    Regulating Clothing Outwork: A Sceptic's View

    By applying the strategies of international anti-sweatshop campaigns to the Australian context, recent regulations governing home-based clothing production hold retailers responsible for policing the wages and employment conditions of clothing outworkers who manufacture clothing on their behalf. This paper argues that the new approach oversimplifies the regulatory challenge by assuming (1) that Australian clothing production is organised in a hierarchical ‘buyer-led’ linear structure in which core retail firms have the capacity to control their suppliers’ behaviour; (2) that firms act as unitary moral agents; and (3) that interventions imported from other times and places are applicable to the contemporary Australian context. After considering some alternative regulatory approaches, the paper concludes that the new regulatory strategy effectively privatises responsibility for labour market conditions – a development that cries out for further debate

    The extent to which cultural activities can generate social and economic benefits for Indigenous communities, and the way in which those benefits are shared within communities depends largely on the way in which the system of intellectual property rights handles Indigenous cultural products. The aim of this paper is to address these issues, taking account of both legal and economic perspectives.     The influence of human rights on land rights and spatial information

    This paper reviews the growing influence of human rights issues on land rights, administration, management and tenure. In the last few decades, attention focussed on integrating economic and environmental considerations to achieve sustainable land use. The World Trade Organisation began in 1995. As a condition of membership, nations undertook legislative programmes aimed at reducing price distortions and barriers to international trade. Reducing trade barriers has direct effects on agricultural production as a major land use. Similarly, as signatories to the 1992 Rio Declaration, nations undertook caring for and reporting on the state of the environment. However, quality of life is also an issue in deciding what is sustainable development. The Universal Declaration of Human Rights, proclaimed in 1948, provided a framework for a series of international human rights conventions. These conventions now influence national legislative programmes.     Professional Ethics in the Construction Industry

    The results are provided of a small, but reprersentative, questionnaire survey of typical project managers, architects and building contractors concerning their views and experiences on a range of ethical issues surrounding construction industry activities. Most (90%) subscribed to a professional Code of Ethics and many (45%) had an Ethical Code of Conduct in their employing organisations, with the majority (84%) considering good ethical practice to be an important organisational goal. 93% of the respondents agreed that "Business Ethics" should be driven or governed by "Personal Ethics", with 84% of respondents stating that a balance of both the requirements of the client and the impact on the public should be maintained. No respondents were aware of any cases of employers attempting to force their employees to initiate, or participate in, unethical conduct. Despite this, all the respondents had witnessed or experienced some degree of unethical conduct, in the form of unfair conduct (81%), negligence (67%), conflict of interest (48%), collusive tendering (44%), fraud (35%), confidentiality and propriety breach (32%), bribery (26%) and violation of environmental ethics (20%)

    In a case currently before the High Court of Australia (Copyright Agency Limited (CAL) v NSW ) the fundamental question at issue is whether the owner (in this case surveyors) of copyright material (in this case land survey plans) that is submitted as part of a public register (in this case the land titles registry) with all the benefits that entails, should nonetheless have the right to charge the government and end users every time they reproduce or communicate that material to the public.     This paper explores the key components of dysfunctional, criminal and deviant behaviours within and by associational and not-for-profit organisations, and their consequences in terms of practice, application and policy. Abstract This short primer explores the key components of dysfunctional, criminal and deviant behaviors within and by associational and not-for-profit organizations, and their consequences in terms of practice, application and policy. A rich literature review of major and minor nonprofit scandals—primarily in the West—but also in other countries around the world demonstrate the breadth and depth of nonprofit corruption, fraud and misuse of funds as well as misconduct and deviant behavior by individuals within and by organizations. These associations range from Mom and Pop-scaled voluntary foundations to transnational charitable organizations, and so-called “Dark Nonprofit Groups (DNGs)” that promote terrorism, hate, extreme political views and other noxious or bizarre ideologies. Summarized are the widely researched concerns regarding self-regulation of these organizations including weaknesses in management controls, issues with adherence to existing vision and mission statements; board and management accountability; internal and external fiduciary controls; and intra- and inter-governmental regulatory responses. The context of these wrongdoings are ensconced within the framework of a discussion of ethics, morals, and wayward interpretations of legal and ownership structures in prevailing cultures and societies. Consequences of nonprofit organizational misconduct and dysfunction reveal a universal need for more research into the dark side of the Third Sector; and additional accountability and transparency not only at the micro level—individuals and board members within the organization--but also at the state, federal and global level. Lastly, increasingly vocal activism of civil society is acknowledged to have given shape and direction to the new moral landscape of 21st century Third Sector agendas

    Australian Government Balance Sheet Management

    Since almost eliminating net debt, the Australian Government%u2019s attention has turned to the financing of broader balance sheet liabilities, such as public sector superannuation. Australia will be developing a significant financial asset portfolio in the %u2018Future Fund%u2019 to smooth the financing of expenses through time. This raises the significant policy question of how best to manage the government balance sheet to reduce risk. This paper provides a framework for optimal balance sheet management. The major conclusions are that: %u2013 fiscal sustainability depends on both the expected path of future taxation and the risks around that path; %u2013 optimal balance sheet management requires knowledge of how risks affect the balance sheet (and therefore volatility in tax rates); and %u2013 the government%u2019s financial investment strategy should reduce the risk to government finances from macroeconomic shocks that permanently affect the budget. Based on this framework, we find that a Future Fund portfolio that included (amongst other potential investments) domestic nominal securities and equities of selected countries would reduce overall balance sheet risk.
