Neoliberalism and the Crisis of Legal Theory
INTRODUCTION: Patients have the right to influence the care they receive, but their wish to participate in care decision-making is unclear. AIM: This study investigates whether participation in nursing documentation influences patient participation in care decision-making, mastery, self-esteem, empowerment and depressive feelings among adult in-patients with chronic disease. MATERIALS AND METHODOLOGY: Adult patients (n=39) with chronic diseases were randomized. The intervention group participated in nursing documentation. Upon departure, patients filled in questionnaires about participation in care decision-making, mastery, self-esteem, empowerment and depressive feelings. RESULTS: The majority of the patients preferred a collaborative or passive role regarding care decision-making. Lack of knowledge was one reason for non-participation. Having been diagnosed more than five years previously meant stronger empowerment. CONCLUSION: It is a challenge for nurses to find strategies to assess patients' wishes regarding participation in care decision-making. Nurses must support patients' knowledge of their disease and empowerment
On the Persistence of Homogeneous Matter
Some recent philosophical debate about persistence has focussed on an
argument against perdurantism that discusses rotating perfectly homogeneous
discs (the `rotating discs argument'; RDA). The argument has been mostly
discussed by metaphysicians, though it appeals to ideas from classical
mechanics, especially about rotation. In contrast, I assess the RDA from the
perspective of the philosophy of physics.
After introducing the argument and emphasizing the relevance of physics
(Sections 1 to 3), I review some metaphysicians' replies to the argument
(Section 4). Thereafter, I argue for three main conclusions. They all arise
from the fact, emphasized in Section 2, that classical mechanics
(non-relativistic as well as relativistic) is both more subtle, and more
problematic, than philosophers generally realize.
The main conclusion is that the RDA can be defeated (Section 6 onwards).
Namely, by the perdurantist taking objects in classical mechanics (whether
point-particles or continuous bodies) to have only temporally extended, i.e.
non-instantaneous, temporal parts: which immediately blocks the RDA.
Admittedly, this version of perdurantism defines persistence in a weaker sense
of `definition' than {\em pointilliste} versions that aim to define persistence
assuming only instantaneous temporal parts. But I argue that temporally

Why Philosophers Shouldn’t Do Semantics
The linguistic turn provided philosophers with a range of reasons for engaging in careful investigation into the nature and structure of language. However, the linguistic turn is dead. The arguments for it have been abandoned. This raises the question: why should philosophers take an interest in the minutiae of natural language semantics? I’ll argue that there isn’t much of a reason - philosophy of language has lost its way. Then I provide a suggestion for how it can find its way again

Solidarity in a global age: Seattle and beyond
There are good grounds for taking seriously Wallerstein's dictum that the world system has entered what he describes as an interregnum. By this he means two important things: First, that the world is moving between two forms of world system, from a capitalist world system to something new; Second, that in such an interregnum questions of structure become less significant than those of agency. The world system is one that has been produced, reproduced and will ultimately be transformed by human actors.
The direction that it takes will be the result of the political struggles that ensue in the interregnum. In this paper I examine some of these claims in the context of a series of events that have taken place over the past decade
and in the run up to the protests that occurred in December 1999 at the World Trade Organization (WTO) summit in Seattle. In so doing I hope to put some empirical flesh on the bones of the idea that Wallerstein has
suggestively offered us. While I am critical of important aspects of Wallerstein's work and that of his cohorts at the Fernand Braudel Center I would equally argue that they have presented us with the most powerful and coherent framework for making sense of, I hesitate to use the term given Wallerstein's ontological assumptions, international relations. Thus, this paper is informed by sympathy with Wallerstein's ideas and an acknowledgement that they offer us a rich source of insight into the emergence of the modern
world order
What about me? Factors affecting individual adaptive coping capacity across different populations
When and why will people adapt to climate change? We conducted a number of studies examining the psychological drivers of individual adaptation to climate change across different populations. We used a variety of methodologies including interviews, surveys, survey experiments and face-to-face experiments. There was a high level of rigour involved in each of these methodologies which means that we can believe in the results. This programme of research represents one of the largest and most integrated attempts to understand some of the psychological drivers of individual-level adaptation.First, we used the most recent advances in the psychological literature of coping more generally to develop a valid scale to measure coping with climate change. Across three studies we found that our tool was both reliable and valid, providing an accurate measure of the different ways in which people cope with climate change. This tool can now be used to understand the effects of both adaptive and maladaptive coping and to understand what leads to these different ways of coping.Next, we examined adaptive capacity. We found that adaptive coping strategies were associated with perceiving climate change as a threat to oneself and one’s way of life, rating environmental goals as important, and believing that adaptive behaviours could help achieve significant personal goals. Furthermore, when looking at societal adaptive capacity (support for governmental policies) we found that not only were a threat appraisal, climate change or environmental goal, and goal connectedness related to support, but also political affiliation, perceived human contribution to climate change, (lack of) denying that climate change exists, and a number of emotions (enthusiasm, worry, (lack of) happiness, and (lack of ) embarrassment). By knowing these factors that lead to adaptive coping and support for adaptive policies we can identify strategies to improve individual adaptive capacity.Third, based on a range of psychological literature, we hypothesised that adaptive behaviour would be related to goals, goal connectedness, adaptive coping, beliefs about climate change (including denial), and emotions that create an uneasy state of activation (enthusiasm and hope combined with worry). We found support for each of these relationships. Thus, we can again identify strategies to increase adaptive climate change behaviour. Across the studies, we found that adaptive capacity and adaptive behaviours relied upon both “green” beliefs and goals and “non-green” beliefs and goals. Moreover, believing that the adaptive behaviours helped a person to achieve their goals (whether they were related to climate change or not) was strongly related