    Open Source Software: The New Intellectual Property Paradigm

    Open source methods for creating software rely on developers who voluntarily reveal code in the expectation that other developers will reciprocate. Open source incentives are distinct from earlier uses of intellectual property, leading to different types of inefficiencies and different biases in R&D investment. Open source style of software development remedies a defect of intellectual property protection, namely, that it does not generally require or encourage disclosure of source code. We review a considerable body of survey evidence and theory that seeks to explain why developers participate in open source collaborations instead of keeping their code proprietary, and evaluates the extent to which open source may improve welfare compared to proprietary development.

    The analysis of the empirical studies relative to the Free/Libre/Open Source Software (FLOSS) case highlights the necessity to enlarge the set of categories used to describe developers incentives. In particular, the evidences stress the important role played by another category of incentives, broadly and roughly defined as psychological and social motivations. However, the theories elaborated to cope with this dimension, such as ift economy,epistemic community or community of practice, are not combined into a unique structured framework. Each one of them, in fact, is focused on particular features of the FLOSS model, so that the FLOSS community itself is often described as ahybrid institution, obtained combining different perspectives. However, it is possible construct a mechanism here called reflexive identity able to bridge the analyzed theories and to explain the empirical evidences left aside by self-supply, reputation and signaling. The reflexive identity mechanism develops through the nexus of ties connecting the community members. In order to cooperate, members have to negotiate the system of meanings they use to interface with the world and with the communitarian environment. But this means reshaping also their own vision of the world, redefining their values and thus their identity. The space opened by the negotiation, then, is the space where community aims, principles and ethos act directly on membersidentity, making them internalize the communitarian structure of rules. The reflexive identity principle, then, merges the psychological and social dimension of the FLOSS phenomenon with the structure of rules adopted by the FLOSS community, and thus it constitutes together with self-supply, signaling, reputation and peer regard the basis upon which the FLOSS community is built.Open Source Software; FLOSS

    Coexisting Intellectual Property Right Regimes: the Case of Open and Closed Source Software

    Die Dissertation beschäftigt sich theoretisch und empirisch mit der Koexistenz von Open Source und Closed Source Prinzipien am Beispiel Software. Es werden kulturelle und rechtliche Einflussfaktoren auf Open Source Software (OSS) untersucht und die Koexistenz von OSS mit Closed Source Software (CSS) theoretisch begründet. Ein Schwerpunkt liegt auf OSS- und CSS-basierten Geschäftsmodellen: Strategische Aspekte und die Marktgleichgewichte mit OSS und CSS Firmen werden untersucht und darauf aufbauend wirtschaftspolitische Maßnahmen analysiert. Abschließend richtet sich der Fokus auf Gründungen im IT-Sektor. Die Arbeit vertieft das Verständnis von OSS und CSS als wirtschaftliches Phänomen. Es zeigt sich, dass die Koexistenz vorteilhaft ist, und z.B. eine einseitige staatliche Förderung von OSS-Firmen durch Subventionen oder die Beschaffungspolitik abzulehnen ist

    Motivation, Incentives and Performance: An Interdisciplinary Review

    This review aims to extend the application of economic knowledge to evidence supplied by other research areas on the relationships between incentives, motivation and performance. Six areas of investigation have been selected based on their potential contribution in addressing three issues relevant to economics. The first issue concerns the distinction between intrinsic and prosocial motivation; the second is the relationship between motivation and performance; the third relates to the existence of perverse effects of incentives on motivation, which can take the form of undermining or crowding-out effects. The results are discussed in terms of their implications for economic theory, showing that different mechanisms are at work under intrinsic or prosocial motivation, implying the need for different instruments to promote behaviors and associated performance. In terms of crowding-out effects, there is little evidence to support a perverse effect when incentives are offered before or during performance, whereas the psychological literature provides consolidated validation for the undermining effect. Economics can gain insights from other disciplines by employing their investigative tools and theoretical developments. A feature of particular interest for economics is gamification, that is, the use of game design elements (design of video games and similar games) in non-game contexts

    Free/Libre/Open Source Software (Floss): Lessons for Intellectual Property Rights Management in a Knowledge-Based Economy

    International audienceThe aim of this paper is to focus on the emerging situation in which open source software is nowadays produced not only by individual developers but in a growing proportion by firms that hire programmers for their own objectives of development in open source or for contributing to open source projects in the context of dedicated communities. As commercial firms it is important to analyze how and why they are capable of drawing benefits from such involvement and their connected activities. Moreover, we want to stress the different types of business model these firms rely on and the possible evolution they are likely to follow in the near future. We shown how Open Source principles provide an alternative way of thinking and managing intellectual property that do not come up against the same problems but needs a radical change in the way of drawing commercial benefits from knowledge development tasks. Then we analyze the growing involvement of commercial actors by setting up a typology of the different business models that can be observed in the OS landscape, how they correspond to the different strategies of industrial firms according to the main characteristics of their technical skills and market position. Finally, in a conclusive section we will draw the main lessons of the FLOSS experience for a possible enlargement of those principles of IPR management and business to other knowledge based commercial activities

    Society’s demands for individual and corporate social responsibility as an alternative response to market and distributive failures are becoming increasingly prominent. We first draw on recent developments in the “psychology and economics” of prosocial behavior to shed light on this trend, which reflects a complex interplay of genuine altruism, social or self image concerns, and material incentives. We then link individual concerns to corporate social responsibility, contrasting three possible understandings of the term: the adoption of a more long-term perspective by firms, the delegated exercise of prosocial behavior on behalf of stakeholders, and insider-initiated corporate philanthropy.     International audienceThis book reports the outcomes of a BELSPO (the Belgian Federal Science Policy Office) research project. The authors develop and estimate (parts of) a comprehensive model in which the micro-performance of SMEs is determined by a complex web of factors. These are situated at the level of the entrepreneur, organization and environment. In this modeling, a fit between individual, strategy, structure and environment is key to attain better performance in terms of, for example, efficiency or profitability. Strategy is assumed to be the linking pin between the entrepreneur’s (or his or her venture’s) strengths and weaknesses, and the opportunities and threats in the environment. In line with this contingency approach, the authors utilize a multi-disciplinary theoretical lens in combination with analysis techniques that allow for the identification of fits (and misfits), such as the analysis of conditional processes or dynamic multi-level QCA fit analysis
