded infrastructure, coded processes and coded assemblages. These objects, infrastructure, processes and assemblages possess technicity, that is, unfolding or evolutive power to make things happen; the ability to mediate, supplement, augment, monitor, regulate, operate, facilitate, produce collective life. We contend that when the technicity of code is operationalised it transduces one of three forms of hybrid spatial formations: code/space, coded space and backgrounded coded space. These formations are contingent, relational, extensible and scaleless, often stretched out across networks of greater or shorter length. We demonstrate the coded transduction of space through three vignettes – each a day in the life of three people living in London, UK, tracing the technical mediation of their interactions, transactions and mobilities. We then discuss how code becomes the relational solution to five different classes of problems – domestic living, travelling, working, communicating, and consuming

    National Security Pedagogy: The Role of Simulations

    This article challenges the dominant pedagogical assumptions in the legal academy. It begins by briefly considering the state of the field of national security, noting the rapid expansion in employment and the breadth of related positions that have been created post-9/11. It considers, in the process, how the legal academy has, as an institutional matter, responded to the demand. Part III examines traditional legal pedagogy, grounding the discussion in studies initiated by the American Bar Association, the Carnegie Foundation, and others. It suggests that using the law-writ-large as a starting point for those interested in national security law is a mistake. Instead, it makes more sense to work backwards from the skills most essential in this area of the law. The article then proposes six pedagogical goals that serve to distinguish national security law: (1) understanding the law as applied, (2) dealing with factual chaos and uncertainty, (3) obtaining critical distance—including, inter alia, when not to give legal advice, (4) developing nontraditional written and oral communication skills, (5) exhibiting leadership, integrity, and good judgment in a high-stakes, highly-charged environment, and (6) creating continued opportunities for self-learning. Equally important to the exercise of each of these skills is the ability to integrate them in the course of performance. These goals, and the subsidiary points they cover, are neither conclusive nor exclusive. Many of them incorporate skills that all lawyers should have—such as the ability to handle pressure, knowing how to modulate the mode and content of communications depending upon the circumstances, and managing ego, personality, and subordination. To the extent that they are overlooked by mainstream legal education, however, and present in a unique manner in national security law, they underscore the importance of more careful consideration of the skills required in this particular field. Having proposed a pedagogical approach, the article turns in Part IV to the question of how effective traditional law school teaching is in helping to students reach these goals. Doctrinal and experiential courses both prove important. The problem is that in national security law, the way in which these have become manifest often falls short of accomplishing the six pedagogical aims. Gaps left in doctrinal course are not adequately covered by devices typically adopted in the experiential realm, even as clinics, externships, and moot court competitions are in many ways ill-suited to national security. The article thus proposes in Part V a new model for national security legal education, based on innovations currently underway at Georgetown Law. NSL Sim 2.0 adapts a doctrinal course to the special needs of national security. Course design is preceded by careful regulatory, statutory, and Constitutional analysis, paired with policy considerations. The course takes advantage of new and emerging technologies to immerse students in a multi-day, real-world exercise, which forces students to deal with an information-rich environment, rapidly changing facts, and abbreviated timelines. It points to a new model of legal education that advances students in the pedagogical goals identified above, while complementing, rather than supplanting, the critical intellectual discourse that underlies the value of higher legal education

    Surveillance, big data and democracy: lessons for Australia from the US and UK

    This article argues that current laws are ill-equipped to deal with the multifaceted threats to individual privacy by governments, corporations and our own need to participate in the information society. Introduction In the era of big data, where people find themselves surveilled in ever more finely granulated aspects of their lives, and where the data profiles built from an accumulation of data gathered about themselves and others are used to predict as well as shape their behaviours, the question of privacy protection arises constantly. In this article we interrogate whether the discourse of privacy is sufficient to address this new paradigm of information flow and control. What we confront in this area is a set of practices concerning the collection, aggregation, sharing, interrogation and uses of data on a scale that crosses private and public boundaries, jurisdictional boundaries, and importantly, the boundaries between reality and simulation. The consequences of these practices are emerging as sometimes useful and sometimes damaging to governments, citizens and commercial organisations. Understanding how to regulate this sphere of activity to address the harms, to create an infrastructure of accountability, and to bring more transparency to the practices mentioned, is a challenge of some complexity. Using privacy frameworks may not provide the solutions or protections that ultimately are being sought. This article is concerned with data gathering and surveillance practices, by business and government, and the implications for individual privacy in the face of widespread collection and use of big data. We will firstly outline the practices around data and the issues that arise from such practices. We then consider how courts in the United Kingdom (‘UK’) and the United States (‘US’) are attempting to frame these issues using current legal frameworks, and finish by considering the Australian context. Notably the discourse around privacy protection differs significantly across these jurisdictions, encompassing elements of constitutional rights and freedoms, specific legislative schemes, data protection, anti-terrorist and criminal laws, tort and equity. This lack of a common understanding of what is or what should be encompassed within privacy makes it a very fragile creature indeed. On the basis of the exploration of these issues, we conclude that current laws are ill-equipped to deal with the multifaceted threats to individual privacy by governments, corporations and our own need to participate in the information society

    Missions and Vehicle Concepts for Modern, Propelled, Lighter-Than-Air Vehicles

    The results of studies conducted over the last 15 years to assess missions and vehicle concepts for modern, propelled, lighter-than-air vehicles (airships) were surveyed. Rigid and non-rigid airship concepts are considered. The use of airships for ocean patrol and surveillance is discussed along with vertical heavy lift airships. Military and civilian needs for high altitude platforms are addressed. Around 1970 a resurgence of interest about lighter-than-air vehicles (airships) occurred in both the public at large and in certain isolated elements of the aerospace industry. Such renewals of airship enthusiasm are not new and have, in fact, occurred regularly since the days of the Hindenburg and other large rigid airships. However, the interest that developed in the early 1970's has been particularly strong and self-sustaining for a number of good reasons. The first is the rapid increase in fuel prices over the last decade and the common belief (usually true) that airships are the most fuel efficient means of air transportation. Second, a number of new mission needs have arisen, particularly in surveillance and patrol and in vertical heavy-lift, which would seem to be well-suited to airship capabilities. The third reason is the recent proposal of many new and innovative airship concepts. Finally, there is the prospect of adapting to airships the tremendous amount of new aeronautical technology which has been developed in the past few decades thereby obtaining dramatic new airship capabilities. The primary purpose of this volume is to survey the results of studies, conducted over the last 15 years, to assess missions and vehicle concepts for modern propelled lighter-than-air vehicles
