    The design of surfaces, between empathy and new figuration

    Nowadays design languages seem anew defined through images and figures that appear increasingly distant from abstraction. In the time that we live in, where it is prevailing a dominance of individual needs rather common desires, an abandon of abstraction in favour of new figuration, stimulates the opportunity to investigate a new dyad, ‘Project and Empathy’; these terms could summarize well the expanded modality of physical and psychological interaction between people – as individual – and artefacts, through the increasing role of surfaces. The whole world of postmodern image, especially through the digital technologies, tends to offer hyper realistic aesthetic simulacra, altered nature: this is the current world of extension of feelings and sense, in which we are immersed daily. This condition affect the approaches to design, which require a new thinking around technologies, method and tools from training to practice the activity of design: a new attitude for materiality of things, beyond the immateriality of digital reality

    With Amgen, the Supreme Court’s majority once again holds that inquiry into the alleged market impact of a misrepresentation is not required to invoke fraud on the market approach to causation so that the class can be certified. Rather than just leaving matters where they have been since the Supreme Court’s muddled encounter with causation in Basic Inc. v. Levinson, the Supreme Court’s most recent decision appears to relax some earlier-held tenets with respect to markets believed sufficiently efficient for fraud on the market to be invoked. This Article not only identifies the central flaw of Basic that has over the decades distorted applications of fraud on the market but also suggests how, building on Amgen, what the future focus should be in considering whether a suit can proceed as a class action based on fraud on the market

    “MacGyver-Meets-Dr. Ruth”: Science Journalism and the Material Positioning of Dr. Carla Pugh

    This article examines the rhetorical consequences of foregrounding female scientists\u27 materials through an analysis of seven news articles on Dr. Carla Pugh, a surgeon who designs medical patient simulators. Journalists foreground Pugh\u27s materials by positioning her as both “MacGyver,” creatively assembling simulators from everyday objects, and “Dr. Ruth,” willingly discussing intimate parts. These positions avoid focusing on Pugh\u27s personal life or body but still ultimately gender her and her work. The MacGyver position associates Pugh with gendered activities, objects, and spaces while undermining her affiliation with the technical aspects of design. Meanwhile, the Dr. Ruth position implies Pugh\u27s knowledge comes from inherent bodily expertise, making certain scientific fields appear more natural for women

    Media Philosophy— A Reasonable Programme?

    It is beyond any doubt that media have an enormous impact on our media-culture societies. Media in?uence our perception and our knowledge, our memory as well as our emotions. They create public spheres and public opinions and give rise to media realities. Media shape our socialisation and our communality. They transform economy, politics, science, religion and law. “What we know about our society, even about our world we are living in, we know via the mass media.” (Luhmann 1996:9; my translation) Accordingly, “the media” have become a paramount subject of interdisciplinary discourses in the last decades all over the world. All these developments have become topics of scienti?c analyses as well as parts of media programmes. Since decades, various academic disciplines focused on an other-observation (“Fremdbeobachtung”) of the media from an external state, whereas the media increasingly tend to observe themselves as well as one another in order to transform this self-observation into parts of their respective programmes. The other-observation is carried out either by scholars of communication- and/or media theory or by philosophers; but whereas the former are organised in academic disciplines, no established discipline entitled “media philosophy” exists until today. Instead, the various approaches to philosophical analyses of media are heterogeneous and lack a solid theoretical basis as well as a disciplinary organisation. Some scholars even hold the view that media are not even within the province of philosophers. Some people deeply regret this deadlock regarding not only topics and discourses but also future jobs and positions for scholars of a discipline “media philosophy” to come. Others welcome this stalemate which gives room to creative solutions of thematic as well as of organisational matters. Let us have a short look at some of the foreseeable options. One of the actual media philosophical approaches concentrates its efforts on a reformulation of traditional philosophical topics in the framework of media ef?ciencies. The list of such topics is rather long and covers nearly all famous crucial subjects of philosophical discourses, reaching from reality, truth, culture, society, education or politics to time, space, emotion, subject or entertainment. This kind of rethinking or reformulating philosophical topics concentrates upon the question how—in the co-evolution of media systems and society—our daily experiences as well as our theoretical modellings of these topics have changed on the historical way from writing to the Internet

    How Understanding the Nature of Corporate Norms Can Prevent Their Destruction by Settlements

    Scholars have long celebrated the importance of norms in corporate law. Indeed, norms likely guide corporate actors more than the omnipresent threat of shareholder suits. This Article divides corporate norms into two distinct groups: aspirational norms and arbiter norms. Aspirational norms announce socially desirable objectives for corporate managers and encourage certain disclosure practices; arbiter norms identify distinct transactions for closer scrutiny by an independent body, the court. This Article shows that even though aspirational norms and arbiter norms serve different objectives, they share a common characteristic—overbreadth. This feature exists whether the norm is set forth by statute or found in judicial doctrine. Such overbreadth explains some, but by no means all, of the problems accompanying shareholder litigation, including the frequency of suits and inconsequential settlements. This Article also develops the paradoxes that accompany corporate norms. The inherent overbreadth of both aspirational and arbiter norms can be of great assistance to their protection against inconsequential settlements. Using the recent decision In re Trulia, Inc. Stockholder Litigation, this Article addresses how courts can fulfill their role in the non-adversarial setting of the settlement hearing. When asked to approve a settlement, the court should anchor its scrutiny of the adequacy and reasonableness of a settlement in the norm that is central to the suit. By doing so, the court can more positively contribute to the ongoing development of corporate norms

    Observing the observers – uncovering the role of values in research assessments of organic food systems

    Assessing the overall effects of organic food systems is important, but also a challenge because organic food systems cannot be fully assessed from one single research perspective. The aim of the article is to uncover the role of values in assessments of organic food systems as a basis for discussing the implications of combining multiple perspectives in overall sustainability assessments of the food system. We explore how values are embedded in five research perspectives assessing organic food systems, 1) Food Science, 2) Discourse Analysis, 3) Phenomenology, 4) Neoclassical Welfare Economics and 5) Actor-Network Theory. The article shows that value has various meanings in different scientific perspectives, and that a strategy for including and balancing different forms of knowledge in overall assessments of the effects of food systems is needed. Based on the analysis, we propose five ecommendations: 1) Elucidate values as a necessary foundation for research assessment across perspectives. 2 The choice of perspective is decisive and should be openly discussed 3) Formulate common goals which can be translated into the different perspectives and 4) Consider assessment of food system sustainability a learning process and design it as such

    The domain of materials for design is changing under the influence of an increased technological advancement, miniaturization and democratization. Materials are becoming connected, augmented, computational, interactive, active, responsive, and dynamic. These are ICS Materials, an acronym that stands for Interactive, Connected and Smart. While labs around the world are experimenting with these new materials, there is the need to reflect on their potentials and impact on design. This paper is a first step in this direction: to interpret and describe the qualities of ICS materials, considering their experiential pattern, their expressive sensorial dimension, and their aesthetic of interaction. Through case studies, we analyse and classify these emerging ICS Materials and identified common characteristics, and challenges, e.g. the ability to change over time or their programmability by the designers and users. On that basis, we argue there is the need to reframe and redesign existing models to describe ICS materials, making their qualities emerge
