    Digital Competence and Family Mediation in the Perception of Online Risk to Adolescents. Analysis of the Montenegro Case Study

    Da diversi anni il dibattito scientifico e politico internazionale ha manifestato un interesse sempre più crescente sulla digital literacy e la digital education, quali strumenti di tutela del minore rispetto ai rischi derivanti dall’utilizzo incontrollato e inconsapevole di diversi mezzi di comunicazione. Contemporaneamente, diversi filoni della letteratura scientifica hanno approfondito i temi dei rischi e delle opportunità legate all’utilizzo della rete, da cui spesso sono stati promossi interventi territoriali politici, di sensibilizzazione o di formazione per arginare gli effetti potenzialmente nocivi e incrementare quelli positivi, legati soprattutto alle opportunità di crescita individuale e di inclusione socioculturale che le tecnologie possono contribuire a determinare. Il paper si inserisce all’interno di questo quadro per riflettere sul modo in cui il possesso o meno di alcune competenze digitali possa influenzare o meno il comportamento di fruizione mediale dei giovani, incrementando o meno il rischio di esposizione mediale all’interno di un contesto socioculturale circoscritto. Per intraprendere questo tipo di riflessione, il paper focalizza la propria attenzione sul caso di studio del Montenegro e analizza alcuni risultati della ricerca Eukids on line del 2016, per riflettere sulla relazione fra competenze digitali e livello di rischio espositivo dei bambini compresi fra i 9 e i 17 anni all’interno di aree territoriali socioculturali circoscritte.For several years, international scientific and political debate has shown increasing interest in digital literacy and digital education as tools to protect minors from the risks associated with the unmonitored and unaware use of various media. At the same time, various strains in the scientific literature have more deeply analyzed the themes of the risks and opportunities associated with using the web; this has often resulted in the promotion of political, awareness-raising, or educational interventions on the local level, to contain the potentially harmful effects and augment the positive ones linked especially to the opportunities for individual growth and sociocultural inclusion that these technologies can help bring about. This paper enters into this framework to explore how whether or not digital competence is possessed can influence young people’s media use behaviour, while increasing or not increasing the risk of media exposure within a circumscribed sociocultural context. To undertake this kind of reflection, this paper focuses its attention on the Montenegro case study and analyzes some results of the 2016 Global kids on line research work, to consider the relationship between digital competence and the exposure risk level of children between 12 and 17 years of age within circumscribed sociocultural areas

    Website Blocked: Filtering Technology in Schools and School Libraries

    This paper investigates the impact of filtering software in K-12 schools and school libraries. The Children\u27s Internet Protection Act, or CIPA, requires that public schools and school libraries use filtering technology in order to receive discounted rates on technology. As a result, nearly all public elementary and secondary schools today use filtering technology. While the provisions of CIPA narrowly define the content to be blocked, filters are often set to block much more than is required. Filtering technology is often ineffective, and many unobjectionable sites end up being blocked, including Web 2.0 sites and tools needed to educate students in a 21st century learning environment. Filtering software raises other issues as well, such as First Amendment implications, a possible digital divide between students that have unfiltered access to online content at home and those that do not, and the loss of opportunity to educate students on how to be good digital citizens. These issues should be acknowledged and addressed. There are many options available to librarians, educators, administrators, and other stakeholders that can increase students\u27 access to online information and educational tools while still protecting children from inappropriate online content and complying with the requirements of CIPA

    In response to growing fears from the entertainment industry over online file-sharing of valuable content, the Federal Communications Commission ( FCC ) enacted sweeping regulations over the production of electronic devices in the name of protecting digital television broadcasts. Although the FCC\u27s broadcast flag regulation was struck down on jurisdictional grounds, Hollywood has not given up the push for strict control. If Hollywood successfully acquires broadcast flag protection there could be far-reaching implications for innovation and development of new digital technologies. While content providers have important reasons to protect copyrighted material, there is too much at stake to merely acquiesce to their demands in the name of piracy prevention

    DRM and Privacy

    Interrogating the relationship between copyright enforcement and privacy raises deeper questions about the nature of privacy and what counts, or ought to count, as privacy invasion in the age of networked digital technologies. This Article begins, in Part II, by identifying the privacy interests that individuals enjoy in their intellectual activities and exploring the different ways in which certain implementations of DRM technologies may threaten those interests. Part III considers the appropriate scope of legal protection for privacy in the context of DRM, and argues that both the common law of privacy and an expanded conception of consumer protection law have roles to play in protecting the privacy of information users. As Parts II and III demonstrate, consideration of how the theory and law of privacy should respond to the development and implementation of DRM technologies also raises the reverse question: How should the development and implementation of DRM technologies respond to privacy theory and law? As artifacts designed to regulate user behavior, DRM technologies already embody value choices. Might privacy itself become one of the values embodied in DRM design? Part IV argues that with some conceptual and procedural adjustments, DRM technologies and related standard-setting processes could be harnessed to preserve and protect privacy

    Cyber-Democracy or Cyber-Hegemony? Exploring the Political and Economic Structures of the Internet as an Alternative Source of Information

    Although government regulation of the Internet has been decried as undercutting free speech, the control of Internet content through capitalist gateways???namely, profit-driven software companies???has gone largely uncriticized. The author argues that this discursive trend manufactures consent through a hegemonic force neglecting to confront the invasion of online advertising or marketing strategies directed at children. This study suggests that ???inappropriate content??? (that is, nudity, pornography, obscenities) constitutes a cultural currency through which concerns and responses to the Internet have been articulated within the mainstream. By examining the rhetorical and financial investments of the telecommunications business sector, the author contends that the rhetorical elements creating ???cyber-safety??? concerns within the mainstream attempt to reach the consent of parents and educators by asking them to see some Internet content as value laden (sexuality, trigger words, or adult content), while disguising the interests and authority of profitable computer software and hardware industries (advertising and marketing). Although most online ???safety measures??? neglect to confront the emerging invasion of advertising/marketing directed at children and youth, the author argues that media literacy in cyberspace demands such scrutiny. Unlike measures to block or filter online information, students need an empowerment approach that will enable them to analyze, evaluate, and judge the information they receive.published or submitted for publicatio

    The particular problems of content and viewpoint discrimination rarely surface in copyright, though some people have argued that fair use implicates them. Nonetheless, one important lesson for copyright from public forum doctrine is that First Amendment law can take some - though not many - speech-related options off the table. In this brief comment, I argue that analogies between copyright law and public forum doctrine highlight important shared commitments to free and robust public discourse, but also substantial practical barriers to judicial enforcement of those commitments