to adaptive capacity and behaviour. We have therefore shown that we can improve adaptation not only in those people who want to help the environment but also in those who are less interested.Unfortunately, the goal structure of environmental goals appears difficult to change. However, making people think about politics did have an effect: Regardless of their own political orientation, a person’s belief about the degree of human contribution to climate change decreased when they were thinking about politics (compared to not thinking about politics). This has implications for how climate change adaptation is discussed in the media and by researchers.The results of our research also have implications for the communication of climate change adaptation policies. Our results show that framing the costs of reducing CO2 emissions in terms of a decrease in future gain—rather than as an opportunity-cost—renders people more willing to commit to climate change initiatives.In summary, this programme of research has taken an integrated and rigorous step towards greater understanding of some of the psychological drivers of individual adaptation to climate change. Mapping Transitions towards Sustainable Consumption : Latitudes, Legends and Declinations in the Interaction between Consumers Culture and Sustainable Business Models
This paper seeks to chart “a navigation route“ towards sustainable consumption. We draw on data collected in research on consumers’ response to integrated products and services bundles conceptualized in design literature as Product Service Systems (PSS). PSS is of interest as it offers potential social and environmental benefits. Such services- based sustainable consumption practices have been neglected by consumer researchers. Methodological approaches to sustainable consumption favoured by policy makers focus research and interventions on individual consumer behaviour, but these have very limited success. Consumer practices, and the role that Government and other institutions play, are a more appropriate conceptual framework to explicate sustainable consumption. However, this Practice Theory approach is not sufficient either; the best solution might be a combination of this with an understanding of the individual value pursued by consumers. We extend Shove (2010)’s contention that adoption of sustainable consumption practices can only be explained with socio-cultural approaches; we propose that a combination of this perspective with an understanding of the value expected by individual consumers, is a more suitable approach than either behavioural paradigms or practices on their own to map these adoption mechanisms.Non peer reviewe
Philosophical foundations of the Death and Anti-Death discussion
Perhaps there has been no greater opportunity than in this “VOLUME FIFTEEN of our Death And Anti-Death set of anthologies” to write about how might think about life and how to avoid death. There are two reasons to discuss “life”, the first being enhancing our understanding of who we are and why we may be here in the Universe. The second is more practical: how humans meet the physical challenges brought about by the way they have interacted with their environment.
Many persons discussing “life” beg the question about what “life” is. Surely, when one discusses how to overcome its opposite, death, they are not referring to another “living” thing such as a plant. There seems to be a commonality, though, and it is this commonality is one needing elaboration. It ostensibly seems to be the boundary condition separating what is completely passive (inert) from what attempts to maintain its integrity, as well as fulfilling other conditions we think “life” has. In our present discussion, there will be a reminder that it by no means has been unequivocally established what life really is by placing quotes around the word, namely, “life”. Creationism and evolution
In Tower of Babel, Robert Pennock wrote that
“defenders of evolution would help their case
immeasurably if they would reassure their
audience that morality, purpose, and meaning are
not lost by accepting the truth of evolution.” We
first consider the thesis that the creationists’
movement exploits moral concerns to spread its
ideas against the theory of evolution. We analyze
their arguments and possible reasons why they are
easily accepted. Creationists usually employ two
contradictive strategies to expose the purported
moral degradation that comes with accepting the
theory of evolution. On the one hand they claim
that evolutionary theory is immoral. On the other
hand creationists think of evolutionary theory as
amoral. Both objections come naturally in a
monotheistic view. But we can find similar
conclusions about the supposed moral aspects of
evolution in non-religiously inspired discussions.
Meanwhile, the creationism-evolution debate
mainly focuses — understandably — on what
constitutes good science. We consider the need for
moral reassurance and analyze reassuring
arguments from philosophers. Philosophers may
stress that science does not prescribe and is
therefore not immoral, but this reaction opens the
door for the objection of amorality that evolution
— as a naturalistic world view at least —
supposedly endorses. We consider that the topic of
morality and its relation to the acceptance of
evolution may need more empirical research
Unfit for practical purpose: critically examining the claims to validity of marketing management discourse
This paper critically evaluates the dominant discourse of academic marketing management which is held to be capable of structuring practice. In addressing this issue and the concerns of the marketing as practice track, this paper draws on critical theory, discourse analysis, and social constructionism. The latter involved carrying out two groups of in depth interviews with marketing managers. The latter’s practice talk is taken as the object of inquiry. As theoretical structures facilitating investigation, the Habermasian notion of validity claims and the critical framework of Minger’s (2000) are utilised, in order to discover what marketers say they do, as opposed to what the dominant discourse says they should do. Minger’s identifies four different features of a critical approach. In terms of a critique of rhetoric, findings demonstrate that normative marketing is based on a poorly reasoned argument about the nature of managerial action, where little or no reference is made to the mental models that people in organisations work within. Secondly, a critique of the tradition of marketing management demonstrates that the boundaries of the right approach have been set by a powerful group who use the dominant discourse in a fashion that furthers their own ends. Thirdly, a critique of authority illustrates that the dominant discourse is seen as the one way to conceptualise marketing, whereas practitioners actually exhibit a range of alternative perspectives. Finally, a critique of objectivity shows that marketing management is not a pre-programmed, transferable technology, but is largely constituted by human agency. As a result of these findings, this paper contends that the dominant academic marketing orthodoxy does not meet the Habermasian claim to validity and is unfit for practical purpose. It is additionally argued that the orthodoxy is damaging, as it contributes to an impoverished understanding of marketing management practice
