    The future of Internet governance: should the U.S. relinquish Its authority over ICANN?

    How ICANN and the Internet domain name system are ultimately governed may set an important precedent in future policy debates over how the Internet should be governed, and what role governments and intergovernmental organizations should play. Overview Currently, the U.S. government retains limited authority over the Internet’s domain name system, primarily through the Internet Assigned Numbers Authority (IANA) functions contract between the National Telecommunications and Information Administration (NTIA) and the Internet Corporation for Assigned Names and Numbers (ICANN). By virtue of the IANA functions contract, the NTIA exerts a legacy authority and stewardship over ICANN, and arguably has more influence over ICANN and the domain name system (DNS) than other national governments. On March 14, 2014, NTIA announced the intention to transition its stewardship role and procedural authority over key Internet domain name functions to the global Internet multistakeholder community. To accomplish this transition, NTIA has asked ICANN to convene interested global Internet stakeholders to develop a transition proposal. NTIA has stated that it will not accept any transition proposal that would replace the NTIA role with a government-led or an intergovernmental organization solution. Currently, Internet stakeholders are engaged in a series of working groups to develop a transition proposal. Their goal is to submit a final proposal to NTIA by summer 2015. NTIA must approve the proposal in order for it to relinquish its authority over the IANA functions contract. While the IANA functions contract expires on September 30, 2015, NTIA has the flexibility to extend the contract for any period through September 2019. Concerns have risen in Congress over the proposed transition. Critics worry that relinquishing U.S. authority over Internet domain names may offer opportunities for either hostile foreign governments or intergovernmental organizations, such as the United Nations, to gain undue influence over the Internet. On the other hand, supporters argue that this transition completes the necessary evolution of Internet domain name governance towards the private sector, and will ultimately support and strengthen the multistakeholder model of Internet governance. Legislation has been introduced in the 113th and 114th Congresses which would prevent, delay, or impose conditions or additional scrutiny on the transition. In the 113th Congress, a provision in the Consolidated and Further Continuing Appropriations Act, 2015 (P.L. 113-235) provides that during FY2015, NTIA may not use any appropriated funds to relinquish its responsibility with respect to Internet domain name system functions. In the 114th Congress, H.R. 805 (the DOTCOM Act of 2015) would prohibit NTIA from relinquishing its authority over the Internet domain name system until the Government Accountability Office (GAO) submits a report to Congress examining the implications of the proposed transfer. The proposed transition could have a significant impact on the future of Internet governance. National governments are recognizing an increasing stake in ICANN and DNS policy decisions, especially in cases where Internet DNS policy intersects with national laws and interests related to issues such as intellectual property, cybersecurity, privacy, and Internet freedom.     Restraining ICANN: an analysis of OFAC sanctions and their impact on the Internet Corporation for assigned names and numbers

    The Internet Corporation for Assigned Names and Numbers (ICANN) has long played a crucial role in coordinating some aspects of the domain name system (DNS) and managing domain names and Internet Protocol Addresses. In 2016, ICANN underwent a significant transformation when completing the IANA Transition, aimed at securing the corporation’s independence from U.S. government oversight. However, while the transition marked a pivotal moment in ICANN’s history, the corporation still operates within U.S. jurisdiction. This situation makes ICANN subject to compliance with the U.S. Office of Foreign Assets Control (OFAC) sanctions programs, impeding the corporation from contracting and accrediting gTLD registries and registrars from countries currently targeted by OFAC, as well as individuals or entities included in OFAC’s «Specially Designated Nationals and Blocked Persons» (SDN) list.     What is at stake for how the Internet continues to evolve is the preservation of its integrity as a single network. In practice, its governance is neither centralised nor unitary; it is piecemeal and fragmented, with authoritative decision-making coming from different sources simultaneously: governments, businesses, international organisations, technical and academic experts, and civil society. Historically, the conditions for their interaction were rarely defined beyond basic technical coordination, due at first to the academic freedom granted to the researchers developing the network and, later on, to the sheer impossibility of controlling mushrooming Internet initiatives. Today, the search for global norms and rules for the Internet continues, be it for cybersecurity or artificial intelligence, amid processes fostering the supremacy of national approaches or the vitality of a pluralist environment with various stakeholders represented. This book provides an incisive analysis of the emergence and evolution of global Internet governance, unpacking the complexity of more than 300 governance arrangements, influential debates and political negotiations over four decades. Highly accessible, this book breaks new ground through a wide empirical exploration and a new conceptual approach to governance enactment in global issue domains. A tripartite framework is employed for revealing power dynamics, relying on: a) an extensive database of mechanisms of governance for the Internet at the global and regional level; b) an in-depth analysis of the evolution of actors and priorities over time; and c) a key set of dominant practices observed in the Internet governance communities.     Rising China and Internet governance: Multistakeholderism, fragmentation and the Liberal Order in the age of digital sovereignty

    In its open and private-based dimension, the Internet is the epitome of the Liberal International Order in its global spatial dimension. Therefore, normative questions arise from the emergence of powerful non-liberal actors such as China in Internet governance. In particular, China has supported a UN-based multilateral Internet governance model based on state sovereignty aimed at replacing the existing ICANN-based multistakeholder model. While persistent, this debate has become less dualistic through time. However, fear of Internet fragmentation has increased as the US-China technological competition grew harsher. This thesis inquires “(To what extent) are Chinese stakeholders reshaping the rules of Global Internet Governance?”. This is further unpacked in three smaller questions: (i) (To what extent) are Chinese stakeholders contributing to increased state influence in multistakeholder fora?; (ii) (how) is China contributing to Internet fragmentation?; and (iii) what are the main drivers of Chinese stakeholders’ stances? To answer these questions, Chinese stakeholders’ actions are observed in the making and management of critical Internet resources at the IETF and ICANN respectively, and in mobile connectivity standard-making at 3GPP. Through the lens of norm entrepreneurship in regime complexes, this thesis interprets changes and persistence in the Internet governance normative order and Chinese attitudes towards it. Three research methods are employed: network analysis, semi-structured expert interviews, and thematic document analysis. While China has enhanced state intervention in several technological fields, fostering debates on digital sovereignty, this research finds that the Chinese government does not exert full control on its domestic private actors and concludes that Chinese stakeholders have increasingly adapted to multistakeholder Internet governance as they grew influential within it. To enhance control over Internet-based activities, the Chinese government resorted to regulatory and technical control domestically rather than establishing a splinternet. This is due to Chinese stakeholders’ interest in retaining the network benefits of global interconnectivity

    There is order on the internet, but how has this order emerged and what challenges will threaten and shape its future? This study shows how a legitimate order of norms has emerged online, through both national and international legal systems. It establishes the emergence of a normative order of the internet, an order which explains and justifies processes of online rule and regulation. This order integrates norms at three different levels (regional, national, international), of two types (privately and publicly authored), and of different character (from ius cogens to technical standards). The author assesses their internal coherence, their consonance with other order norms and their consistency with the order's finality. The normative order of the internet is based on and produces a liquefied system characterized by self-learning normativity. In light of the importance of the socio-communicative online space, this is a book for anyone interested in understanding the contemporary development of the internet.
